Starr: Concerns Mueller Report Not Written ‘Fair, Balanced’

Former independent counsel Ken Starr said Wednesday there are legitimate concerns over whether the report of special counsel Robert Mueller has been written "in a fair and balanced way."

In remarks on Fox News' "America's Newsroom," Starr noted "so many questions have been raised" about the alleged bias of the Mueller investigative team ahead of the release of their full report Thursday.

"They've had the opportunity — without any kind of check or balance — to write whatever they want to write," Starr said. "And that I think legitimately raises concern of fairness and balance."

Star said the frustration after the release will also be "we don't have it all" because of legally necessary redactions — and readers' tendencies will be for "cherry picking."

"It is inevitable . . . a lot of interpretation and extrapolation," he said, adding: "It would be good if we could call a national timeout and actually review what we have and then come to a more sober judgment. But politics is politics."

(Reuters) – Shares in Levi Strauss & Co surged 31 percent in their debut on Thursday, giving the U.S. jeans maker a market value of $8.7 billion and indicating a strong investor appetite ahead of much-awaited listings from Lyft and Uber Technologies.

The 165-year-old company’s return to the public market comes at a time when stocks are near all-time highs and the popularity of denim is surging, driven by the resurgence of the 90s styles such as high-waist and pinstriped jeans.

The self proclaimed inventor of the blue jeans, which has grown to become one of the world’s most recognized denim brands, hopes to use a part of the proceeds from the share offering to expand further into emerging markets such as Brazil, China and India.

“Denim continues to prove prevalent in streetwear and on the runway, so we’re not expecting it to go anywhere any time soon,” an analyst at retail analytics firm Edited said.

“That’s why now is a great time for Levi’s to capitalize on this momentum.”

Levi first went public in 1971. It sold a total of 1.27 million shares at $47 each and the stock opened at $60, according to a New York Times report.

After 14 years as a public company, it was taken private by the Haas family, the descendants of founder Levi Strauss, in a $1.6 billion leveraged buyout.

Levi’s second IPO was priced at $17 on Wednesday, above the expected range, in an oversubscribed offering. The Haas family will retain 80 percent voting control of the public company. The market capitalization of the company is based on outstanding shares of about 390 million, which includes the over-allotment option.

“There is a lot to like when it comes to Levi Strauss the brand and its outlook moving forward,” said Jeff Zell, senior research analyst and partner at IPO tracking firm, IPO Boutique.

“The company and the underwriters targeted a reasonable valuation to start and allowed the true investor demand to dictate price which ultimately came one-dollar above range.”

The company reported a 14 percent rise in revenue to $5.6 billion in 2018, a majority of which came from men’s denim. Its biggest market is Americas, which accounts for about 55 percent of total revenue.

The San Francisco, California-based company sells in 110 countries through 50,000 retail stores and its rivals include Gap Inc and VF Corp’s Lee and Wrangler brands.

To attract young customers, Levi’s is planning to expand its tailor shop and print bar that allow consumers to customize and put their own designs on the company’s branded jeans and T-shirts.

Levi’s market splash also marks the start of what could be a blockbuster year for IPOs with several high profile companies expected to list their shares.

Ride-hailing service provider Lyft Inc kicked off the investor road show for its market debut on Monday and larger rival Uber is expected to go public in April.

The line-up also includes photo-posting app Pinterest, home-renting service provider Airbnb and business messaging app Slack.

LONDON (Reuters) – The chief executive of mining group BHP has no plans to quit and will focus on the “nuclear level of safety” needed to avoid any repeat of the Vale dam collapse in Brazil, as well as on transforming his own company.

Speculation about the future of CEO Andrew Mackenzie, 62, has swirled since 2017 when activist investor Elliott Advisors began campaigning for change and Ken MacKenzie was appointed as chairman.

Asked about how long he planned to stay, Mackenzie, in the role since 2013, said he was not thinking about moving on.

“I’ve got a lot to do right now and I’ve got a lot to do on tailings dams,” he told reporters in London.

As the tailings disaster in Brazil in January overshadows the mining industry, BHP has the experience to lead change as its Samarco joint venture with Vale was involved in a previous dam collapse in November 2015 that left 19 dead.

Following Samarco, the International Council on Mining and Metals (ICMM) issued updated guidelines to try to safeguard tailings dams that store waste from mining operations.

