California judge rules son of twin gay couple is American citizen

A federal judge in California ruled Thursday that a twin son of a gay married couple has been an American citizen since birth, handing a defeat to the U.S. government, which had only granted the status to his brother.

The State Department was wrong to deny citizenship to 2-year-old Ethan Dvash-Banks because U.S. law does not require a child to show a biological relationship with their parents if their parents were married at the time of their birth, District Judge John F. Walter found.

A lawsuit filed by the boys' parents, Andrew and Elad Dvash-Banks, sought the same rights for Ethan that his brother, Aiden, has as a citizen.

Each boy was conceived with donor eggs and the sperm from a different father — one an American, the other an Israeli citizen — but born by the same surrogate mother minutes apart.

The government had only granted citizenship to Aiden, who DNA tests showed was the biological son of Andrew, a U.S. citizen. Ethan was conceived from the sperm of Elad Dvash-Banks, an Israeli citizen.

The suit was one of two filed last year by an LGBTQ immigrant rights group that said the State Department is discriminating against same-sex binational couples by denying their children citizenship at birth. The cases filed in Los Angeles and Washington by Immigration Equality said the children of a U.S. citizen who marries abroad are entitled to U.S. citizenship at birth no matter where they are born, even if the other parent is a foreigner. Only the Los Angeles case was decided Thursday.

The State Department did not immediately respond to an email seeking comment on the ruling. Previously the department pointed to guidance on its website that said there must be a biological connection to a U.S. citizen to become a citizen at birth.

"This family was shocked and appalled and angry when they were told their family wasn't legal," said Aaron Morris, executive director of Immigration Equality. "They wanted their twin boys to be treated exactly the same."

Morris said the government wrongly applied a policy for children born out of wedlock to married same-sex couples.

Walter agreed, writing that the State Department statute does not contain language "requiring a 'blood relationship between the person and the father' in order for citizenship to be acquired at birth."

"This is justice! We are hopeful that no other family will ever have to go through this again. It's like a giant rock has been removed from our hearts," Andrew and Elad Dvash-Banks said in a statement provided by Immigration Equality.

Andrew Dvash-Banks was studying in Israel when he met his future husband, Elad, an Israeli citizen. Because they couldn't marry at the time in the U.S. or in Israel, they moved to Canada, where they wed in 2010. The children were born by a surrogate in September 2016.

Everything seemed fine until the couple brought their cranky infants to the American consulate in Toronto a few months later to apply for citizenship and the woman at the counter began asking probing questions they found shocking and humiliating.

The consular official told them she had discretion to require a DNA test to show who the biological father was of each boy and without those tests neither son would get citizenship. The men knew that Andrew was Aiden's biological father and Elad was Ethan's but they had kept it a secret and hadn't planned on telling anyone.

After submitting the DNA test results that proved who fathered each boy, the couple received a large and small envelope from the U.S. on March 2. The big one included Aiden's passport. The other was a letter notifying Andrew that Ethan's application had been denied.

The family has since moved to Los Angeles to be closer to Andrew Dvash-Banks' family.

The other case involves two women, one from the U.S., and one from Italy, who met in New York, wed in London and each gave birth to a son. The State Department didn't recognize the couple's marriage, the lawsuit said, and only granted citizenship to the boy whose biological mother was born and raised in the U.S.

PARIS (Reuters) – Three members of the French government have quit their jobs ahead of campaigns for European Parliament elections next month and municipal elections in France next year, the presidency said on Wednesday.

European affairs minister Nathalie Loiseau, government spokesman Benjamin Griveaux and digital junior minister Mounir Mahjoubi, have left the government, the Elysee palace said in a brief statement.

Loiseau had earlier announced her resignation in order to lead the LREM party into the May 26 European Parliament vote and Mahjoubi has said he would run for Paris mayor in 2020.

Griveaux has repeatedly said he will announce by the end of spring whether he is running for Paris mayor.

The statement had no other details although the three departures are likely to lead to a cabinet mini-reshuffle in the coming days.

Asked when the reshuffle could take place, an Elysee official had no comment.

Eating Nuts Boosts Brain Health – Study

Long-term, high nut consumption could be the key to better cognitive health in older people according to new research from the University of South Australia.

In a study of 4822 Chinese adults aged 55+ years, researchers found that eating more than 10 grams of nuts a day was positively associated with better mental functioning, including improved thinking, reasoning and memory.

