The Latest: Jury convicts man in Oklahoma City bomb plot

The Latest on the trial of a man accused of planning to detonate what he believed was an explosive device outside an Oklahoma City bank (all times local):

A man accused of trying to detonate what he believed was an explosives-laden van outside an Oklahoma City bank has been found guilty by a federal jury.

Jurors on Monday convicted 24-year-old Jerry Drake Varnell of attempted use of an explosive device and attempted use of a weapon of mass destruction.

Prosecutors alleged Varnell planned to detonate what he thought was a half-ton (450-kilogram) vehicle bomb on Aug. 12, 2017. The FBI learned of the plan and an undercover agent posing as someone who could help construct the device provided inert materials.

Varnell's attorneys claimed he was entrapped and his parents say he suffers from mental health issues.

No sentencing date was set. Varnell faces up to life in prison for attempting to use a weapon of mass destruction.

Varnell has pleaded not guilty and his parents have said he is a paranoid schizophrenic who has been in several mental hospitals. Defense attorneys say he was entrapped.

Varnell has been found mentally competent to stand trial.

TOKYO (Reuters) – The Tokyo Stock Exchange’s push to weed out small and weak firms from its main board could take years, but some fund managers are already ditching small-caps for fear they could be excluded from benchmarks.

Asia’s second largest stock exchange is expected to unveil a plan in coming months to revamp its stock market structure, in part a response to criticism that it has too many listed firms on the main board, seen as the blue ribbon segment of the bourse, and its Topix index.

“It’s good that the TSE wants to do something about the Topix index, which appears to be making Japan look full of zombie companies,” said Toru Ohara, chief investment officer at Okasan Asset Management.

“A stock market benchmark is a strategic product for a country. Having a strong stock index is one of the cheapest ways to boost the economy,” he said.

In November, there were 2,119 firms on the TSE’s first section – that compares with 292 in Euronext’s compartment A and 500 in London Stock Exchange’s Premium Listing.

And it’s not far off the 2,434 in the New York Stock Exchange in the United States, whose economy is almost four times bigger than Japan’s.

Unlike the main bourses of Wall Street and elsewhere – where the numbers of listings have shrunk due to mergers, failures to meet listing standards and bankruptcies – Tokyo’s list of counters has risen over the last three decades.

Additionally, there has been less shareholder pressure in Japan for companies to boost profits while the exchange’s exit rules are considered relatively lax.

As a result, about a third of main board’s counters are now valued at below the 25 billion yen ($226 million) mark the exchange itself sets as a minimum for new listings. Many of them also trade below their book value.

SMALL CAP WHACK

Some fund managers have already started to take the TSE’s reform drive into consideration.

“That is something investors keep in some corner of their mind,” said Yas Iwanaga, chief investment officer at Amundi Japan.

Indeed, small caps have underperformed the overall market since November, when an external panel set up by TSE to look into the issue proposed the exchange should consider having stricter rules for companies to stay on the main board.

The Topix Small, an index of all listed firms excluding top 500 companies, has fallen 5.4 percent, compared with a 2.6 percent fall in the Topix.

The Topix Small Value fared worse, falling 5.6 percent.

“I wouldn’t say small cap shares will be deserted forever. If they become cheaper, there will be some buying,” said Amundi’s Iwanaga.

While some analysts attribute the small cap underperformance to global demand for bigger stocks, most agree a major change at the TSE would have a huge impact on markets.

“It would be such an easy, tradable idea. Small, value shares would come under major pressure,” said Masahiro Suzuki, senior quantitative analyst at Daiwa Securities.

At the same time, many investors believe attempts to trim the main board would meet corporate opposition given the prestige such listings hold in Japan.

Main board firms have better access to bank loans and are seen attracting top talent more easily.

“It even affects staff at those companies, because it is easier for people working for the main board companies to get housing loans for instance,” said an executive at asset management firm, who declined to be identified as he is not authorized to speak publicly on the matter. “You should expect very strong resistance.”

