SEC steps on Tesla ‘reasonable’ to prevent problems: commissioner

WASHINGTON (Reuters) – The U.S. securities watchdog’s request that a federal judge hold Tesla Inc Chief Executive Elon Musk in contempt over the billionaire entrepreneur’s use of Twitter was “reasonable,” said a U.S. Securities and Exchange Commission official on Monday.

SEC Commissioner Robert Jackson, a Democrat, told reporters at a conference in Washington that the SEC was reasonable in suggesting greater oversight of Musk’s communications, including the threat of new fines if he backslides.

“The idea (is) that we would have future oversight to prevent future problems from recurring,” Jackson said.

The SEC had asked U.S. District Judge Alison Nathan to hold Musk in contempt over a Feb. 19 tweet in which the agency said he had improperly posted material information about Tesla’s vehicle production outlook without seeking approval from its lawyers.

In a Friday order, the judge gave both sides until April 18 to reach a resolution. If they do not, the judge said she would decide whether to hold Musk in contempt. If he is held in contempt, the judge would allow discussions on possible sanctions. “I understand those who are skeptical and who feel that it’s innovative relief – to me it was important relief and I thought enforcement took very reasonable steps, both to the nature of the relief and our oversight of that relief,” added Jackson of the judge’s order.

The SEC, which had sued Tesla, asked the company in September to consider removing Musk. The CEO agreed to step down as Tesla’s chairman in an agreement that also required preapproval of Musk’s written communications that could be material to the company, such as volumes of cars produced or other information likely to change the value of its securities. In a statement by Tesla on Thursday, Musk said “the tweet in question was true, immaterial to shareholders, and in no way a violation of my agreement.”

The SEC said the first of the Feb. 19 tweets conflicted with Tesla’s Jan. 30 outlook, when it targeted annualized Model 3 production exceeding 500,000 as soon as the fourth quarter, and projected 360,000 to 400,000 vehicle deliveries this year.

At the time the SEC also said Musk had violated their agreement by sending a tweet that had not been vetted by Tesla’s lawyers and he should be held in contempt. It did not say what penalties it wanted imposed, raising the question of whether it would again seek his removal or propose less drastic measures.

MEXICO CITY (Reuters) – Gunmen shot dead 13 people at a bar in the city of Minatitlan in the Mexican Gulf coast state of Veracruz, authorities said on Friday, in one of the worst slayings to hit Mexico since President Andres Manuel Lopez Obrador took office.

The unidentified assailants opened fire on Friday night after coming to look for a man at a bar in the southeast of Minatitlan, a spokesman for the government of Veracruz said.

Seven men, five women and a child died in the shooting, which occurred close to Minatitlan’s oil refinery, one of six run by state oil firm Petroleos Mexicanos (Pemex). Four other people were injured, the state government said in a statement.

The motive for the killings was unclear, the spokesman said.

The man the gunmen were seeking was identified as the owner of a bar in the city, the state government said. The attack took place during a family celebration.

It was not immediately clear if the man owned the bar where the attack occurred, nor whether he was present at the time.

Hugo Gutierrez, the head of public security in the state, said on Twitter that an operation had been launched to capture the people responsible for the killings.

The oil-rich state of Veracruz has been convulsed by gang violence and political corruption scandals for several years.

Lopez Obrador took office in December vowing to reduce violence in Mexico, where more than 200,000 people have been killed since the end of 2006 in brutal turf wars between drug cartels and their clashes with security forces.

After reaching record levels in 2018, murder rates have stayed high, surpassing previous-year levels in the first three months of the new government, official government data shows.

The president was due to visit Veracruz on Sunday, according to an official schedule published before the attack took place.

At least 1 dead after new cyclone tears into Mozambique

At least one person is reported dead and homes have been destroyed by a powerful cyclone that struck northern Mozambique and continues to dump rain on the region, with the United Nations warning of "massive flooding."

Cyclone Kenneth arrived just six weeks after Cyclone Idai tore into central Mozambique, killing more than 600 people and displacing scores of thousands. The U.N. says this is the first time in known history that the southern African nation has been hit by two cyclones in one season.

Forecasters say the new cyclone made landfall Thursday night in a part of Mozambique that has not seen such a storm in at least 60 years.

Mozambique's local emergency operations center says a woman in the city of Pemba was killed by a falling tree.

LONDON (Reuters) – A senior Revolutionary Guards commander said on Wednesday Iranian Foreign Minister Mohammad Javad Zarif was the main person in charge of foreign policy and he was supported by the Supreme Leader, Ayatollah Ali Khamenei.

