U.S. FAA warns Southwest, union that contract dispute could pose safety concerns

WASHINGTON (Reuters) – The Federal Aviation Administration warned Southwest Airlines Co and a union representing its mechanics in a letter Friday that a contract dispute could pose safety concerns.

The letter warned that a “breakdown in the relationship” between the airline and Aircraft Mechanics Fraternal Association “raises concerns about the ongoing effectiveness of the airline’s safety management system.”

Earlier this week, Southwest said the dispute is costing it millions of dollars in lost revenues a week as well as millions of dollars in costs related to flight cancellations and delays.

Southwest did not immediately comment on the FAA letter.

HONG KONG (Reuters) – Chinese electric vehicle (EV) maker NIO Inc has blocked the eight top investment banks that did its IPO from working for rivals by tying them up in rare year-long non-compete clauses, several people with direct knowledge of the matter said.

The move highlights the fierce competition between China’s EV makers as they seek the capital needed to survive in a fast-growing market, also the world’s largest.

NIO, for its initial public offering in September, had hired Bank of America Merrill Lynch, Citigroup, Credit Suisse, Deutsche Bank, Goldman Sachs, JPMorgan, Morgan Stanley and UBS.

These were also the top eight banks worldwide for equity sales in 2018, according to Refinitiv data.

The non-compete clause prevents them from helping NIO’s rivals raise public or private funds for 12 months following the IPO, the sources said, declining to be named as they were not authorized to speak publicly on the matter.

NIO and the banks declined to comment.

The list of rivals covered by the restrictions included up to 10 names, although it may have varied between the individual agreements, the people said.

Xpeng Motors and WM Motor were on that list, three sources said. A separate source said the list included those two and Byton, among others.

NIO’s non-compete demands were particularly restrictive both in their breadth and duration, several sources said.

Typically such deals restrict banks from working with rivals until the transaction closes or for a shorter period such as six months, two of the sources said.

“Issuers sometimes don’t like it when you’re doing an IPO for the competitors on a concurrent timetable because they will worry that you might divulge information to the benefit of the other clients,” said Stephen Chan, partner at law firm Dechert LLP, speaking about general industry practices.

One banker involved in the NIO deal said his bank had lost mandates because of the non-compete clause.

Adding to the banks’ frustration, they had signed up to NIO’s demands when the IPO was expected to raise about double the $1 billion it actually brought in – meaning banks would initially have expected a much larger payout.

“It would have been interesting in hindsight seeing if it could have got the same agreement with people knowing what the actual valuation was going to be,” a senior banker who worked on the deal said.

EV CAPITAL-RAISING RUSH

NIO’s move comes at a time when many Chinese EV makers are considering IPOs or have launched private fundraisings as China cuts the subsidies it has historically offered as part of its efforts to curb pollution.

On Wednesday, China said it had raised its standards for NEVs that qualify for subsidies and reduced the amount it was willing to provide.

In January, Byton was seeking to raise at least $500 million to finance its growth, people familiar with the matter told Reuters at the time.

Earlier this month, WM Motor announced it closed its Series C funding round of 3 billion yuan ($446.16 million).

Reuters reported on Friday that Leap Motor, a smaller EV maker, was seeking a private fundraising of 2.5 billion yuan, advised by Deutsche Bank.

NIO itself did not stop with its IPO.

In January, it sold a $750 million convertible bond to plug the gap between the money it raised in its IPO and what it had expected to raise.

Giannis Antetokounmpo had 26 points and 13 rebounds, Brook Lopez scored 25 points, and the host Milwaukee Bucks beat the Charlotte Hornets 131-114 on Saturday night.

The Bucks trailed by as many as 14 in the second quarter but exploded for 39 third-quarter points to take the lead before increasing their advantage to as many as 18 in the fourth quarter.

The Bucks became the first team in the league to reach the 50-win plateau. They are now 27-5 at home. They have won two straight and nine of their past 11.