It would also be difficult to get consensus on criteria for the main board. Many investors worry that market capitalization thresholds would exclude some promising companies.

Given likely resistance, some market participants think a better solution for the TSE would be to create a new elite market above the first section, rather than kicking out existing companies.

Akiya Kiyota, CEO of Japan Exchange Group, which runs TSE, has said he personally thinks there are too many markets now, noting the current four: the first and second sections and two start-up markets.

But he has so far steered clear of saying how he wants to streamline and when he plans to make changes, citing ongoing discussion at the panel.

Brett Kavanaugh To Spend Summer Overseas

Justice Brett Kavanaugh has joined the faculty of George Mason University’s Antonin Scalia Law School, where he will co-teach a summer course in the United Kingdom on the origins of the Constitution.

Kavanaugh, who has evaded public attention following his bitter confirmation in October 2018, will remain in England for nearly six weeks while the Court is on its summer recess. The justice has generally kept a low profile since joining the Court, avoiding solo public appearances and divisive opinion writing.

“It is a rare opportunity for students to learn from a Supreme Court justice and we believe that contributes to making our law program uniquely valuable for our students,” the law school said in a statement.

George Mason University’s student newspaper was first to report that Kavanaugh joined the law faculty.

It is common for the justices to teach law abroad during the summer, when the high court is not in session. Justices Ruth Bader Ginsburg and Neil Gorsuch led seminars in Italy in July 2018, while retired Justice Anthony Kennedy taught in Austria.

Yet Kavanaugh’s 38-day course is unusually long in comparison to his colleagues, whose teaching commitments generally run a few short days. Ginsburg and Gorsuch’s Italian jaunt ran about two weeks, while Kennedy’s lasted about three.

Another round of skirmishes relating to Kavanaugh’s confirmation are likely this summer, which may be a factor in his lengthy retreat to the UK. Politico’s Anna Palmer and Jake Sherman will publish an account of Congress during President Donald Trump’s tenure in April, which purports to contain the definitive story on his confirmation. Another book called “Confirmation Bias” will follow in June from Carl Hulse of The New York Times.

Kavanaugh defenders Mollie Hemingway and Carrie Severino will publish their own book-length treatment of his nomination this summer, which is meant to preempt forthcoming projects thought to be unflattering, according to Axios. Ruth Marcus, The Washington Post’s deputy editorial page editor and Jackie Calmes of the Los Angeles Times are also writing books on the Kavanaugh confirmation. Kate Kelly and Robin Pogrebin of The New York Times will publish a history of the justice’s early years this October called “The Education of Brett Kavanaugh.”

Once a staple of law school programming, Kavanaugh lamented that he might never return to academia, after three women publicly accused him of sexual misconduct. He denied those allegations.

“I love teaching law,” Kavanaugh told Senate Judiciary Committee Democrats during his second confirmation hearing in September 2018. “But thanks to what some of you on this side of the committee have unleashed, I may never be able to teach again.”

Just days after that hearing, Harvard Law School announced it had cancelled Kavanaugh’s January-term course on the modern Supreme Court. The announcement followed weeks on intense pressure from students and alumni, who hoped the law school would disassociate itself with the beleaguered Supreme Court nominee. Kavanaugh was named the Samuel Williston Lecturer on Law at Harvard in 2009.

BEIJING (Reuters) – China’s desire to develop close ties with Iran will remain unchanged, regardless of the international situation, President Xi Jinping told the speaker of Iran’s parliament, ahead of Thursday’s visit to Beijing by Saudi Arabia’s crown prince.

China has traditionally played little role in Middle East conflicts or diplomacy, despite relying on the region for oil, with Iran its fourth largest supplier last year, but has been trying to raise its profile, especially in the Arab world.

Saudi Arabia’s King Salman visited Beijing in 2017, and Saudi Crown Prince Mohammed bin Salman arrives on Thursday for a two-day visit.