Lead researcher, UniSA’s Dr. Ming Li, says the study is the first to report an association between cognition and nut intake in older Chinese adults, providing important insights into increasing mental health issues (including dementia) faced by an aging population.

“Population aging is one of the most substantial challenges of the twenty-first century. Not only are people living longer, but as they age, they require additional health support which is placing unprecedented pressure on aged-care and health services,” Dr. Li says.

“In China, this is a massive issue, as the population is aging far more rapidly than almost any other country in the world.

“Improved and preventative health care – including dietary modifications – can help address the challenges that an aging population presents.

“By eating more than 10 grams (or two teaspoons) of nuts per day older people could improve their cognitive function by up to 60 percent– compared to those not eating nuts – effectively warding off what would normally be experienced as a natural two-year cognition decline.”

China has one of the fastest growing aging populations. In 2029, China’s population is projected to peak at 1.44 billion, with the ratio of young to old dramatically imbalanced by the rising ranks of the elderly. By 2050, 330 million Chinese will be over age 65, and 90.4 million will be over age 80, representing the world’s largest population of this most elderly age group.

More broadly, the World Health Organization says that by 2020, the number of people aged 60 years and older will outnumber children younger than five years old.

The UniSA study analyzed nine waves of China Health Nutrition Survey data collected over 22 years, finding that 17 percent of participants were regular consumers of nuts (mostly peanuts). Dr. Li says peanuts have specific anti-inflammatory and antioxidant effects which can alleviate and reduce cognitive decline.

“Nuts are known to be high in healthy fats, protein and fiber with nutritional properties that can lower cholesterol and improve cognitive health,” Dr. Li says.

“While there is no cure for age-related cognition decline and neurogenerative disease, variations in what people eat are delivering improvements for older people.”

The World Health Organization estimates that globally, the number of people living with dementia is at 47 million.

By 2030, this is projected to rise to 75 million and by 2050, global dementia cases are estimated to almost triple. China has the largest population of people with dementia.

“As people age, they naturally experience changes to conceptual reasoning, memory, and processing speed. This is all part of the normal aging process,” Dr. Li says

“But age is also the strongest known risk factor for cognitive disease. If we can find ways to help older people retain their cognitive health and independence for longer – even by modifying their diet – then this absolutely worth the effort.”

Pope replaces Santiago bishop after abuse cover-up claims

Pope Francis has replaced Cardinal Ricardo Ezzati , the embattled archbishop of Santiago, Chile, after he became embroiled in the country's spiraling sex abuse and cover-up scandal.

Francis on Saturday accepted Ezzati's resignation and named a temporary replacement to govern Chile's most important archdiocese: the current bishop of Copiapo, Monsignor Celestino Aos Braco.

The 77-year-old Ezzati had submitted his resignation two years ago when he reached the mandatory retirement age of 75. But Francis kept him on, and he became the flashpoint of abuse survivors' ire for mishandling several cases of abuse.

Francis himself became embroiled in the scandal after initially discrediting victims during his 2018 trip to Chile.

After realizing his error, Francis summoned all Chile's active bishops to the Vatican and strong-armed them to offer their resignations.

Dems To Introduce Bill Requiring Men Call Police When They ‘Release Sperm From Their Testicles’

A pair of Georgia Democrat lawmakers are planning to introduce a bill that would require men to call police when they ejaculate, and classify unprotected sex as “aggravated assault” on the men’s part.

State Reps. Dar’shun Kendrick, of Lithonia, and Park Cannon, of Atlanta are putting forward a “testicular bill of rights” in protest of Georgia’s House passing a bill preventing abortions once a heartbeat is detected in the womb.

“Introducing my ‘testicular bill of rights’ legislative package. You want some regulation of bodies and choice? Done!” Kendrick tweeted on Monday.

Kendrick and Cannon’s bill would “require men who are age 55 and older to ‘immediately report to the county sheriff or local law enforcement agency’ when he ‘releases sperm from his testicles,'” reported The Atlanta Journal-Constitution.

“This bill helps men who are well past reproductive age to self report when they willfully engage in conception,” Cannon said.

The measure would require a men to obtain permission from their sexual partners before obtaining any prescriptions for erectile dysfunction medication.

Additionally, it would outlaw vasectomy procedures, require a “24 hour waiting period” to buy sex toys or pornography, and mandate DNA tests to determine the father at six weeks into a pregnancy.

The move is a political ploy as it has little chance of passing Georgia’s House or Senate.

