Ex-Celtic Jabari Bird makes plea in domestic assault case

Former Boston Celtics guard Jabari Bird awaits sentencing after making a plea in a case accusing him of assaulting his ex-girlfriend.

The 24-year-old Bird was released on bail after the hearing Monday pending sentencing May 28.

He pleaded to sufficient facts. The plea is not an admission of guilt but acknowledges a likely conviction at trial.

Bird faced several charges in the alleged attack on the woman in September, including strangulation or suffocation, kidnapping, and assault and battery with a dangerous weapon.

The woman said in a statement read in court that the violence started when she accused Bird of cheating.

The woman said "the physical and psychological pain you have caused me will haunt me forever."

Bird and the woman declined to comment outside court. The Celtics traded Bird in February.

Mark Levin blasts Mueller report as ‘200-page op-ed’ for liberal media: ‘This is a hack job!’

Special Counsel Robert Mueller wrote the report for the left-wing media and it wouldn't stand up in court, conservative radio host Mark Levin said on Fox News.

"This report, Volume II, doesn't have a syllable of legal significance," Levin, the host of "Life, Liberty & Levin," said. "There's not a syllable of law in it...None if's been tested in a court of law. There's been no challenge to it. No cross-examination. Nothing."

He added: "That's why Mueller wrote this. This is a political document that he should never have written...He knew CNN would be obsessed with it. He knew that MSNBC would be obsessed with it...This is a 200-page op-ed.

"No prosecutor - if they didn't want to be disbarred - would ever produce anything like this...That's why prosecutors are not supposed to write essays."

His comments come after Attorney General Bill Barr held a press conference Thursday morning before releasing the redacted Mueller report to the public.

Levin expressed anger at the Democratic leadership and left-wing media's obsession over yesterday's documents, instead of Volume I, which he says found no collusion between Trump and Russa, the entire purpose of the investigation.

House Judiciary Chairman Jerry Nadler, whom Levin calls a "slip-n-fall lawyer," submitted a subpoena to obtain the "complete and unredacted" Mueller report Friday.

"Obstruction was not the purpose of the investigation, and he didn't have an obstruction case against the president, otherwise, he would've brought it," Levin said. "I'm using plain English so even Joe Scarborough and Jake Tapper can understand this."

He added: "Volume II is crap. Volume II was written for slip-n-fall lawyer Nadler, slip-n-fall lawyer Schiff. That's why he wrote it. He knew the media would run with it."

Levin said Mueller should've shut down the investigation as soon as he realized the president didn't collude with Russia but he says Mueller had alternative motives and blasted Volume I as faulty as well.

"How can you talk about Russia interfering in our election and ignore the Hillary Clinton campaign, and the DNC, and the senior level FBI that's been wiped out by their own conduct? How in the world can you do that and not interview Barack Obama and Susan Rice and all the rest of them?" Levin said. "This is a hack job!"

Levin pointed out the media's negative reporting of Trump. "This isn't a free press!"

Gas tanker explosion near Los Angeles injures 2; smoke could be seen for miles

A leaky gas tanker burst into flames south of Los Angeles on Sunday, injuring two people and sending a cloud of smoke into the air that could be seen for miles.

The explosion unfolded Sunday morning in Florence. Photos showed one nearby home blackened from the flames and smoke just a few hours later. The fire department tweeted out updates throughout Sunday morning.

Two people were rushed to the hospital with unknown injuries, but there were no deaths. The blast sent a manhole cover flying into the air and flames shooting out of the storm drain, police said in a statement.

Firefighters got a call in the morning about the smell of gas in the air, and when they arrived at the scene they found a 9,000-gallon tanker leaking. The Los Angeles Police Department (LAPD) said the gas connected with an ignition source and exploded into flames, forcing the firefighters back and leaving the nearby houses open to the flames.

"Companies put water on the fire, trying to protect two buildings that were exposed to the flames," firefighter Nicolas Prange told Reuters.

At least one family was forced to leave. Some 72 firefighters tried to put out the blaze, and it was finally extinguished after almost two hours. The Los Angeles Fire Department (LAFD) said the fuel type originally was thought to be natural gas, but investigators later determined it was gasoline.