But the ICMM is industry-led and Mackenzie has called for an independent body to oversee dams.

“We have to acknowledge the deficiencies in the scientific and technical understanding,” the Scotsman said.

“You need to think about this with the best possible science and engineering in the world. It has to have a nuclear level of safety now.”

Mackenzie said mining companies were needed to provide society with resources and to support a transition to a low carbon economy that will spur demand for minerals such as copper, used in electrification.

After the commodities crash of 2015-16, the mining industry has repaired balance sheets and handed cash to shareholders. The next steps are less obvious as old ore bodies become depleted and new assets are often in politically unstable countries.

BHP on Tuesday said its first-half underlying profit was down 8 percent from the same period a year ago and it cut its forecast for productivity gains to flat for the financial year, mainly because production outages meant $460 million in savings was not achieved.

Mackenzie said he was excited to be leading a “transformation agenda” to help with the next phase of growth and maximize the productivity of operations.

“The transformation agenda is the biggest lever we have got to play. It’s reporting direct to me. I’m getting a lot out of it,” Mackenzie said.

Iraq war hero's family accepts Medal of Honor from Trump

The son of an Army staff sergeant awarded a posthumous Medal of Honor by President Donald Trump on Wednesday said he wants his father to be remembered as the best parent and best soldier anyone could ever ask for.

And that's exactly how Travis Atkins will be remembered, Trump assured Atkins' son, Trevor Oliver.

"You can't get better than the Congressional Medal of Honor. You just can't," Trump explained. The medal is the nation's highest military honor for bravery against an enemy, and Trump had just presented the eighth one of his presidency to Trevor Atkins.

Atkins, 31, of Bozeman, Montana, died in June 2007 while trying to subdue a suspected Iraqi insurgent in a town near Baghdad.

After realizing the man was trying to detonate a suicide vest, Atkins wrapped his body around the man and threw him to the ground, away from three of his soldiers who were nearby. Atkins, who was on his second tour of duty in Iraq and leading a 15-soldier squad after he had become "bored" with civilian life, was killed instantly.

At a somber White House ceremony, Trump said Atkins had called his son days before that fateful June day to wish the boy a happy 11th birthday. Neither knew it would be the last time they'd speak, Trump said, adding that Oliver has always known that his father sacrificed himself for his country.

Invited by Trump to address the audience, which included the three surviving soldiers, Oliver said he takes "a lot of pride" in the Medal of Honor. He described the moment as "surreal" and something he could not put into words.

Atkins' had been awarded the Distinguished Service Cross, which was upgraded to a Medal of Honor after a Defense Department review.

Trump can choose to recognize individuals for a variety of contributions to society, including the arts and science. But the Medal of Honor, which is instigated by the military itself through a nomination and lengthy review process that does not involve the president, is the public award ceremony Trump prefers to host.

Trump so far has recognized gallantry during World War II, Vietnam, Afghanistan and Iraq, including three posthumous honors.

Presidents claim the public spotlight for presenting the medal to service members or on behalf of those who are no longer living, but they have little say in who ultimately is recognized since the White House is not part of the process. Cases work their way up the chain of command at the Pentagon to the service secretary and defense secretary, both of whom have authority to disapprove of a recommendation.

The president, as commander in chief, has the final say after the defense secretary gives his approval.

Some 3,523 people have received the Medal of Honor since President Abraham Lincoln awarded the first one in 1863, during the Civil War, according to the Congressional Medal of Honor Society. There are 72 living recipients.

After the ceremony, two Republican members of Montana's congressional delegation — Sen. Steve Daines and Rep. Greg Gianforte, announced that they introduced legislation Wednesday to put Atkins' name on a Veterans Affairs clinic in Bozeman.

LONDON (Reuters) – Iran will overcome “inhumane and illegal” U.S. sanctions in the new Iranian year by expanding ties with nations equally tired of “bullying” by the United States, Foreign Minister Mohammad Javad Zarif said on Wednesday on Twitter.

“We rely solely on our own people to overcome any challenges, but we also welcome constructive engagement, including with the expanding array of nations who are equally sick and tired of the bullying of the U.S.,” Zarif said on his Twitter feed.

