Judge Napolitano: Here's what the FBI, Justice Department will look at in Smollett investigation

The FBI and Justice Department investigation into the handling of Jussie Smollett’s case will likely focus on whether the controversial decision to let him walk free was “an act of corruption and if so, was anybody’s civil rights violated by it,” Fox News Senior Judicial Analyst Andrew Napolitano says.

The judge’s appearance on “Fox & Friends" Thursday came after President Trump called the case “outrageous” and an “embarrassment to our nation.” Cook County State’s Attorney Kim Foxx, whose office approved the dismissal of charges that the "Empire" actor faked a hate crime, has been heavily criticized in recent days over that decision, including by Chicago’s mayor and police chief.

“Was it an act of corruption on the part of the prosecutor who first said ‘I’m not in the case’ and then said ‘I’m sort of back in but don’t tell anybody that I’m back in’?” Napolitano said. “This is absurd. Either you are in, or you are out. And if you have a conflict you have to get out.”

Foxx recused herself from the case in February but defended her office offering Smollett “an alternative prosecution model” in a series of interviews Wednesday.

SMOLLETT’S LAWYER SUGGESTS BROTHERS WORE WHITE MAKEUP DURING ATTACK, BRUSHES OFF FBI PROBE

In one with WBBM-TV, Foxx said no one tried to intervene on Smollett’s behalf, despite emails showing that she was contacted by people linked to Smollett about the case.

"There was no attempt, whatsoever, to influence the outcome of this case," she told the television station. "None whatsoever."

The case was then handed to First Assistant State’s Attorney Joseph Magats, who reports to Foxx. That passing of the torch has been questioned by legal experts.

“I don’t know what her involvement is but when someone comes to you – if I was about to sentence somebody that I really knew and liked and respected came to me and said ‘hey you should give that person a break’, what’s the right thing for me to do?” Napolitano said. “Get off the case. Don’t say publicly why, just totally get off the case don’t slowly walk back in, just get off the case. Because cases not only must be just, they must appear to be just.”

When asked by host Brian Kilmeade if there are any political figures who have gained something in the wake of the charges against Smollett being dropped, Napolitano says he’s not yet sure.

“There are pieces of the puzzle we don’t yet understand,” he said. “All of this is below the radar screen. Somebody wants something and so they did a favor for somebody else, and I can’t fill in the blanks yet, but I think it’s going to come out.”

Video: Libs Cheer as Beto Endorses Third Trimester Abortions

Democrat presidential candidate Beto O’Rourke was asked if he supports up-to-birth abortions during a campaign event in Cleveland, Ohio, but rather than answer the question directly, he instead pivoted to the general topic of abortion.

“Are you for or against third-trimester abortions?” I asked O’Rourke Monday.

“The question is about abortion and reproductive rights and my answer to you is that should be a decision that the woman makes. I trust her,” O’Rourke said to cheers and applause.

O’Rourke also co-sponsored a bill in 2017 that would have done away with most state restrictions on abortion.

From National Review:

“The former Texas congressman, who rose to prominence during a failed Senate run against Ted Cruz (R., Texas) last year, co-sponsored in 2017 the Women’s Health Protection Act, which would have eliminated nearly all state restrictions on abortion, including so-called right-to-know laws and mandatory waiting periods.”

“O’Rourke’s refusal to engage with the policy debate surrounding third-trimester abortions in particular is broadly reflective of the Democratic presidential field, which comprises lawmakers who maintain a blanket opposition to abortion restrictions regardless of gestational age.”

Mike Adams joins Owen Shroyer live via Skype to break down an array of news stories including the push to censor nutritional / health information by big tech, medical fascism, 3-D printed gun technology, and how some feminists are calling for abortion to be an option for women after an undetermined amount of time following the birth. It could be days, weeks, or even months after the successful delivery that the mother “chooses” to abort the infant.

Nvidia CEO says no plans for more acquisitions after Mellanox deal

TEL AVIV (Reuters) – U.S. chip supplier Nvidia Corp has no plans for further acquisitions for the time being after its nearly $7 billion purchase of Israeli chip designer Mellanox Technologies, its chief executive said on Tuesday.

“I like to have money and so I am going to save money for a while,” Jensen Huang told a Calcalist business conference in Tel Aviv. “This is a great acquisition. I am not looking for another.”

Nvidia earlier this month agreed to buy Mellanox for $6.8 billion, beating rival Intel Corp in a deal to help the firm boost its data center and artificial intelligence (AI) business.