However, China has had to walk a fine line, as it also has close ties with Saudi Arabia’s regional foe, Iran.

Meeting Iranian Parliament Speaker Ali Larijani on Wednesday, Xi said the two countries had a long friendship and shared long-tested mutual trust, according to a Chinese foreign ministry statement issued on Thursday.

“No matter how the international and regional situation changes, China’s resolve to develop a comprehensive strategic partnership with Iran will remain unchanged,” it paraphrased Xi as saying.

China and Iran should further deepen strategic mutual trust and continue to support each other on core interests and major concerns, Xi added.

China advocates cooperation among international and regional parties to swiftly put the Middle East on the road of stability and development, he said.

“We support Iran in playing a constructive role in maintaining regional peace and stability and are willing to closely communicate and coordinate on regional issues,” Xi added.

In Beijing, Larijani has been accompanied by Oil Minister Bijan Zanganeh and Foreign Minister Mohammad Javad Zarif, who met his Chinese counterpart on Tuesday.

Washington’s major European allies opposed a decision last year by U.S. President Donald Trump to abandon the Iran nuclear deal that included China and Russia, and lifted international sanctions on Iran, in return for curbs on its nuclear program.

Marshals arrest fugitive from Connecticut in South Carolina

A man who disappeared after escaping from a Connecticut prison 29 years ago has been arrested in South Carolina.

WPDE-TV reports the U.S. Marshal's Office took Ted Lee Livingston into custody Wednesday in Longs, near the South Carolina coast. Livingston was wanted in Connecticut on an escape charge dating from 1990.

Horry County Police say Livingston had changed details about his birthday and other identifying information on his South Carolina driver's license to evade capture.

Livingston is being held in the J. Reuben Long Detention Center while he awaits extradition back to Connecticut.

The Hartford Courant reports the 49-year-old Livingston was convicted of sale of a controlled substance and sentenced to 4 1/2 years in prison in January 1990.

It was not immediately clear whether he's represented by an attorney.

Biden video ‘highlighted all of his weaknesses’ and shows he’s ‘out of date’: Matthew Continetti

Former Vice President Joe Biden did not do himself any favors when he released a video message addressing the controversy over his history of inappropriate touching, Washington Free Beacon editor-in-chief Matthew Continetti argued Wednesday.

In the video posted earlier in the day on Twitter, Biden promised he would be “more mindful and respectful of people’s personal space” going forward but never offered an apology to the women accusing him of making them feel uncomfortable. Since the video was released, at least three more accusers have come forward with accusations against him, making the total at least seven women.

During Wednesday's All-Star panel segment on Fox News' "Special Report with Bret Baier," Continetti -- along with Washington Times opinion editor Charles Hurt and Reuters White House correspondent Jeff Mason -- weighed in on the political fallout of Biden’s attempt at damage control as he mulls a 2020 run for president.

Continetti argued that you can “make a human connection” as Biden says “without sniffing somebody’s hair.”

“The video highlighted all of his weaknesses," Continetti continued. "His voice seemed frail, the production value is poor, he wasn’t framed very well, he was very pale, and he confesses that social norms have passed him by, which means he’s out of date -- which is exactly why Democrats are worried about him entering the race.

“This is another bad moment for Biden in several weeks of bad news. It makes me wonder whether he’ll actually pull the trigger and enter the race.”

But Mason told the panel that Biden was being “authentic,” pointing out that the former vice president wasn’t reading from a script and that his video message indicated that his previous statements weren’t enough and that he didn’t “feel the need to apologize.”

Meanwhile, Hurt noted how “strange” it is that former President Barack Obama hasn’t weighed in on the controversy and suggested that Obama and Biden overhyped their relationship while they were in office.

UK’s only female giant panda artificially inseminated at zoo

Britain's only female giant panda has been artificially inseminated in a bid to produce a cub.