Zarif tendered his resignation two days ago but President Hassan Rouhani has not accepted it yet.

“Mr Zarif is in charge of the foreign policy of the Islamic Republic, and has always been supported by the top officials,” Qassem Soleimani, head of the Quds Force — the extraterritorial branch of the Islamic Revolutionary Guard Corps – was quoted as saying by Fars news agency.

Migrants break border gate, force their way into Mexico

Mexican authorities say that a group of about 350 migrants broke the locks on a border gate and forced their way into southern Mexico.

The National Immigration Institute did not identify the nationalities of the migrants, but they are usually from Central America. A similar confrontation occurred on the border bridge between Mexico and Guatemala last year.

The institute said the migrants were acting in a "hostile" and "aggressive" way, and accused them of also attacking local police in Metapa, a Mexican village that lies between the border and the nearby city of Tapachula.

The group of 350 pushed past police guarding the bridge and joined a larger group of about 2,000 migrants who are walking toward Tapachula, the latest caravan to enter Mexico.

Mom who triggered Amber Alert planned to inject daughter, herself with bleach, police say

A mother who triggered an Amber Alert in Washington last week planned to inject her daughter and herself with bleach to rid themselves of parasites, police said.

Brooke Helmandollar, 41, was arrested and charged with criminal mistreatment of her daughter, 10, who she pulled out of school on March 12, the Spokesman-Review reported. Police in Nampa, Idaho, issued an Amber Alert on March 20 for Alissa Helmandollar a day after she was last seen with Helmandollar at a hotel. Authorities at the time said they feared the girl may have been in danger “due to Brooke’s recent threatening behavior.”

Helmandollar took Alissa out of school earlier this month and told a staff member she and her daughter would be staying in a hotel because of a parasite and insect infestation at their house. The staff member, however, also noticed the mother’s car seats were covered with protective plastic.

The 41-year-old later told police she planned to inject bleach in her daughter and herself, court documents stated. Police also found bleach, charcoal and materials to perform enemas, the Spokesman-Review reported.

The mother-daughter duo was located in Cheney, Washington, a short time after the Amber Alert was issued.

The 10-year-old was placed in Child Protective Services custody following Helmandollar’s arrest.

Helmandollar later told police she was suffering from health issues and initially sought medical help but believed her doctors were not listening to her, KREM2 reported. She was taken to the hospital for a mental health evaluation.

Helmandollar’s husband, John Helmandollar, was also being investigated for child endangerment after he did not appear about his daughter’s disappearance. When he discovered an Amber Alert was issued, he told police, “That’s not going to make me look good,” court documents stated.

LONDON (Reuters) – The leader of Britain’s opposition Labour Party, Jeremy Corbyn, said on Friday he had turned down an invitation to a state dinner which will be part of U.S. President Donald Trump’s visit to Britain in June.

“Theresa May should not be rolling out the red carpet for a state visit to honor a president who rips up vital international treaties, backs climate change denial and uses racist and misogynist rhetoric,” Corbyn said in a statement.

He said maintaining the relationship with the United States did not require “the pomp and ceremony of a state visit” and he said he would welcome a meeting with Trump “to discuss all matters of interest.”

A bedridden 67-year-old woman and more than a dozen animals were rescued Thursday after a welfare check found that they were living in a home filled with trash, urine, and feces, Florida police said.

Pinellas County sheriff’s deputies said when they arrived at the home in Dunedin around 7:20 p.m. Thursday, they could smell the odor of rotting trash and animal feces as they walked up to the driveway.

“Inside the residence, the odor of feces and urine was so overwhelming that deputies had to don masks,” the sheriff’s department said in a statement.

Walking throughout the residence, the deputies found 10 emaciated dogs and puppies living in bins filled with their own feces, five large Macaw birds flying freely, rats, bugs and overall squalor.

Deputies said due to the large amounts of trash in the home, they had to clear a path to reach the victim’s bedroom.

“None of the home’s toilets were working and all were found to be overflowing with feces,” deputies said. “The only working sink was located on the opposite end of the house from the victim’s bedroom.”

They said there was no food or water for the victim or the animals.

The victim was transported to a local hospital for injuries that were non-life threatening, while the animals were transported to shelters.

The woman’s caretaker, Richard Lawrence Goodwin, 65, was arrested and charged with abuse and neglect of an elderly person, disabled person, and cruelty to animals.

