What is ‘collusion,’ and is it a crime? Russia investigation’s buzzword explained

The most frequently used term surrounding the Russia investigation has often left many scratching their heads: collusion.

Merriam-Webster has seen spikes in searches for the definition of the word since Special Counsel Robert Mueller took over the probe to determine whether President Trump's 2016 presidential campaign conspired with Russian officials in May 2017. That same month, the online dictionary said “lookups” for collusion were up more than 1,800 percent.

President Trump also has questioned what the term means.

“Where’s the Collusion? They made up a phony crime called Collusion, and when there was no Collusion they say there was Obstruction (of a phony crime that never existed),” Trump tweeted at the time. “If you FIGHT BACK or say anything bad about the Rigged Witch Hunt, they scream Obstruction!”

As Mueller wraps up his years-long investigation, here’s a look at what the buzzword means — and how it applies to this specific case.

What is collusion?

Collusion is a non-legal term that refers to secret collaboration or conspiracy. But in U.S. code, it’s only used in antitrust laws to address crimes like price fixing.

Other than that, the word isn’t necessarily equivalent to criminality, despite its frequent use, according to Politico.

Michael Gerhardt, a constitutional law professor at the University of North Carolina, acknowledged the term can be confusing, especially when it’s linked to such a high-profile case.

"It's not a technical word. It's actually used, in part, to actually almost confuse people," Gerhardt previously told ABC News. "It's either used in two different ways: to almost confuse people, because there's no federal statute or code that uses this word, and then I think the other way it's used is maybe as a catch-all, an umbrella-like term that could encompass everything."

Is collusion a crime?

Even though “collusion” may not be a crime in and of itself, conspiracy is.

Conspiracy happens when two or more people agree to commit a crime “against the United States or to defraud the United States” and start to take steps toward it, according to 18 U.S. Code 371. People can still be charged with conspiracy, even if they don’t actually commit a crime, as long as there is proof they intended to carry out the illegal activity.

The statute specifically states conspiracy relates to "impairing, obstructing or defeating the lawful function of any department of government."

"Because conspiracy charges carry separate penalties, you can be convicted of both conspiracy and a crime that you or your fellow conspirators accomplished during the conspiracy (the 'substantive' count)," the American Bar Association explains in a chapter on Criminal Justice.

Giuliani later clarified his comment that "collusion is no crime," noting that the only actual crime in the Mueller investigation centers around hacking.

"And it's ridiculous to think that the president hacked," he told Fox News. "It has become crystal clear that this investigation ... has been continued as an illegitimate investigation."

How does it relate to Mueller’s probe?

So far, Mueller has accused three Russian entities and 13 Russian nationals of allegedly hacking Democrats, including the Democratic National Committee (DNC) and Hillary Clinton's campaign during the 2016 election. Several of Trump's former campaign associates have also been charged as a result of the probe, though none of the charges are directly related to any misconduct by the president's campaign.

The term "collusion" may be shorthand, but if the special counsel uncovers any illegal activities between the U.S. and Russia — such as hacking, election fraud, falsifying records or conspiracy — during the 2016 election, then it would be considered a federal crime. Plus, if Trump or his colleagues ever had advanced knowledge about Russia's stolen email trove and did not report it to federal authorities, then they could be accused of covering up the crime or working as foreign agents.

Mueller also is considering whether Trump's attempts to close the investigation when it was first launched would be considered obstruction of justice, according to June 2017 reports. Several intelligence officials have since undergone interviews in front of the special counsel to discuss the matter.

Section 1503 of Chapter 73 of U.S. Code Title 18 states: "A person who 'corruptly or by threats of force, or by threatening letter or communication, influences, obstructs, or impedes, or endeavors to influence, obstruct, or impede, the due administration of justice' is guilty of the crime of obstruction of justice."

(Reuters) – Three major U.S. airlines said on Monday they were experiencing system-wide computer outages, with United Airlines saying it was unable to create paperwork as a result.

Delta Air Lines and Southwest Airlines Co both said on their social media accounts that they were experiencing a system-wide outage.

COPENHAGEN (Reuters) – Airline SAS said on Thursday it will cancel a number of flights from midnight as a precautionary measure in case of a threatened pilots’ strike.

“As a result of the notice of strike from the pilots’ union in Denmark, Norway and Sweden, SAS is taking precautionary measures to protect travelers and staff,” it said in a statement posted on Facebook.

“This means that a number of flights will be canceled to avoid stranded travelers and crews,” it said.