UK's Brexit negotiations 'shameful,' similar to how the left refused to accept Trump's win: Nigel Farage

Former U.K. Independence Party leader Nigel Farage said Friday there are parallels in 'acceptance' between his country's current Brexit situation and President Trump's 2016 triumph.

"It's the same game. Both Brexit and Trump were huge seismic shocks in the political arena and just as our [members of parliament] here don't accept Brexit, many of them want to stop it or overturn it," Farage told "Fox & Friends."

Britain’s House of Commons voted Thursday to ask the European Union to delay their country’s exit.

"The problem is hundreds of our members of parliament didn't only vote the other way but they have never ever respected the result and are doing their best to overturn it, to frustrate it," Farage told co-host Steve Doocy.

Ardern says royal commission will investigate mosque attacks

New Zealand's prime minister has announced a top-level inquiry into the circumstances surrounding the massacre of 50 people in two Christchurch mosques.

Prime Minister Jacinda Ardern says the country's highest form of investigation, a royal commission of inquiry, was appropriate for "matters of the gravest public importance."

Her Cabinet had previously agreed on holding an inquiry, but had not decided what kind of investigation would be held.

She said the Cabinet agreed Monday a royal commission of inquiry "will look at what could have or should have been done to prevent the attack."

An Australian white supremacist has been charged with murder for the March 15 attacks.

NEW DELHI/MUMBAI (Reuters) – The grounding of India’s Jet Airways is turning into a quick windfall and long-term opportunity for international airlines keen to scoop up nearly a million outbound passengers from what was once the nation’s biggest airline.

Jet, which previously had a fleet of around 120 largely Boeing Co planes, was forced to indefinitely halt all flight operations on April 17 after its banks rejected the carrier’s plea for emergency funds.

The carrier’s descent into crisis has benefited international airlines in the form of rising fares and demand, data showed.

Fares from India to cities such as Dubai, London, New York, Singapore and Bali in the first quarter of 2019 rose between 4 percent and 32 percent from a year ago, according to Indian travel portal MakeMyTrip Ltd.

In the peak travel months of May and June, fares to London have spiked as much as 36 percent and tickets to San Francisco are up nearly 20 percent from a year ago, according to data from travel portal Yatra.com.

“For the next three months it’s actually bonanza time for international players,” said Ashish Nainan, a research analyst at CARE Ratings. “At least until the middle of June, the fares are not going to come down.”

Due to rising demand, even before Jet’s lessors grounded planes, carriers such as British Airways, Cathay Pacific Airways Ltd, Singapore Airlines Ltd and United Airlines saw an up to a 27 percent increase in passenger numbers from India in the last quarter of 2018, data from India’s aviation regulator showed. That is the latest period for which the data is available.

India is one of the world’s fastest-growing aviation markets, clocking 15-20 percent domestic growth in recent years. It has long had only two full-service long-haul carriers, state-run Air India and Jet.

Jet is now hoping to be bailed out by a new investor, with final bids due on May 10.

INCREASING CAPACITY

Before its grounding, Jet had the biggest share of India’s outbound international air traffic, carrying 12 percent of the 7.8 million passengers headed overseas in the Oct-Dec quarter, down from 14 percent a year earlier, data from the Directorate General of Civil Aviation showed.

The total number of passengers traveling overseas with Jet fell 10 percent during the last quarter of 2018 even as the outbound travel market grew about 5 percent.

Meanwhile, Singapore Airlines posted a 27 percent increase in passengers from India, Cathay registered 17 percent growth and British Airways saw a 10 percent rise in the same period.

Cathay said the events at Jet combined with increasing demand for travel had led it to deploy larger aircraft with more seats on some Indian routes.

“In the long term we would certainly like to be able to offer more capacity into India, not just on our existing routes but by establishing new services to secondary cities,” Cathay said in a statement.

Singapore Airlines, in an email to Reuters, said the Indian market is “very promising” but declined to give details of airfare levels or demand patterns in the wake of Jet’s exit, citing a quiet period before the release of its annual results.

DOMESTIC GAINS

Jet’s grounding has also had a big impact on the domestic market, with inter-city air fares to major cities such as New Delhi, Mumbai, Bengaluru and Kolkata soaring more than 20 percent in May and June, according to Yatra.com.

The spike in fares is expected to underpin strong earnings for IndiGo and SpiceJet Ltd, which are set to report results for the quarter ended March 31 in the coming weeks.