“Everybody wanted it,” Huang said. When asked if he paid too much, he said: “Beyond imagination.”

“But the company has created amazing technology and has a great future,” he said.

Nvidia, once known as a provider of gaming chips, now also provides chips to speed up AI tasks such as teaching servers to recognize images. Mellanox makes chips that connect those servers together inside the data center.

“Our strategy is we would like to double down on data centers. The future of computing is heavily focused on data centers,” Huang said.

Nvidia gets about a quarter of its revenue from data centers, with the $2.9 billion in sales in 2018 from the segment growing 52 percent year over year.

Huang noted that following the deal with Mellanox, which is expected to close by the end of the year, there would be no cost cuts and the Mellanox brand would be maintained.

“We are going to keep every single product line.

We are going to keep every single employee,” he said, noting he planned to grow Mellanox’s business in Israel. “There is no overlap whatsoever and there are no cost synergies.”

Huang said investors were initially wary about the acquisition. But since the deal’s announcement on March 11, Nvidia’s shares have risen 15 percent to $173.80.

Pope leads Catholics into Easter with vigil Mass

VATICAN CITY (Reuters) – Pope Francis led the world’s Roman Catholics into Easter at a vigil Mass in St. Peter’s Basilica on Saturday night, urging the faithful to live not for transient things like wealth and success but for God.

The largest church in Christendom was dark at the start of the long service as the pope carved into a candle the numbers of the year 2019 and the first and last letters of the Greek alphabet – Alpha and Omega – signifying that God is the beginning and end of all things.

Easter, the most important day in the Church’s liturgical calendar, commemorates the day Christians believe Jesus rose from the dead.

Francis, marking his seventh Easter season as pope, wove his homily around the Bible account of the women who went to Jesus’ tomb only to find it empty and the large stone that had sealed it had been cast away.

“God takes away even the hardest stones against which our hopes and expectations crash: death, sin, fear, worldliness,” he said.

“There is another stone that often seals the heart shut: the stone of sin. Sin seduces; it promises things easy and quick, prosperity and success, but then leaves behind only solitude and death. Sin is looking for life among the dead, for the meaning of life in things that pass away,” he said.

During the Mass, Francis welcomed eight adult converts into the Church, conferring on them the sacraments of baptism and confirmation. They were from Italy, Albania, Ecuador, Indonesia and Peru.

On Sunday, the 82-year-old leader of the world’s 1.3 billion Roman Catholics is due to say a Mass in St. Peter’s Square and read the traditional “Urbi et Orbi” (To The City and The World) message.

NEW DELHI (Reuters) – Lessors to India’s Jet Airways Ltd are planning to ask the country’s aviation regulator to de-register many more planes leased to the airline, three sources told Reuters, signaling that a planned bailout of the troubled carrier is failing to assuage their concerns.

About six of Jet’s lessors are likely to apply to India’s Directorate General of Civil Aviation (DGCA) to de-register up to 15 of the grounded planes, over the next 10 days, said one of the sources with direct knowledge of the situation.

Once a plane is de-registered, the lessors are free to take them out of the country and lease them to other airlines.

While some lessors have already taken a few planes out of India after a mutual agreement with Jet, sources have told Reuters, the latest series of applications to the DGCA would be on a non-consensual basis.

Jet did not immediately respond to a request for comment.

Jet, India’s oldest private carrier now controlled by its lenders, has had to ground more than three-quarters of its fleet of 119 planes, many due to non-payment to lessors, leading to hundreds of flight cancellations.

Avolon, one of the world’s biggest aircraft lessors, on Thursday applied to the DGCA to take two of its planes placed with Jet outside of India, making it the first to pull planes out on a non-consensual basis.

About 100 of Jet’s 119 mainly Boeing Co planes are leased by companies such as Avolon, GE Capital Aviation Services (GECAS) and Aercap Holdings. It was not immediately clear which of the lessors were planning to apply for de-registration in the coming days.

AHMEDABAD/NEW DELHI (Reuters) – PepsiCo Inc has sued four Indian farmers for cultivating a potato variety that the snack food and drinks maker claims infringes its patent, the company and the growers said on Friday.

Pepsi has sued the farmers for cultivating the FC5 potato variety, exclusively grown for its popular Lay’s potato chips. The FC5 variety has a lower moisture content required to make snacks such as potato chips.

PepsiCo is seeking more than 10 million rupees ($142,840.82) each for alleged patent infringement.