Swedish, Danish and Norwegian pilot unions earlier this month called a strike if there was no agreement on wages and other terms after an earlier round of talks broke down without the parties finding common ground.

National mediators in the three countries have been trying to broker a deal since last week between delegations of the two parties. SAS spokeswoman Freja Annamatz said negotiations were still ongoing.

US ambassador’s Passover wishes in Polish met with anger

The U.S. ambassador to Poland wished Jews a happy Passover in Polish, and the reaction has been a wave of angry comments on Twitter.

Ambassador Georgette Mosbacher also wished Poles a happy Easter on Sunday. But by then, she was accused of offending the country with her Passover tweet and reminded that she is serving in a mostly Roman Catholic country.

Krystyna Pawlowicz, a lawmaker with Poland's ruling right-wing party, called it a "provocation."

Robert Bakiewicz, a far-right activist who organizes a yearly Independence Day march that government leaders joined last year, said "Christ died and was resurrected also for you, pagans and traitorous Jews."

Some came to Mosbacher's defense, recalling that Poland also has a small Jewish population. Poland was home to Europe's largest Jewish population before the Holocaust.

What General Electric investors want from CEO on Thursday: Clarity

NEW YORK (Reuters) – Portfolio manager Michael Kon began buying General Electric Co shares about a year ago and got more last fall after GE Chief Executive Larry Culp outlined plans to reboot the ailing power-plant unit.

“I wouldn’t say that they’ve got their arms around it,” Kon, who is also research director at investment firm value-oriented Golub Group LLC, said of the power trouble.

“But at least they’ve identified all the issues.”

Culp has a chance to attract more investors by providing greater clarity on GE’s strategy when he and other GE leaders lay out their 2019 financial forecast on Thursday.

Wall Street analysts expect GE to earn 70 cents a share this year and generate $1.9 billion in free cash flow, on average, according to data from Refinitiv.

GE optimists, spurred by Culp’s actions, have fueled a 53 percent rally from the stock’s low in December. As the first outsider to head the 127-year-old conglomerate, Culp has cracked open GE’s books to more scrutiny, shaken up its board and stationed new leaders in trouble spots like power and insurance.

But Culp still faces many skeptics who dumped the stock as GE racked up staggering losses of more than $30 billion over the last two years and cut its dividend to near zero.

The camps are unusually divided: Of 19 analysts who cover the company, nine rate its stock “hold” or “strong sell” while 10 rate it “buy” or “strong buy,” according to Refinitiv.

MURKY OUTLOOK

Those views did not change much even after GE reported a $22 billion loss in January or told investors last week its industrial businesses will lose cash in 2019.

GE shares are down 15 percent since Culp took over in October, and they are worth less than a third of their value in 2016.

Some analysts count Culp’s candor as positive and say the cash flow warning shows serious investment in restructuring.

But others say the changes have clouded GE’s outlook and want Culp to paint a credible picture of its future.

GE’s strategy of selling assets to pay off its outsized debt, for example, is ditching some of its most cash-generative businesses, such as rail and biopharma, said John Inch, analyst at Gordon Haskett Research Advisors. GE’s power unit has cut 12,000 jobs and 30 percent of facility space but plans to spend more on restructuring this year, he added.

“Just exactly what are you doing in power with all that restructuring money?” Inch asked.

GE’s forced asset sales also mean GE is not getting good prices, said Oliver Pursche, chief market strategist at Bruderman Asset Management LLC.

Investors who buy GE stock thinking it is cheap are ignoring cash outflows, strategy uncertainty and the fact that GE cannot afford to pay a dividend.

“The reality is, it’s at $9 for a very good reason,” said Pursche, who’s firm sold when GE cut its dividend in 2017 and won’t buy until the dividend returns and the outlook is clear.

“Until you get a cohesive growth strategy,” he said, “there’s no compelling reason to invest.”

Cyprus probes ‘unprecedented’ killings by serial killer suspect

ATHENS (Reuters) – Police in Cyprus are probing the actions of a possible serial killer after two women were found murdered and dumped in a mine shaft and a third, a six-year-old child, is still missing.

The victims were discovered in the space of a week at an abandoned mine about 30 kilometers (18.6 miles) west of the capital Nicosia.

One has been identified as a 39-year-old woman from the Philippines who disappeared in May, 2018 along with her six-year-old daughter.

A second victim, found late on Saturday, is thought to be a 28-year-old from the Philippines who was also reported missing last year, though has not been definitively identified.

A 35-year-old career officer with the Cypriot army is in custody on suspicion of killing all three.