Officials at Edinburgh Zoo in Scotland said Monday it's "far too early" to know if the procedure was a success. The zoo said Tian Tian had her annual health check on Sunday and was artificially inseminated "under expert veterinary care."

Tian Tian, 15, has had cubs in China but not in Britain, where she and male companion Yang Guang have lived since 2011. Her name means "sunshine."

There have been attempts to breed a cub every year since then, thus far without success. The zoo says the gestation period for a giant panda is typically about five months.

NEW DELHI/MUMBAI (Reuters) – The grounding of India’s Jet Airways is turning into a quick windfall and long-term opportunity for international airlines keen to scoop up nearly a million outbound passengers from what was once the nation’s biggest airline.

Jet, which previously had a fleet of around 120 largely Boeing Co planes, was forced to indefinitely halt all flight operations on April 17 after its banks rejected the carrier’s plea for emergency funds.

The carrier’s descent into crisis has benefited international airlines in the form of rising fares and demand, data showed.

Fares from India to cities such as Dubai, London, New York, Singapore and Bali in the first quarter of 2019 rose between 4 percent and 32 percent from a year ago, according to Indian travel portal MakeMyTrip Ltd.

In the peak travel months of May and June, fares to London have spiked as much as 36 percent and tickets to San Francisco are up nearly 20 percent from a year ago, according to data from travel portal Yatra.com.

“For the next three months it’s actually bonanza time for international players,” said Ashish Nainan, a research analyst at CARE Ratings. “At least until the middle of June, the fares are not going to come down.”

Due to rising demand, even before Jet’s lessors grounded planes, carriers such as British Airways, Cathay Pacific Airways Ltd, Singapore Airlines Ltd and United Airlines saw an up to a 27 percent increase in passenger numbers from India in the last quarter of 2018, data from India’s aviation regulator showed. That is the latest period for which the data is available.

India is one of the world’s fastest-growing aviation markets, clocking 15-20 percent domestic growth in recent years. It has long had only two full-service long-haul carriers, state-run Air India and Jet.

Jet is now hoping to be bailed out by a new investor, with final bids due on May 10.

INCREASING CAPACITY

Before its grounding, Jet had the biggest share of India’s outbound international air traffic, carrying 12 percent of the 7.8 million passengers headed overseas in the Oct-Dec quarter, down from 14 percent a year earlier, data from the Directorate General of Civil Aviation showed.

The total number of passengers traveling overseas with Jet fell 10 percent during the last quarter of 2018 even as the outbound travel market grew about 5 percent.

Meanwhile, Singapore Airlines posted a 27 percent increase in passengers from India, Cathay registered 17 percent growth and British Airways saw a 10 percent rise in the same period.

Cathay said the events at Jet combined with increasing demand for travel had led it to deploy larger aircraft with more seats on some Indian routes.

“In the long term we would certainly like to be able to offer more capacity into India, not just on our existing routes but by establishing new services to secondary cities,” Cathay said in a statement.

Singapore Airlines, in an email to Reuters, said the Indian market is “very promising” but declined to give details of airfare levels or demand patterns in the wake of Jet’s exit, citing a quiet period before the release of its annual results.

DOMESTIC GAINS

Jet’s grounding has also had a big impact on the domestic market, with inter-city air fares to major cities such as New Delhi, Mumbai, Bengaluru and Kolkata soaring more than 20 percent in May and June, according to Yatra.com.

The spike in fares is expected to underpin strong earnings for IndiGo and SpiceJet Ltd, which are set to report results for the quarter ended March 31 in the coming weeks.

“Domestic Indian carriers are the main benefactors, but I suspect if Jet fails to be revived by May 10 then Vistara and other airlines that ply international routes, particularly the lucrative Gulf market, are the main winners,” said Shukor Yusof, the head of aviation consultancy Endau Analytics. Vistara is a joint venture of India’s Tata Sons and Singapore Airlines.