The farmers grow potatoes in the western state of Gujarat, a leading producer of India’s most consumed vegetable.

“We have been growing potatoes for a long time and we didn’t face this problem ever, as we’ve mostly been using the seeds saved from one harvest to plant the next year’s crop,” said Bipin Patel, one of the four farmers sued by Pepsi.

Patel did not say how he came by the PepsiCo variety.

A court in Ahmedabad, the business hub of Gujarat, on Friday agreed to hear the case on June 12, said Anand Yagnik, the lawyer for the farmers.

“In this instance, we took judicial recourse against people who were illegally dealing in our registered variety,” A PepsiCo India spokesman said. “This was done to protect our rights and safeguard the larger interest of farmers that are engaged with us and who are using and benefiting from seeds of our registered variety.”

PepsiCo, which set up its first potato chips plant in India in 1989, supplies the FC5 potato variety to a group of farmers who in turn sell their produce to the company at a fixed price.

The All India Kisan Sabha, or All India Farmers’ Forum, has asked the Indian government to protect the farmers.

The farmers’ forum has also called for a boycott of PepsiCo’s Lay’s chips and the company’s other products.

The Ministry of Agriculture & Farmers’ Welfare did not immediately respond to an email seeking comment.

PepsiCo is the second major U.S. company in India to face issues over patent infringement.

Stung by a long-standing intellectual property dispute, seed maker Monsanto, which is now owned by German drugmaker Bayer AG, withdrew from some businesses in India over a cotton-seed dispute with farmers, Reuters reported in 2017. (reut.rs/2ncBknn)

CHICAGO/BENGALURU (Reuters) – Archer Daniels Midland Co said on Friday it was considering spinning off its ethanol business after slim biofuel margins and Midwestern floods slammed the U.S. grains merchant’s profit, which tumbled 41 percent in the first quarter.

ADM said it was creating an ethanol subsidiary, which will include dry mills in Columbus, Nebraska; Cedar Rapids, Iowa; and Peoria, Illinois.

The ethanol subsidiary will report as an independent segment, the company said, allowing options “which may include, but are not limited to, a potential spin-off of the business to existing ADM shareholders.”

Results were hit by the “bomb cyclone” blizzards that devastated the Midwest and Great Plains this year, causing massive flooding across Nebraska, Iowa and Missouri, washing out rail lines and wreaking havoc in the moving and processing of corn, soybeans and wheat. One-sixth of U.S. ethanol production was halted.

In March, ADM warned Wall Street that flooding and severe winter weather in the U.S. Midwest would reduce its first-quarter operating profit by $50 million to $60 million.

“The first quarter proved more challenging than initially expected,” said Chairman and Chief Executive Officer Juan Luciano, with earnings down in its starches, sweeteners and bioproducts unit. Luciano said impacts of the severe weather ultimately “were on the high side of our initial estimates”.

Ongoing problems in the ethanol industry added to the problems and “limited margins and opportunities” for ADM, Luciano said.

The ethanol industry has been in the midst of a historic downswing due to the U.S.-China trade war, excess domestic supply and weak margins.

ADM, which had been an ethanol pioneer, signaled to Wall Street in 2016 that it was hunting for options and considering sales of its U.S. dry ethanol mills. Luciano told Reuters this year that offers ADM had received for the mills were too low.

In addition, ADM said it planned to repurpose its corn wet mill in Marshall, Minnesota, to produce higher volumes of food and industrial-grade starches.

Other major traders are alsy trying to distance themselves from struggling ethanol businesses. Louis Dreyfus Company BV spun off its Brazilian sugar and ethanol business Biosev in 2013. Rival Bunge sold its sugar book and has sought a buyer for its Brazilian mills since 2013.

ADM, which makes money trading, processing and transporting crops, such as corn, soybeans and wheat, has been looking to strengthen its core business. Last month it said it would seek voluntary early retirements of some North American employees and cut jobs as part of a restructuring effort.

The company expects to lower 2019 capital spending by 10 percent to between $800 million and $900 million.

Net earnings attributable to the company fell to $233 million, or 41 cents per share, in the three months ended March 31, from $393 million, or 70 cents per share, a year earlier.

Revenue fell to $15.30 billion from $15.53 billion. On an adjusted basis, the company earned 46 cents per share, while analysts on average had estimated 60 cents, according to IBES data from Refinitiv.

A Cook County judge recently called out embattled State Attorney Kim Foxx for upholding a double standard by prosecuting a woman for filing a false police report — but dropping similar charges against embattled “Empire” actor Jussie Smollett.

