Former Barclays chairman ‘not aware’ of Qatar fee document, court told

LONDON (Reuters) – Barclays’ former chairman, giving evidence in a landmark London fraud trial, said he first saw a document detailing agreed fees for Qatari investors in the British bank four years after the payment was agreed.

Former Barclays chief executive John Varley and some of his most senior former colleagues – Roger Jenkins, Tom Kalaris and Richard Boath – are charged with conspiracy to commit fraud by false representation over side deals struck with Qatar during an 11 billion pound-plus emergency fundraising over a decade ago.

Marcus Agius, the bank’s former chairman, told the trial on Wednesday that he did not know how 280 million pounds ($365 million) of extra fees for Qatar were negotiated or how the figure was arrived at in October 2008 at the height of the financial crisis.

“Not only did I not see the document, I was not aware of its existence,” the veteran banker, who is giving evidence for the prosecution, told Southwark Crown Court on his second day in the witness box. He said he first saw the document in 2012.

Agius was not cross examined by the defense.

Qatari investors plowed around 4.0 billion pounds into Barclays during two fund raisings at the height of the credit crisis in 2008 that allowed the bank to avoid a state bailout.

The Serious Fraud Office, which is prosecuting the case, alleges the four former Barclays’ executives misled shareholders, the market and other investors by not disclosing that Barclays paid an extra 322 million pounds to Qatar through two “advisory service agreements” over a decade ago.

The former executives – the most senior bankers to face a jury trial in Britain over credit crisis-era conduct – deny wrongdoing.

Varley and Agius had been jointly handed full authority to carry out a second capital raising after a meeting of a board finance committee, established by Barclays on Oct. 28, 2008. This included approving fees that were “fair and reasonable”, according to documents presented to the court.

“Matters were moving almost on an hourly basis,” Agius said, noting that a smaller decision-making group was more practical to secure strategic investors as markets gyrated in the credit crunch.

Agius, the first prosecution witness to give evidence, said he had been aware of underwriting fees and a 66 million pound payment for Qatar for helping bring on board Abu Dhabi investors in the October fundraising.

Qatari investors have not been accused of wrongdoing.

The trial is scheduled to last for up to six months.

WASHINGTON (Reuters) – Lawyers for President Donald Trump’s former national security adviser Michael Flynn asked a judge on Tuesday to delay his sentencing in a case that stemmed from an investigation of possible collusion between Trump’s campaign and Russia during the 2016 presidential election campaign.

The lawyers asked Judge Emmet Sullivan for a delay of 90 days while Flynn may need to provide more cooperation in the Russia probe being led by Special Counsel Robert Mueller.

The request was made in a joint filing with Mueller, who said he took no position on Flynn’s request for a delay.

India’s polarized politics: how two teenagers will vote after surviving riots

AHMEDABAD, India (Reuters) – On the night of February 28, 2002, two toddlers living in adjacent alleys were dragged out of a slum district in Ahmedabad in the western state of Gujarat that had been set ablaze by a mob in one of India’s worst ever Hindu-Muslim riots.

The attack in the Naroda Patiya area of the state’s biggest city was among scores of clashes in which more than 800 Muslims and 255 Hindus were killed in the month-long violence in the home state of Narendra Modi. He had just become its chief minister and would rule there until becoming India’s prime minister in 2014.

Rights groups say about 2,000 people were killed, mostly Muslims, and including scores of children.

The toddlers who survived, a Muslim boy and a Hindu girl, were both one-year-olds at the time of the riots. Now, 17 years later, they are among an estimated 15 million first-time voters in a general election in which Modi and his Hindu nationalist Bharatiya Janata Party (BJP) are seeking a second term on a platform that, critics say, marginalises Muslims in favor of the nation’s majority Hindus.

Mohammad Rafiq and Pooja Jadhav, now both 18, met for the first time during the Reuters interview. Jadhav hesitantly acknowledged Rafiq’s presence but said they were too shy to talk.

“I have many Muslim female friends but I don’t talk to Muslim boys,” she said in the presence of her mother.

But despite the silence between them, they have a lot in common.

Both are largely uneducated and work 10 hour-days in menial jobs to support their families, who fled with them from one-room homes on that fateful day. Both want to secure permanent employment but do not have the educational qualifications, and say they want to vote for a party that will resolve this problem.

They also want get married within their communities, move to better homes and forget the 2002 riots.

But both grew up in a world of communal anger and are wary of people from the other religion. That is also reflected in their politics.         

“Even before I understood the word politics or elections, I was told that the BJP is an anti-Muslim political party,” said Rafiq who works at a factory printing election flags with symbols of the BJP and the main opposition party, Congress.

“RAGE” TOWARDS BJP

Rafiq’s family-run furniture shop and house were looted by Hindu men during the riots. His father was hit in the leg by a police bullet as he was fleeing the slum and his mother suffered head injuries when terrified people stampeded.

The family lived in a relief camp and later moved into a house situated next to Ahmedabad’s biggest garbage collection site.

“My rage towards the BJP is part of my life story. I  can forgive but I cannot forget,” said Rafiq as he stood next to a huge black mound of garbage.

“If Modi ever cared for Muslims he could come to see how we have learned to live with the stench from the landfill. His disrespect for Muslims defines my political choice,” said Rafiq, who said he will be voting for the Congress party at the polls in Gujarat on Tuesday. The votes from a 39-day staggered election will be counted on May 23.

Back in 2002, at least 97 people, mostly Muslims, living in Naroda Patiya were killed and 950 houses and shops were set on fire in less than 10 hours.

Modi, the state’s chief minister at the time, has faced allegations of allowing, or even encouraging, the Hindu attacks on Muslims, but he has vehemently denied the charges and a court-appointed investigation panel found no evidence to prosecute him.