Photos showed the tanker was transformed into a heap of scrap metal after nearly two hours of being on fire.

LAFD Hazardous Materials specialists were on the scene to determine the environmental impact of the blaze and to make sure crews still working near the incident were safe. The LAPD said arson investigators also were dispatched to investigate any possible foul play.

Southern California Gas Co. crews were evaluating whether any of their equipment was damaged in the explosion, according to spokeswoman Melissa Bailey.

Australian media to face court over Pell trial coverage

SYDNEY (Reuters) – Three dozen Australian journalists and publishers are to face court on Monday over their coverage of Cardinal George Pell’s trial for child sex abuse, with prosecutors seeking fines and jail terms over accusations of breached gag orders in the case. Prosecutors in the southeastern state of Victoria have accused the 23 journalists and 13 news outlets of aiding and abetting contempt of court by overseas media and breaching suppression orders.

Among those facing contempt charges are Nine Entertainment Co, the Age, the Australian Financial Review, Macquarie Media, and several News Corp publications.

Although Monday’s hearing is largely procedural, media experts say the case shows not only the serious consequences of breaching rules on court reporting but also how poorly the rules rein in coverage in the era of digital news.

“It shows that the laws themselves are out of sync with the speed and breadth of publication,” said Mark Pearson, a professor of journalism and social media at Griffith University in Queensland state.

“But the courts can only do what is available to them. The courts have to send a message that people deserve a fair trial and that people can’t publish what they want to when someone is facing court, if that might damage the trial.”

Breaches of suppression orders can be punished with jail for up to five years and fines of nearly A$100,000 ($71,000) for individuals, and nearly A$500,000 for companies.

Macquarie Media did not respond to a request for comment but it has previously declined to comment, as the accusations are subject to legal proceedings.

Nine, which owns the Age and the Australian Financial Review, has denied the accusations and said it was surprised by the charges. News Corp has said it will defend itself vigorously.

Pell, who became the most senior Catholic cleric worldwide to be convicted of child sex abuse, was jailed for six years in February.

The county court of Victoria put a suppression order on reporting of Pell’s trial last year to prevent jury prejudice in that case, as well as on a second trial on other charges set for March.

In December, the jury in the first trial found Pell guilty of abusing two choir boys.

After the verdict, some Australian media said an unnamed high-profile person had been convicted of a serious crime that could not be reported.

No Australian media named Pell or the charges at the time, though some overseas media did.

Those who published online do not have offices or staff in Australia and were not charged for ignoring the suppression order, but have lobbied against it.

“Gag orders are futile in a case of global interest in the digital age,” said Steven Butler, an official of the Washington-based Committee to Protect Journalists. “We urge Australian authorities to drop these proceedings and to re-examine the application of such suppression orders,” added Butler.

The gag order, which had applied across Australia “and on any website or other electronic or broadcast format accessible within Australia”, was lifted on Feb. 26 when the charges that would have figured in the second trial were dropped.

PARIS (Reuters) – Drinks group Pernod Ricard, which is being targeted by activist investor Elliott, is banking that its push into socially and environmentally sound business practices will boost its growth in the coming decade.

Pernod, the world’s second-biggest spirits group behind Diageo, is unveiling on Wednesday a strategic roadmap plan going up to 2030.

That plan includes eight pledges to undertake socially responsible business habits, such as preserving and looking after the land used to produce its Martell cognac or Mumm champagne brands.

Other pledges include aims to save water and cut down on waste and carbon emissions, as well as fighting alcohol abuse and promoting gender balance in its top management teams.

Companies around the world are tweaking business models to ensure they capture the current vogue for having strong environmental, social and corporate governance habits (‘ESG’).

This is partly to win over “Millennial” customers who are often keen to help the environment, and to attract investments from funds that specialize in putting trillions of dollars into companies screened for having good ethical criteria.

“It’s about making sure we have a very cohesive plan of action that addresses all aspects of our business from grain to glass,” said Pernod executive Vanessa Wright, speaking to Reuters ahead of the publication of the new Pernod plan.