“This is a form of crime unprecedented for the norms of Cyprus. It’s premature to assess the extent of this crime,” police chief Zacharias Chrysostomou told reporters.

There was an intensive search at the mine shaft, which is submerged in water, and at a reservoir in the area on Monday morning.

Both women had worked in Cyprus, which has a sizeable Filipino population.

In court hearings, police said the army officer was suspected of having approached the women on an online dating site.

Campaigners say police ignored fears expressed for their safety when they went missing last year. One campaigner, Louis Koutroukides, said police questioned his motives and suggested the 39-year-old and her child may have moved to the north of the divided island.

“If they believed me when I went to the police things would have turned out differently,” he told state TV.

Chrysostomou said police had “every intention” of investigating any perceived shortcomings and would assign responsibility where due.

LG Electronics first-quarter profit likely down 19 percent, beating estimates

SEOUL (Reuters) – South Korea’s LG Electronics Inc said on Friday its operating profit for the three months ended March likely fell 19 percent from a year earlier, indicating a narrower drop than what analysts were expecting.

The second-biggest television set maker in the world, after Samsung Electronics Co Ltd, estimated an operating profit of 899.6 billion won ($792.77 million) for the quarter, versus 1.1 trillion won a year earlier.

That compares with an average estimate of 808 billion won from 21 analysts polled by Refinitiv I/B/E/S.

Revenue likely fell 1.4 percent to 14.9 trillion won, LG said, versus a 15.3 trillion won consensus.

LG did not disclose further details of first-quarter operations and will announce full results in late April.

Analysts said LG’s longtime loss-generating smartphone business and intensifying price competition in the global TV market likely weighed on earnings.

LG held 3 percent of the global smartphone market in terms of shipment last year, according to a report from market tracker Counterpoint Research.

Earlier on Friday, Samsung said it was heading for its lowest quarterly profit in more than two years as a glut in memory chips, slowing panel sales and rising competition in smartphones hit margins.

NEW DELHI/MUMBAI (Reuters) – The grounding of India’s Jet Airways is turning into a quick windfall and long-term opportunity for international airlines keen to scoop up nearly a million outbound passengers from what was once the nation’s biggest airline.

Jet, which previously had a fleet of around 120 largely Boeing Co planes, was forced to indefinitely halt all flight operations on April 17 after its banks rejected the carrier’s plea for emergency funds.

The carrier’s descent into crisis has benefited international airlines in the form of rising fares and demand, data showed.

Fares from India to cities such as Dubai, London, New York, Singapore and Bali in the first quarter of 2019 rose between 4 percent and 32 percent from a year ago, according to Indian travel portal MakeMyTrip Ltd.

In the peak travel months of May and June, fares to London have spiked as much as 36 percent and tickets to San Francisco are up nearly 20 percent from a year ago, according to data from travel portal Yatra.com.

“For the next three months it’s actually bonanza time for international players,” said Ashish Nainan, a research analyst at CARE Ratings. “At least until the middle of June, the fares are not going to come down.”

Due to rising demand, even before Jet’s lessors grounded planes, carriers such as British Airways, Cathay Pacific Airways Ltd, Singapore Airlines Ltd and United Airlines saw an up to a 27 percent increase in passenger numbers from India in the last quarter of 2018, data from India’s aviation regulator showed. That is the latest period for which the data is available.

India is one of the world’s fastest-growing aviation markets, clocking 15-20 percent domestic growth in recent years. It has long had only two full-service long-haul carriers, state-run Air India and Jet.

Jet is now hoping to be bailed out by a new investor, with final bids due on May 10.

INCREASING CAPACITY

Before its grounding, Jet had the biggest share of India’s outbound international air traffic, carrying 12 percent of the 7.8 million passengers headed overseas in the Oct-Dec quarter, down from 14 percent a year earlier, data from the Directorate General of Civil Aviation showed.

The total number of passengers traveling overseas with Jet fell 10 percent during the last quarter of 2018 even as the outbound travel market grew about 5 percent.

Meanwhile, Singapore Airlines posted a 27 percent increase in passengers from India, Cathay registered 17 percent growth and British Airways saw a 10 percent rise in the same period.

Cathay said the events at Jet combined with increasing demand for travel had led it to deploy larger aircraft with more seats on some Indian routes.

“In the long term we would certainly like to be able to offer more capacity into India, not just on our existing routes but by establishing new services to secondary cities,” Cathay said in a statement.

Singapore Airlines, in an email to Reuters, said the Indian market is “very promising” but declined to give details of airfare levels or demand patterns in the wake of Jet’s exit, citing a quiet period before the release of its annual results.