Libyan Minister of Economy Ali Abdulaziz Issawi speaks during an interview with Reuters in Tripoli

April 26, 2019

By Ulf Laessing

TRIPOLI (Reuters) – Libya’s U.N.-recognized government has budgeted up to 2 billion dinars ($1.43 billion) to cover costs of a three-week-old war for control of the capital, such as treatment for the wounded, to be funded without new borrowing, the economy minister said.

Ali Abdulaziz Issawi suggested the government hoped for business to continue more or less as usual despite the assault on Tripoli, in the country’s northwest, by forces tied to a parallel administration based in the eastern city of Benghazi.

Once Africa’s third largest producer of oil, Libya has been riven by factional conflict since the fall of Muammar Gaddafi in 2011, with the country now broadly split between eastern-based forces under Khalifa Haftar and the U.N.-backed government in Tripoli, in the west, under Prime Minister Fayez al-Serraj.

Still, with Haftar’s Libyan National Army forces unable so far to pierce defenses in Tripoli’s southern suburbs, normal life and business activities continue in much of the capital and western coastal towns.

Issawi, in an interview with Reuters in his Tripoli office, also said Libya’s commercial ports and wheat imports were still functioning normally, although some roads have been blocked.

He said the Serraj government estimates it will spend up to 2 billion dinars extra on medical treatment for wounded, aid for displaced people and other “emergency” war costs.

He said this was not military spending but analysts believe that the sum will also cover expenditures such as pay for allied armed groups or food for fighters.

“We could actually spend less,” he added, in comments that gave the first insight into the economic impact of the fighting.

Issawi said the Tripoli government, which controls little territory beyond the greater capital region, would not incur new debt to fund the war costs, sticking to a plan to post a 2019 budget without a deficit.

Tripoli derives revenue largely from oil and natural gas production, interest-free loans from local banks to the central bank, and a 183 percent surcharge on foreign exchange transactions conducted at official rates.

But with centralized tax collection greatly diminished, public debt has piled up – to 68 billion dinars in the west, including unpaid state obligations such as social insurance.

Some analysts expect Serraj’s government will be forced to raise new debt if the war for control of Tripoli drags on.

With much of Libya dominated by armed factions that also act as security forces, the public wage bill for both the western and eastern administrations has soared as fighters have been made public employees in efforts to buy their loyalty.

The east has sold bonds worth 35 billion dinars outside the official financial system as the Tripoli central bank does not fund the parallel government apart from some wages.

Despite its limited reach, the Tripoli government still runs an annual budget of around 46.8 billion dinars, mainly for public salaries and fuel subsidies.

“This year we cannot finance via debt…we will not borrow (by agreement with the central bank),” Issawi said.

According to International Monetary Fund data, Libya’s central government debt-to-GDP ratio is 143 percent, making it one of the most heavily indebted in the world on that measure.

Issawi declined to say what parts of the budget would be trimmed to support the extra outlay for war costs.

However, with some 70 percent of the budget allocated to public wages, fuel subsidies and other welfare benefits, a portion devoted to infrastructure is most likely to be axed.

Widespread lawlessness has meant there have been no major infrastructural projects since 2011, when a NATO-backed uprising overthrew dictator Muammar Gaddafi, leaving schools, hospitals and roads in acute need of restoration.

FOREX SURCHARGE

Issawi said the government planned to raise as much as 30 billion dinars by the end of 2019 from hard currency deals after imposing in September a 183 percent surcharge on commercial and private transactions done on the official rate of 1.4 to the U.S. dollar. That fee has effectively devalued the official rate to 3.9, much closer to the black market equivalent.

Some 17 billion dinars have been raised since then, with hard currency allocated for import credit letters now issued without delays, Issawi said. The forex fee has helped the government forecast a budget in the black for 2019.

Despite the narrowing spread between the two rates, the black market continues to thrive. Dozens of traders remained at their favorite spot behind the central bank headquarters in Tripoli when Reuters reporters visited it last week.

But traders said it could take time for the Serraj government to register the extra forex receipts as official banking channels were taking up to six months to approve import financing, keeping the black market in play for dealers.

Issawi said authorities planned to lower the forex fee from 183 percent, without saying when. The black market rate has dropped from 6 to around 4.1 since September but it has hardly moved of late as demand for black market cash remains high.

The Tripoli government has stopped subsidizing food and bread, which used to be cheaper than drinking water in Libya. Wheat imports are now being arranged by private traders and there are surplus stocks of flour at the moment, Issawi said.