BROADER PLANS TO BOOST PROFITS

Pernod – together with peers such as Diageo, Danone and Nestle – is looking to respond to new demands from consumers choosing healthier diets and lifestyles seen as helping the environment and communities.

Wright, who is group vice-president for Sustainability & Responsibility at Pernod, said the new ethical pledges formed part of Pernod’s broader plan to lift profits and sales, with the French company under pressure from Elliott.

New York hedge fund Elliott Management wants Pernod to improve profit margins and corporate governance.

Pernod, which also makes Absolut vodka and Jameson whiskey, has already vowed to raise operating margins by 50-60 basis point each year between now and 2021, provided it can deliver annual organic sales growth of 4-7 percent.

Pernod is also promising to close the gender pay gap across its business by 2022.

In the last eight years, some 95 percent of Pernod’s vineyards have been awarded formal certificates to show they do not harm the environment, while those vineyards have also cut back on the amount of water used and their carbon emissions.

“A lot of these actions will create long-term value. Value will also come from consumers being more attracted to our brands and we will also save some costs,” said Wright.

By 2030, Pernod is committing to halve its carbon footprint levels from 2.84 million tonnes per year at present.

It is also hoping to replenish 100 percent of the water consumption at production sites, and will ban promotional items made from single-use plastic by 2025, among other gestures.

DUBLIN (Reuters) – Ireland pleaded with religious orders on Wednesday to reveal where decades-old remains of all babies who died in their care are buried, after an official inquiry found they provided remarkably little evidence about their deaths.

Findings by the inquiry two years ago that remains ranging in age from 35 foetal weeks to 3 years were stored in underground chambers at a former church-run home for unwed mothers revived anguish over how women and children were once treated at state-backed Roman Catholic institutions.

Investigators confirmed on Wednesday that 802 children died at the home in the western town of Tuam between 1925 and 1961 but said some were likely buried elsewhere on the site.

They expressed surprise at the lack of knowledge about the burials from the local council and the nuns from the Bon Secours order who ran the home.

Their latest interim report also found that over 3,000 children died in five other institutions over a similar time period. In one case investigators could only establish where 64 of the 900 children recorded to have died at the County Cork home of Bessborough were buried, despite extensive searches.

“My plea this morning, especially to the relevant people who may be out there: Let us know where they are buried,” Children’s Minister Katherine Zappone told a news conference.

“Please come forward. Tell the truth. Let us acknowledge them with that truth, that they lived and died and then maybe they could be treated with dignity in death. This is my hope as the minister for christen in Ireland.”

The infant mortality rate at Church-run institutions was significantly higher than in wider Irish society at that time, with death certificates blaming mainly infections like measles, gastroenteritis, bronchitis, tuberculosis and pneumonia. 

Relatives have alleged that the babies were mistreated because they were born to unmarried women.

As part of the inquiry, nuns from the Sacred Hearts of Jesus and Mary order who ran the Bessborough institution provided affidavits and oral evidence but gave “remarkably little evidence about the burial arrangements”, the report found.

One member of the order who was in Bessborough for most of the 1948-1998 period told the Commission that she did not remember any child deaths during her time there.

The Catholic Church’s once powerful position and prestige in Ireland have been greatly diminished over the past three decades by a series of scandals over pedophile priests, abuse at Magdalene laundries (workhouses), forced adoptions of illegitimate babies and other painful issues.

The commission is due to submit its final findings by February 2020.

“I did not think in assuming the children’s ministry (that) I would be spending so much time talking about death,” Zappone said.

Multiple people died Thursday when a semitrailer plowed into stationary traffic that resulted in explosions and flames on a Colorado freeway, authorities said.

The incident occurred just before 5 p.m. in the Denver suburb of Lakewood when a truck driver lost control while traveling east on Interstate 70, according to a preliminary investigation. The collision started a chain reaction and a diesel fuel spill, Lakewood police spokesman Ty Countryman told the Denver Post.

“This is looking to be one of the worst accidents we’ve had here in Lakewood,” he said.

The driver of the runaway truck survived. At least one truck was carrying lumber, another was hauling gravel and the third may have been carrying mattresses, KDVR-TV reported.