Kemba Walker scored 25 points to lead the Hornets, who remain in 10th place in the Eastern Conference playoff race. Frank Kaminsky scored 16, Miles Bridges had 15, Nic Batum and Jeremy Lamb finished with 14 apiece, and Cody Zeller scored 10.

Timberwolves 135, Wizards 130 (OT)

Karl-Anthony Towns collected 40 points and 16 rebounds before exiting with a right knee injury, and host Minnesota outlasted Washington.

Towns, who left in the final minute of regulation and did not play in overtime, reached the 40-point plateau for the third time in five games. The two-time All-Star fell just shy of his season high of 42 points. He will undergo further testing on his knee, but coach Ryan Saunders said he has not heard reason for serious concern.

Derrick Rose scored 16 of his 29 points after the third quarter for the Timberwolves, who have won two of three. Taj Gibson had 15 points and 13 rebounds.

Celtics 120, Lakers 107

Kyrie Irving scored 30 points, Marcus Smart and Marcus Morris added 16 each, and visiting Boston extending its winning streak to three with a win over Los Angeles.

Gordon Hayward added 15 points as the Celtics avenged a defeat to the Lakers at home in February when former Boston point guard Rajon Rondo hit a game-winning shot at the buzzer.

LeBron James finished with a triple-double (30 points, 12 assists, 10 rebounds) for the Lakers, who were playing without a number of key contributors because of injuries. Los Angeles lost its fifth consecutive game and fell for the seventh time in its last eight games.

D’Angelo Russell hit a go-ahead 3-pointer with 1:39 remaining, and Brooklyn held off host Atlanta to complete a season-series sweep despite a triple-double performance by rookie Trae Young.

Spencer Dinwiddie had 23 points and Jarrett Allen finished with 20 points and 12 rebounds for the Nets, who had beaten the Hawks twice in Brooklyn earlier in the three-game season series.

Young’s triple-double consisted of 23 points, 10 rebounds and 11 assists. John Collins had 33 points and 20 rebounds for Atlanta, which dropped its second straight.

De’Aaron Fox scored a game-high 30 points and hit the go-ahead basket with 5:03 to play as visiting Sacramento beat New York.

The Kings overcame a 15-point first quarter deficit and survived squandering an 11-point lead in the fourth quarter to win the opener of a pivotal four-game Eastern Conference road trip. Sacramento, which hasn’t made the playoffs since 2006, entered Saturday four games behind the San Antonio Spurs in the race for the eighth and final playoff spot in the Western Conference.

Buddy Hield scored 19 points, and Nemanja Bjelica had a double-double (13 points, 10 rebounds) for the Kings.

CJ McCollum scored 26 points on 11-for-14 shooting as Portland pulled out a victory over visiting Phoenix.

Seth Curry came off the bench to match his season high with 22 points for the Trail Blazers, who ended their two-game losing streak. Damian Lillard added 18 points and nine assists, and Jusuf Nurkic contributed 14 points and nine rebounds for Portland.

FRANKFURT (Reuters) – Volkswagen on Wednesday said it has teamed up with Amazon Web Services to link up and integrate the data from 122 VW Group plants, machines and systems, as a way to improve its production systems and processes.

Amazon will help Volkswagen join up its plants and supply chain with over 30,000 locations and 1,500 suppliers using a data platform known as the “Volkswagen Industrial Cloud”, the company said in a joint press release with Amazon.

The cloud platform could be made available to other car manufacturers and specific negotiations with major industrial companies interested in migrating to the Volkswagen Industrial Cloud are already underway, VW and Amazon said.

The cloud helps VW to detect supply bottlenecks and process disruptions early as well as to optimize the operation of machinery and equipment.

Amazon’s machine learning analytics and production know-how will be extended to the requirements of the auto industry, VW and Amazon Web services said.

The St. Louis Cardinals announced a five-year extension for newly acquired first baseman Paul Goldschmidt on Saturday.

Financial terms were not revealed, but the St. Louis Post Dispatch reported that it will pay him “around $130 million.”

The deal will keep Goldschmidt, 31, in St. Louis through the 2024 season.