Inadequate bilateral traffic rights between India and other countries, however, could be an impediment to foreign carriers’ hopes of winning business lost by Jet, some analysts said.

“Even before Jet’s operational shutdown, international capacity was significantly constrained,” said Kapil Kaul, CEO for South Asia of consultancy CAPA. “We have now more serious capacity challenge … this is unlikely to be stabilized in the near term.”

A new national government likely to be in place sometime after elections end in May is expected to address the international capacity constraints, and once bilateral agreements are eased airlines including Emirates, Turkish and Qatar would immediately benefit, said Kaul.

“We would love to add more flights but we are at the limit of the allocation granted to us for traffic rights,” Emirates Chief Commercial Officer Thierry Antinori told reporters in Dubai on Wednesday.

(Reuters) – AstraZeneca Plc beat first-quarter sales and earnings expectations on Friday as the British drugmaker benefited from a push into cancer drugs and emerging markets including China.

Newer treatments such as lung cancer drug Tagrisso, now the company’s top selling medicine, have helped the drugmaker’s return to growth after years of crumbling sales due to patent losses on older drugs.

Sales in China have shown explosive growth, more than doubling since 2012, but AstraZeneca executives on Friday said that may not be sustained.

“The enormous growth you currently see in China, 28 percent, probably is not sustainable, but we feel very bullish that the growth will continue to be at a pace of between 15 percent and 20 percent,” Ruud Dobber, executive vice president, BioPharma, told Reuters.

Shares of the company were down 0.2 percent at 5,878 pence at 1031 GMT.

The turnaround in AstraZeneca’s fortunes has been powered by a push into cancer treatments led by Chief Executive Pascal Soriot, who saw off a 2014 takeover bid from Pfizer in part by promising annual sales of $45 billion by 2023.

In the first quarter, sales from its oncology unit rose 59 percent to $1.89 billion, accounting for 35 percent of total product sales.

The company has moved deeper into cancer therapy market through wide-ranging deals, including those for immunotherapy and targeted therapy. Last month, it agreed a multi-billion dollar oncology deal with Japan’s Daiichi Sankyo Co Ltd.

“We’re reaching that point where after years of having to keep faith, we have actually got something tangible to believe in,” Hargreaves Lansdown analyst Nicholas Hyett said.

AstraZeneca also backed its annual sales and earnings forecast and said it has extensively prepared for UK’s anticipated exit from the European Union, even in the event of a no-deal exit.

The company has already spent more than 40 million pounds ($52 million) on Brexit preparations, including stockpiling six weeks’ worth of drugs in the UK and four weeks in continental Europe to guard against shortages.

AstraZeneca said product sales rose 14 percent at constant currency to $5.47 billion in the quarter, led by its lung cancer drug Tagrisso and respiratory treatment Pulmicort.

China sales increased by 28 percent to $1.24 billion in the quarter, accounting for nearly a quarter of overall product sales.

Core earnings came in at 89 cents per share in the quarter. Analysts on average were expecting core earnings of 85 cents per share and product sales of $5.29 billion, according to a company provided consensus of 19 analysts.

It’s the type of crime that doesn’t happen every day.

Police in the suburbs of Philadelphia say three suspects broke into a medical facility in Wynnewood, Pennsylvania, last Saturday and fled with 18 colonoscopies – devices used for examining the health of patients’ colons.

The devices were reportedly worth a total of about $450,000, authorities said.

But police were perplexed about what the suspects might have planned to do with the instruments.

“This is not something that a typical pawn shop might accept,” Lower Merion Police Detective Sergeant Michael Vice told Philadelphia’s WCAU-TV. “My feeling would be that it was some type of black market sales.”

Such a market apparently does exist, Lower Merion Police Superintendent Michael J. McGrath told Philly.com.

“They appeared to know precisely where to go, and they pried the door open,” McGrath said of the suspects, who were captured on surveillance video leaving the facility, carrying bulging backpacks.

Police are hoping the suspects will be caught in the end.