Lakewood police tweeted there were multiple fatalities but did not give a specific number. Six people were taken to a hospital. Their conditions were not released, according to the paper.

Lanes in both directions were closed and expected to remain so into Friday morning.

President Trump will address members and leaders of the National Rifle Association on Friday at the group’s annual convention in Indiana.

Around 80,000 gun enthusiasts and more than 800 exhibitors are expected to pack the Indiana Convention Center in Indianapolis for the three-day event, the Indianapolis Star reported. It will mark the third straight year that Trump will deliver the keynote address, where he is expected to champion the rights of gun owners.

COLORADO ENACTS ‘RED FLAG’ LAW TO SEIZE GUNS FROM THOSE DEEMED DANGEROUS, PROMPTING BACKLASH

Trump and Vice President Mike Pence spoke at last year’s convention in Dallas. During his speech, Trump assured gun owners that he would protect their Second Amendment rights, according to the paper.

“Your Second Amendment rights are under siege,” Trump told the cheering audience in Dallas. “But they will never, ever be under siege as long as I am your president.”

Trump has supported some gun control measures in the past. Last year, his administration imposed a ban on bump stocks, attachments that enable semiautomatic rifles to fire in rapid bursts. Although, he most recently threatened to veto two Democratic gun control bills.

This year’s convention comes as the NRA faces outside pressure and internal problems. The group has seen its legislative agenda stall amid a series of mass shootings — including a massacre at a Parkland, Fla., high school in February 2018 that left 17 dead and launched a youth movement against gun violence.

It’s also grappling with infighting in its ranks, money problems and investigations into whether Russian agents courted officials and funneled money through the group.

“I’ve never seen the NRA this vulnerable,” said John Feinblatt, president of Everytown for Gun Safety, a nonprofit that advocates for gun control measure.

The convention will run through the weekend and conclude Sunday.

(Reuters) – Ailing British retailer Debenhams said two proposed company voluntary arrangements (CVA) could see all its stores remaining open during 2019, with 22 closures planned for next year, putting about 1,200 jobs at risk.

Debenhams’ lenders took control of the retailer earlier this month in a process designed to keep its shops open at the expense of shareholders.

BENGALURU (Reuters) – Chinese brands controlled a record 66 percent of Indian smartphone market in the first quarter, led by Xiaomi Corp, a report showed, with volumes rising 20 percent on the back of popularity for brands like Vivo, RealMe and Oppo.

Xiaomi’s India shipments fell by 2 percent over last year, but the Beijing-based company was still the biggest smartphone brand in the country, followed by Samsung Electronics Co Ltd, according to Hong-Kong based Counterpoint Research.

Shipment volumes for Vivo jumped 119 percent, while those of Oppo rose 28 percent.

“Vivo’s expanding portfolio in the mid-tier range ($100 to $180) drove its growth along with aggressive Indian Premier League cricket campaign,” Counterpoint analysts said.

India is the world’s fastest growing market for smartphones, where affordable pricing coupled with features like “selfie” cameras and big screens have popularized Chinese brands.

Video streaming services like Netflix Inc and Hotstar, as well as heavy usage of messaging apps like Facebook Inc’s WhatsApp have further spurred demand.

“Data consumption is on the rise and users are upgrading their phones faster as compared to other regions,” Counterpoint’s Tarun Pathak said.

“As a result of this, the premium specs are now diffusing faster into the mid-tier price brands. We estimate this trend to continue leading to a competitive mid-tier segment in coming quarters.”

The Dalai Lama has returned to his headquarters in the north Indian hill town of Dharmsala after a brief stay in a hospital in the capital for treatment of a chest infection.

Hundreds of exiled Tibetans lined the streets of Dharmsala carrying ceremonial scarves and incense sticks to welcome the Dalai Lama on Friday.

The 83-year-old Tibetan spiritual leader told reporters that he had fully recovered, but that the illness had been “a little bit serious.” He did not give any details.

The Dalai Lama usually spends several months a year traveling the world to teach Buddhism and highlight Tibetans’ struggle for greater freedom in China. But he has cut down on his travels in the past year to take care of his health.