This bill and the pro-life bill passed by the Georgia House are in stark contrast with each other, as Bill 481’s goal is to protect the lives of unborn babies, whereas this bill simply limits the rights of men in a belittling fashion.

PRAGUE (Reuters) – Czech President Milos Zeman will appoint Karel Havlicek, the head of a small business association and deputy chief of the government’s science and research council, as new industry minister on April 30, a spokesman said on Monday.

The president will also appoint lawyer Vladimir Kremlik as new transport minister, replacing Dan Tok who resigned after serving more than four years, a record tenure for the transport post.

Havlicek’s main tasks will be regulating the telecoms market and preparing a project to boost the European Union country’s nuclear power capacity.

Both ministries are controlled by Prime Minister Andrej Babis’s ANO party, which leads the coalition government.

Brazilian President Jair Bolsonaro on Thursday said his government must make men aware of the dangers of poor hygiene after expressing dismay over the 1,000 penis amputations that apparently occur in his country each year.

“In Brazil, we have 1,000 penis amputations a year due to a lack of water and soap,” he said while speaking to reporters in Brasilia after visiting the Education Ministry. “We have to find a way to get out of the bottom of this hole.”

The far-right leader called the figure “ridiculous and sad,” Reuters reported. A spokeswoman for the Brazilian urology society told the news agency the number is based on its official data for penis amputations.

The amputations were conducted out of necessity over untreated infections, along with complications from HIV and various cancers, she said.

A top Russian diplomat says Russia is willing to negotiate a new nuclear weapons treaty with the United States and China.

Deputy Foreign Minister Sergei Ryabkov told reporters on Friday Moscow is closely following reports in the United States that the U.S. would like to reach a nuclear weapons deal with both Russia and China, and is “willing” to negotiate. The story was reported by CNN earlier Friday.

Ryabkov also said that Russia “would like to convince” the U.S. to adopt a joint statement that would condemn any use of nuclear weapons.

Ryabkov’s comments come just months after the U.S. withdrew from the Intermediate-Range Nuclear Forces Treaty, a cornerstone of the post-Cold War security, and Russia followed suit. Each claims breaches by the other.

Government dysfunction and an intelligence failure that preceded the Easter Sunday bombings in Sri Lanka are traced to simmering divisions between the president and prime minister after a weekslong political crisis that crippled the country last year.

The government has admitted to a “lapse of intelligence” after officials failed to act upon near-specific information received from foreign agencies. Suicide bombers exploded themselves last Sunday in three churches and three luxury hotels, killing 253 people and wounding 400 more. Authorities said eight Muslim militants blew themselves up at their targets while the wife of one of the attackers blasted herself on being rounded up by police.

The carnage has brought forth arguments that worshippers and holidaymakers fell victim to the rivalry and a lack of communication between the country’s two leaders — President Maithripala Sirisena and Prime Minister Ranil Wickremesinghe.

The Cabinet led by Wickremesinghe says neither he nor his ministers were informed of the intelligence received by the defense authorities. Sirisena is the head of state, defense minister, minister in charge of the police and head of the armed forces. He also chairs the National Security Council, which includes the heads of security agencies and departments. Traditionally the prime minister also plays an important role on the council.

According to Health Minister Rajitha Senaratne, Sirisena has not included Wickremesinghe in national security affairs since a dispute between them came into the open in October last year. This is an unusual departure from the protocol, he said.

Senaratne said that Sirisena was overseas when the attacks took place and even after that, the National Security Council refused to meet with Wickremesinghe as he tried to give them instructions.

Sirisena has also said that he was not informed of the intelligence received and vowed to overhaul the leadership of the defense forces.

The top bureaucrat at the Defense Ministry, Hemasiri Fernando, has resigned at Sirisena’s insistence.

“It is a major factor,” said Jehan Perera, the head of local activist group National Peace Council, referring to the alleged lack of coordination between the leaders contributing to the failure to prevent the attacks.

“The primary responsibility has to be taken by the president, he did not give the information and he did not act,” Perera said. “He had the Ministry of Defense, took the police from the prime minister, chaired the National Security Council meetings and did nothing,” Perera said.

Kusal Perera, a journalist and political commentator, says security and intelligence officials should have acted on the information whether or not they received orders from politicians.

“If they (Wickremesinghe and his party) were not invited to the National Security Council, why did not they say in Parliament that they were not responsible for the security of the country any longer,” said Perera, who is not related to Jehan Perera.

“Saying that now is taking political advantage, not taking responsibility,” he said.