DOMESTIC GAINS

Jet’s grounding has also had a big impact on the domestic market, with inter-city air fares to major cities such as New Delhi, Mumbai, Bengaluru and Kolkata soaring more than 20 percent in May and June, according to Yatra.com.

The spike in fares is expected to underpin strong earnings for IndiGo and SpiceJet Ltd, which are set to report results for the quarter ended March 31 in the coming weeks.

“Domestic Indian carriers are the main benefactors, but I suspect if Jet fails to be revived by May 10 then Vistara and other airlines that ply international routes, particularly the lucrative Gulf market, are the main winners,” said Shukor Yusof, the head of aviation consultancy Endau Analytics. Vistara is a joint venture of India’s Tata Sons and Singapore Airlines.

Inadequate bilateral traffic rights between India and other countries, however, could be an impediment to foreign carriers’ hopes of winning business lost by Jet, some analysts said.

“Even before Jet’s operational shutdown, international capacity was significantly constrained,” said Kapil Kaul, CEO for South Asia of consultancy CAPA. “We have now more serious capacity challenge … this is unlikely to be stabilized in the near term.”

A new national government likely to be in place sometime after elections end in May is expected to address the international capacity constraints, and once bilateral agreements are eased airlines including Emirates, Turkish and Qatar would immediately benefit, said Kaul.

“We would love to add more flights but we are at the limit of the allocation granted to us for traffic rights,” Emirates Chief Commercial Officer Thierry Antinori told reporters in Dubai on Wednesday.

(Reuters) – AstraZeneca Plc beat first-quarter sales and earnings expectations on Friday as the British drugmaker benefited from a push into cancer drugs and emerging markets including China.

Newer treatments such as lung cancer drug Tagrisso, now the company’s top selling medicine, have helped the drugmaker’s return to growth after years of crumbling sales due to patent losses on older drugs.

Sales in China have shown explosive growth, more than doubling since 2012, but AstraZeneca executives on Friday said that may not be sustained.

“The enormous growth you currently see in China, 28 percent, probably is not sustainable, but we feel very bullish that the growth will continue to be at a pace of between 15 percent and 20 percent,” Ruud Dobber, executive vice president, BioPharma, told Reuters.

Shares of the company were down 0.2 percent at 5,878 pence at 1031 GMT.

The turnaround in AstraZeneca’s fortunes has been powered by a push into cancer treatments led by Chief Executive Pascal Soriot, who saw off a 2014 takeover bid from Pfizer in part by promising annual sales of $45 billion by 2023.

In the first quarter, sales from its oncology unit rose 59 percent to $1.89 billion, accounting for 35 percent of total product sales.

The company has moved deeper into cancer therapy market through wide-ranging deals, including those for immunotherapy and targeted therapy. Last month, it agreed a multi-billion dollar oncology deal with Japan’s Daiichi Sankyo Co Ltd.

“We’re reaching that point where after years of having to keep faith, we have actually got something tangible to believe in,” Hargreaves Lansdown analyst Nicholas Hyett said.

AstraZeneca also backed its annual sales and earnings forecast and said it has extensively prepared for UK’s anticipated exit from the European Union, even in the event of a no-deal exit.

The company has already spent more than 40 million pounds ($52 million) on Brexit preparations, including stockpiling six weeks’ worth of drugs in the UK and four weeks in continental Europe to guard against shortages.

AstraZeneca said product sales rose 14 percent at constant currency to $5.47 billion in the quarter, led by its lung cancer drug Tagrisso and respiratory treatment Pulmicort.

China sales increased by 28 percent to $1.24 billion in the quarter, accounting for nearly a quarter of overall product sales.

Core earnings came in at 89 cents per share in the quarter. Analysts on average were expecting core earnings of 85 cents per share and product sales of $5.29 billion, according to a company provided consensus of 19 analysts.

Britain and Ireland are making a new push to restore Northern Ireland’s collapsed government, amid mounting criticism of politicians following the murder of a journalist by a banned militant group.

The two governments are expected to make an announcement Friday about talks to revive the power-sharing administration, which has been suspended for more than two years because of a dispute between the main Protestant and Catholic parties.

Security officials warn that political drift in Northern Ireland could embolden those bent on violence.

Pressure on politicians has grown since the killing of journalist Lyra McKee, shot dead by an Irish nationalist militant during rioting in Londonderry last week.

Police have released video footage of a stocky, masked man they say is a key suspect and have urged residents to help identify him.