“Domestic Indian carriers are the main benefactors, but I suspect if Jet fails to be revived by May 10 then Vistara and other airlines that ply international routes, particularly the lucrative Gulf market, are the main winners,” said Shukor Yusof, the head of aviation consultancy Endau Analytics. Vistara is a joint venture of India’s Tata Sons and Singapore Airlines.

Inadequate bilateral traffic rights between India and other countries, however, could be an impediment to foreign carriers’ hopes of winning business lost by Jet, some analysts said.

“Even before Jet’s operational shutdown, international capacity was significantly constrained,” said Kapil Kaul, CEO for South Asia of consultancy CAPA. “We have now more serious capacity challenge … this is unlikely to be stabilized in the near term.”

A new national government likely to be in place sometime after elections end in May is expected to address the international capacity constraints, and once bilateral agreements are eased airlines including Emirates, Turkish and Qatar would immediately benefit, said Kaul.

“We would love to add more flights but we are at the limit of the allocation granted to us for traffic rights,” Emirates Chief Commercial Officer Thierry Antinori told reporters in Dubai on Wednesday.

(Reuters) – AstraZeneca Plc beat first-quarter sales and earnings expectations on Friday as the British drugmaker benefited from a push into cancer drugs and emerging markets including China.

Newer treatments such as lung cancer drug Tagrisso, now the company’s top selling medicine, have helped the drugmaker’s return to growth after years of crumbling sales due to patent losses on older drugs.

Sales in China have shown explosive growth, more than doubling since 2012, but AstraZeneca executives on Friday said that may not be sustained.

“The enormous growth you currently see in China, 28 percent, probably is not sustainable, but we feel very bullish that the growth will continue to be at a pace of between 15 percent and 20 percent,” Ruud Dobber, executive vice president, BioPharma, told Reuters.

Shares of the company were down 0.2 percent at 5,878 pence at 1031 GMT.

The turnaround in AstraZeneca’s fortunes has been powered by a push into cancer treatments led by Chief Executive Pascal Soriot, who saw off a 2014 takeover bid from Pfizer in part by promising annual sales of $45 billion by 2023.

In the first quarter, sales from its oncology unit rose 59 percent to $1.89 billion, accounting for 35 percent of total product sales.

The company has moved deeper into cancer therapy market through wide-ranging deals, including those for immunotherapy and targeted therapy. Last month, it agreed a multi-billion dollar oncology deal with Japan’s Daiichi Sankyo Co Ltd.

“We’re reaching that point where after years of having to keep faith, we have actually got something tangible to believe in,” Hargreaves Lansdown analyst Nicholas Hyett said.

AstraZeneca also backed its annual sales and earnings forecast and said it has extensively prepared for UK’s anticipated exit from the European Union, even in the event of a no-deal exit.

The company has already spent more than 40 million pounds ($52 million) on Brexit preparations, including stockpiling six weeks’ worth of drugs in the UK and four weeks in continental Europe to guard against shortages.

AstraZeneca said product sales rose 14 percent at constant currency to $5.47 billion in the quarter, led by its lung cancer drug Tagrisso and respiratory treatment Pulmicort.

China sales increased by 28 percent to $1.24 billion in the quarter, accounting for nearly a quarter of overall product sales.

Core earnings came in at 89 cents per share in the quarter. Analysts on average were expecting core earnings of 85 cents per share and product sales of $5.29 billion, according to a company provided consensus of 19 analysts.

It’s the type of crime that doesn’t happen every day.

Police in the suburbs of Philadelphia say three suspects broke into a medical facility in Wynnewood, Pennsylvania, last Saturday and fled with 18 colonoscopies – devices used for examining the health of patients’ colons.

The devices were reportedly worth a total of about $450,000, authorities said.

But police were perplexed about what the suspects might have planned to do with the instruments.

“This is not something that a typical pawn shop might accept,” Lower Merion Police Detective Sergeant Michael Vice told Philadelphia’s WCAU-TV. “My feeling would be that it was some type of black market sales.”

Such a market apparently does exist, Lower Merion Police Superintendent Michael J. McGrath told Philly.com.

“They appeared to know precisely where to go, and they pried the door open,” McGrath said of the suspects, who were captured on surveillance video leaving the facility, carrying bulging backpacks.

Police are hoping the suspects will be caught in the end.