Sirisena and Wickremesinghe belong to different political parties but came together for Sirisena’s presidential campaign in 2015. Their relationships broke down and their differences exploded last year when Sirisena suddenly sacked Wickremesinghe as prime minister and appointed in his place former strongman Mahinda Rajapaksa, whom he defeated in the presidential election. The crisis crippled the country for more than seven weeks to the point of not being able to pass this year’s national budget on time.

A court decision compelled Sirisena to reappoint Wickremesinghe, but the two leaders have been rivals within the same government.

Rajapaksa, who is the minority leader in Parliament, blames the government for weakening intelligence and dropping its guard, which he had maintained to defeat the separatist Tamil Tiger rebels 10 years ago to end the 26-year-old civil war. He also criticized the government for the detention of intelligence officers accused of extrajudicial killings and abductions during the closing days of the war, which he said crippled the security apparatus before the bombings. According to conservative U.N estimates, some 100,000 people were killed in Sri Lanka’s conflict.

Sirisena summoned an all-party conference Thursday to which Wickremesinghe was also invited. At the conference, Sirisena stressed “setting aside all the political beliefs and difference (so that) everybody should collectively commit towards building a peaceful environment within the country,” a statement from his office said.

“It is not a secret that the disagreements between me and the government aggravated over the past two years,” Sirisena told the country’s media executives Friday. “One of the reasons for that is weakening of military intelligence and arresting military officials unnecessarily and my speaking up against it within and outside the government.”

Jehan Perera said that the security threat could prove politically advantageous to Rajapaksa and his family, with a presidential election scheduled at the end of this year. Gotabhaya Rajapaksa, a younger brother of Mahinda, was the powerful defense secretary during his brother’s reign and has expressed his interest to join the contest.

“People are saying we want a stronger leader and they are talking about Gotabhaya. It (the blasts) has worked to their benefit,” Perera said.

Cyprus police are intensifying a search for the remains of more victims at locations where an army officer, who authorities say admitted to killing five women and two girls, allegedly had dumped their bodies.

Police said Friday’s search will concentrate on a military firing range, a reservoir and a man-made lake near an abandoned mine approximately 32 kilometers (20 miles) west of the capital Nicosia.

On Thursday, the 35-year-old suspect told investigators that he had killed four more people than he had previously admitted to. All the suspect’s alleged victims are foreign nationals.

Police have already found the bodies of a 38-year-old Filipino woman and two as yet unidentified women.

Search crews are now looking for the daughter of the 38-year-old, a Romanian mother and daughter and another Filipino woman.

A California man who allegedly fatally shot his ex-girlfriend in broad daylight last month before fleeing the country has been returned to the U.S. following his arrest in Mexico on Wednesday, authorities said.

Julio Cesar Rocha, 25, of Montlcair, is accused of shooting his 25-year-old ex-girlfriend Thalia Flores and a second unidentified male victim March 21 around 2:45 p.m. while the two were sitting in a vehicle in the parking lot of a discount store in Chino. Both communities are about 36 miles east of Los Angeles.

Flores died at the scene. The man, whose name was not released, walked to a nearby hospital where he’s recovering from his gunshot wounds.

Rocha allegedly fled the scene and remained at large for more than a month, the Daily Bulletin reported. He was formally arrested at 4:30 p.m. after arriving at Los Angeles International Airport from Mexico, KTLA-TV reported.

The suspect was booked at the West Valley Detention Center in Rancho Cucamonga on murder and attempted murder charges, the City of Chino Police Department said on Facebook.

Flores ended her seven-year relationship with Rocha just two months before her death and still lived in fear of him until that point, a sister of the victim, Bernice Flores, told the Daily Bulletin.

“He said himself so many times to other people, ‘If I can’t have her, no one will.’ ” Flores said, adding that her sister stayed in the relationship longer that she would have liked in fear that Rocha would hurt her or her family if they broke up.

Rocha was convicted on misdemeanor battery in 2016 and sentenced to 60 days in prison. He was originally charged with misdemeanor assault with a deadly weapon, but the charges were lowered in a plea deal, the Daily Bulletin reported.

Rocha was convicted of misdemeanor resisting or obstructing a peace officer in 2014. A second charge of misdemeanor battery was dropped in a plea deal, and Rocha was ordered to complete a 26-week anger management course, according to San Bernardino County Superior Court records. Rocha was later arrested and sentenced to 10 days behind bars for failing to complete the course.