“When we made the trade to acquire Paul, we knew we had added one of the game’s premier players,” Cardinals’ President of Baseball Operations John Mozeliak said in a statement. “We are all excited for Paul’s introduction to St. Louis, and to our passionate fans, who we feel will make this the perfect match.”

Arizona traded Goldschmidt, a six-time All-Star, to St. Louis in December in exchange for right-hander Luke Weaver, catcher Carson Kelly, infielder Andy Young and the Cardinals’ Compensation B selection in the 2019 draft.

Goldschmidt has slugged 30 or more homers in four of the past six seasons, but the Diamondbacks were shopping the 31-year-old because he was entering the last season of his contract, which was slated to pay him $14.5 million. He batted .290 with 33 homers and 83 RBIs in 2018. He has three 100-RBI campaigns and has batted .300 or better three times since 2013.

Overall, he batted .297 with 209 homers and 710 RBIs in 1,092 games over parts of eight seasons for Arizona. He finished second in National League MVP balloting in 2013, when he set career highs of 36 homers and 125 RBIs, and again in 2015.

The Vegas Golden Knights could be getting some offensive punch for their playoff push, and it could come from a player who has never played in the NHL, multiple outlets reported Thursday.

Nikita Gusev, the reigning MVP of Russia’s Kontinental Hockey League, could be on his way to the United States after his current team, SKA St. Petersburg, was eliminated from the playoffs by SCKA Moscow.

Gusev, 26, had 82 points in 62 games this season to lead the KHL, according to NHL.com. The left wing scored 17 goals with 65 assists. Canada’s TSN reported that Gusev’s representatives were working on a release from his current contract, which officially expires at the end of April.

“I don’t know much about him,” Vegas head coach Gerard Gallant said, according to the league website. “(Golden Knights general manager) George (McPhee) mentioned it today. … If he joins us, we’ll see what’s going to happen. Hopefully he does join us and gets some practice time in with us, but I have no idea where that’s going.”

Vegas trails its best-of-7 Western Conference playoff matchup with San Jose 1-0, with Game 2 set for Friday in the Bay Area. The Golden Knights are the defending Western Conference champions.

Gusev was a seventh-round draft pick by the Tampa Bay Lightning in 2012, but his rights were traded to Vegas in the 2017 expansion draft.

(Reuters) – U.S. stock index futures were flat on Friday, as investors paused ahead of GDP data, which is expected to show the world’s largest economy maintained a moderate pace of growth in the first quarter.

Gross domestic product probably increased at a 2% annualized rate in the quarter as a burst in exports, strong inventory stockpiling and government investment in public construction projects offset a slowdown in consumer and business spending, according to a Reuters survey of economists.

The Commerce Department report will be published at 8:30 a.m. ET.

The GDP data comes as investors look for fresh catalysts to push the markets higher. The S&P 500 index is about 0.5% below its record high hit in late September, after surging nearly 17% this year.

First-quarter earnings have been largely upbeat, with nearly 78% of the 178 companies that have reported so far surpassing earnings estimates, according to Refinitiv data.

Wall Street now expects S&P 500 earnings to be in line with the year-ago quarter, a sharp improvement from the 2.3% fall expected at the start of April.

Amazon.com Inc rose 0.9% in premarket trading after the e-commerce giant reported quarterly profit that doubled and beat estimates on soaring demand for its cloud and ad services.

Ford Motor Co shares surged 8.5% after the automaker posted better-than-expected first-quarter earnings largely due to strong pickup truck sales in its core U.S. market.

Mattel Inc jumped 8% after the toymaker beat analysts’ estimates for quarterly revenue, as a more diverse range of Barbie dolls powered sales in the United States.

At 6:52 a.m. ET, Dow e-minis were down 35 points, or 0.13%. S&P 500 e-minis were down 1.5 points, or 0.05% and Nasdaq 100 e-minis were up 10.75 points, or 0.14%.

Among decliners, Intel Corp slumped 7.7% after it cut its full-year revenue forecast and missed quarterly sales estimate for its key data center business.