Foxx has faced intense criticism over her office’s decision to drop a 16-count indictment against Smollett, just weeks after bringing the charges against the high-profile TV star. Foxx’s deal with Smollett, which did not require him to admit guilt, drew ire from the public, the city’s top cop and the former mayor who called it a “whitewash of justice.”

JUSSIE SMOLLETT CHICAGO PROSECUTOR KIM FOXX CHIDED BY NATIONAL ATTORNEYS GROUPS AFTER JUSSIE SMOLLETT CHARGES DROPPED

Cook County Judge Marc Martin, who was presiding over an unrelated case, chastised Foxx and her office for creating a situation where anyone charged with filing a false report would expect the same leniency her office afforded Smollett.

Candace Clark, 21, is facing one felony count of making a false report. Prosecutors accused her of giving a friend access to her bank account and then telling authorities the money had been stolen. She denies the charges and claims she’s the victim of Foxx’s double standard — something the judge weighed in on.

“Well, Ms. Clark is not a movie star, she doesn’t have a high-price lawyer, although, her lawyer’s very good. And this smells, big time,” Martin said to prosecutors during a recent hearing, Fox 32 reported. “I didn’t create this mess, your office created this mess. And your explanation is unsatisfactory to this court. She’s being treated differently.”

The judge continued, “There’s no publicity on this case. She doesn’t have Mark Geragos as her lawyer or Ron Safer or Judge Brown. It’s not right. And (if) I proceed in this matter, you’re just digging yourselves further in a hole. (If the) press gets a hold of this, it’ll be in a newspaper. Why is Ms. Clark being treated differently than Mr. Smollett?”

Foxx recused herself from the Smollett case in February but continued to oversee the investigation through text messages with her assistant Joseph Magats.

The text messages revealed Foxx called Smollett a “washed up celeb who lied to cops.” They also show she cautioned Magats about throwing the book at Smollett.

“Sooo……I’m recused, but when people accuse us of overcharging cases…16 counts on a class 4 becomes exhibit A,” Foxx wrote to Magats on March 8.

“Pedophile with 4 victims 10 counts. Washed up celeb who lied to cops, 16. On a case eligible for deferred prosecution I think it’s indicative of something we should be looking at generally. Just because we can charge something doesn’t mean we should,” she added, referring to the case of R&B singer R. Kelly, who was indicted on 10 counts of aggravated criminal sexual abuse in connection with four women, three of whom were underage.

KIM FOXX’S CHIEF ETHICS OFFICER RESIGNS FOLLOWING SMOLLETT CONTROVERSY

President Trump said last month he asked for a federal review of Foxx’s decision to drop the charges against Smollett. He also called the actor “an absolute embarrassment to our country.”

The Smollett case garnered national attention and threatened to tear Chicago apart. It pit the police department and mayor against prosecutors and underscored the idea that wealthy people are somehow above the law.

Smollett told police he was attacked on Jan. 29 around 2 a.m. as he was returning home from a sandwich shop in Chicago. He said two masked men shouted racial and anti-gay slurs, poured bleach on him, beat him and tied a rope around his neck. He claimed they shouted, “This is MAGA country” — a reference to President Trump’s “Make America Great Again” campaign slogan.

After an intense investigation, police said Smollett staged the entire incident to drum up publicity for his career.

Smollett has strongly denied the accusations.

BERLIN (Reuters) – Wulf Matthias will not stand for a second term as Wirecard’s chairman in 2020, German daily Handelsblatt said on Friday, citing sources in the financial industry.

For age reasons alone this would not be an option for Matthias, aged 75, Handelsblatt added.

Matthias will keep his mandate until it ends in 2020, the paper quoted a company spokeswoman as saying.

Wirecard was not immediately available for comment when contacted by Reuters.

President Donald Trump says the National Rifle Association is getting stronger, not weaker, and is doing important work vital to making his “Make America Great Again” slogan a reality.

Trump is heading to Indianapolis Friday to address the nation’s largest gun rights organization, which played a pivotal role in his victory in 2016.

The NRA spent millions of dollars to help elect Trump in 2016 but had a much lower profile during the 2018 midterms. It’s unclear how visible the NRA will be in 2020 after a series of mass shootings that has hardened public sentiment against gun violence.

Trump disagrees with those who say the NRA is getting weaker. He tweeted  Friday morning  that the NRA is “getting stronger & stronger and doing some really great and important work.”