Rival Advanced Micro Devices declined 0.8%.

Oil majors Exxon Mobil Corp and Chevron Corp are expected to report results later in the day.

WARSAW (Reuters) – Germany could owe Poland more than $850 billion in reparations for damages it incurred during World War Two and the brutal Nazi occupation, a senior ruling party lawmaker said.

Some six million Poles, including three million Polish Jews, were killed during the war and Warsaw was razed to the ground following a 1944 uprising in which about 200,000 civilians died.

Germany, one of Poland’s biggest trade partners and a fellow member of the European Union and NATO, says all financial claims linked to World War Two have been settled.

The right-wing Law and Justice (PiS) has revived calls for compensation since it took power in 2015 and has made the promotion of Poland’s wartime victimhood a central plank of its appeal to nationalism.

PiS has yet to make an official demand for reparations but its combative stance towards Germany has strained relations.

“Poland lost not only millions of its citizens but it was also destroyed in an unusually brutal way,” Arkadiusz Mularczyk, who heads the Polish parliamentary committee on reparations, told Reuters in an interview.

“Many (victims) are still alive and feel deeply wronged.”

His comments come a month before European Parliament elections in which populist and nationalist parties are expected to do well. Poland will also hold national elections later this year, with PiS still well ahead of its rivals in opinion polls.

EU LARGESSE

Mularczyk said the reparations figure could amount to more than 10 times the estimated 100 billion euros ($111 billion) that Poland has received so far in European Union funds since it joined the bloc in 2004.

Germany is the biggest net donor to the EU budget and some Germans regard its contributions as generous compensation to recipient countries like Poland which suffered under Nazi rule.

In 1953 Poland’s then-communist rulers relinquished all claims to war reparations under pressure from the Soviet Union, which wanted to free East Germany, also a Soviet satellite, from any liabilities. PiS says that agreement is invalid because Poland was unable to negotiate fair compensation.

Mularczyk said his committee hoped to complete its report on the reparations issue by Sept. 1, the 80th anniversary of Hitler’s invasion.

Accusing Berlin of playing “diplomatic games” over the issue, he said: “The matter is being swept under the rug (by Germany) … until it’ll be wiped from the memory, from people’s awareness.”

His comments come after the Greek parliament voted this month to seek billions of euros in German reparations for the Nazi occupation of their country.

WASHINGTON (Reuters) – U.S. President Donald Trump on Friday said the United States did not pay any money to North Korea as it sought the release of comatose American student Otto Warmbier.

The Washington Post reported on Thursday that Trump had approved payment of a $2 million bill from North Korea to cover its care of the college student, who died shortly after he was returned to the United States after 17 months in a North Korean prison.

Al-Qaida in Yemen is vowing to avenge beheadings carried out by Saudi Arabia this week — an indication that some of the 37 Saudis executed on terrorism-related charges were members of the Sunni militant group.

Al-Qaida in the Arabian Peninsula, as the branch is called, posted a statement on militant-linked websites on Friday, accusing the kingdom of offering the blood of the “noble children of the nation just to appease America.”

The statement says al-Qaida will “never forget about their blood and we will avenge them.”

U.S. ally Saudi Arabia on Tuesday executed 37 suspects convicted on terrorism-related charges. Most were believed to be Shiites but at least one was believed to be a Sunni militant.

His body was pinned to a pole in public as a warning to others.

For two friends with checkered pasts it was the luck of a lifetime: a 4 million-pound ($5.2 million) lottery win.

But Mark Goodram and Jon-Ross Watson may see their celebrations cut short.

The Sun newspaper reports that Britain’s National Lottery is withholding the payout as it investigates whether the men, who have a string of criminal convictions, used illicit means to buy the winning ticket.

The Sun said neither man has a bank account, leading lottery organizers to investigate how they obtained the bank-issued debit card that paid for the 10 pound ($13) scratch card.

Camelot, which runs the lottery, said Friday it couldn’t confirm details of the story because of winner-anonymity rules. The firm said it holds a “thorough investigation” if there is any doubt about a claim.