The attacks were in retaliation for the death of at least 59 Hindus after a train carriage carrying hundreds of  pilgrims caught fire following a scuffle between Hindus and Muslims at a railway station in Gujarat.

Demarcation along religious lines has become pronounced in Ahmedabad since the riots. Hindus refused to sell houses to Muslims, forcing them to set up ghettos on the edges of the prosperous city.

Rafiq’s father sold the house in Naroda Patiya and used the money to start a metal trade business, and buy clothes and items for their new home, which was given to them by a Muslim charity organization.

“We had a choice to go back and live in the house where my neighbors were killed or live near this garbage site. My father chose the garbage site,” said Rafiq.

Rafiq traveled with Reuters to his old home in Naroda Patiya for the first time in two years. He met his relatives and stood near the house now owned by Muslims not known to him.

“The air is better here. There is no stench. I would have been happier if we lived here,” said Rafiq.

COMFORTED BY MODI

By contrast, Jadhav’s family returned to their partially damaged house in Naroda Patiya after the riots to live among Muslim neighbors.

“We had no choice. Muslim victims left this area and new Muslims came to live here. We are stuck,” she said.

Over a dozen members of 37 Hindu families in Naroda Patiya interviewed by Reuters said they want to live in a Hindu neighborhood but they lack the financial resources to move.  

When Modi became prime minister in 2014, Jadhav said her mother, a widow, celebrated his victory.

“Seeing her happy made me happy too. I have nothing against Muslims, but I like Modi,” said Jadhav, who works as a domestic helper.

Jadhav says she is comforted by BJP rule, especially living among Muslims. But she declined to say who she will vote for.

“We live in a country ruled by the BJP and Muslims know that they cannot behave badly with us. No one wants riots again,” said Jadhav. She says she enjoys listening to Modi’s speeches emphasizing his pro-Hindu brand of nationalism.

“I have heard about the riots and since then I know Muslims and Hindus should not engage after a point. There has to be a boundary forever,” she said.

The teenagers are both products of angry times.

“Children read comic books, fairy tales but we have grown up listening about Hindu, Muslim riots. My vote will be my reaction to our painful past,” said Rafiq as he scanned his mobile phone to play and sing the latest Bollywood hip hop song.

“Our time will also come,” he sang in the Hindi language and smiled at Jadhav. She hesitantly smiled back as she stood at door of her home.

Cornyn’s team, Patton Oswalt get into heated back-and-forth on Twitter

Oswalt made a brief appearance in a Tuesday video that announced the senatorial bid of Democrat Mary Jennings “MJ” Hegar, a former Air Force helicopter pilot.

Team Cornyn, the official Twitter account for Cornyn’s campaign, reposted a string of “offensive” tweets by the 50-year-old actor and questioned why Hegar would associate with Oswalt. Some Twitter users accused the campaign of "pearl clutching."

“Hollywood Hegar supporter and video guest star, Patton Oswalt, has tweeted some offensive comments over the years, reply A or B to let us know which one is more offensive to you,” read one of the tweets from Team Cornyn. The post included a screengrab of Oswalt's old tweets.

Within hours the tweet received nearly 9,000 comments but only 450 likes. Twitter users mocked Cornyn for his perceived prudishness. Others accused him of hypocrisy for not calling out President Trump for including the “S-word” in a Friday tweet.

Oswalt weighed in, accusing Cornyn of being “scared s---less” of Hegar, and for not debating her. He later mocked Cornyn for unwittingly promoting Hegar, and pleaded with his campaign to "never stop."

LONDON (Reuters) – British police have arrested 113 people after climate change activists blocked some of London’s most famous roads including Oxford Circus, Marble Arch and Waterloo Bridge in an attempt force the government to do more to tackle climate change.

The protests, led by British climate group Extinction Rebellion, brought parts of central London to a standstill on Monday and some stayed overnight for a second day of protest on Tuesday.

Extinction Rebellion, which generated headlines with a semi-nude protest in the House of Commons earlier this month, is demanding the government declare a climate and ecological emergency and reduce greenhouse gas emissions to net zero by 2025.

“There have been 113 arrests in total, the majority of which are for breach of Section 14 Notice of the Public Order Act 1986 and obstruction of the highway,” London police said.

Tents littered the roads at Oxford Circus with some activists huddled beneath a pink boat with the words “Tell the Truth” across its side. One placard read: “Rebel for Life”.

Police said five of those arrested had been detained after the Shell building near the River Thames was targeted.

Two protesters on Monday scaled up scaffolding writing ‘Shell Knows!’ in red paint on the front of the building and three protesters glued their hands to the revolving doors at the entrance.

Credit Suisse aims to take control of China securities venture

ZURICH (Reuters) – Credit Suisse has agreed to take majority control of Chinese securities venture Credit Suisse Founder Securities Ltd (CSFS), boosting its stake to 51 percent from 33.3 percent via a capital injection, the Swiss bank said on Monday.

Under the deal, the stake held by Credit Suisse’s partner Founder Securities Co Ltd will fall to 49 percent. Credit Suisse did not say how much capital it planned to inject should regulators approve the deal.

China now allows foreign banks to hold controlling stakes in securities joint ventures as a major part of the country’s pledge to ease ownership curbs, especially in the trillion-dollar financial sector.

Swiss rival UBS Group became the first foreign bank to hold a majority stake in a Chinese securities venture when China’s securities regulator gave the go-ahead in November under new rules announced by Beijing in 2017.

JP Morgan and Nomura also won Chinese regulatory approval last month to set up majority-owned brokerage joint ventures.

The China Securities Regulatory Commission said at the time it would continue to approve foreign brokerage joint ventures “efficiently”.

The biggest global investment banks, which struggled to build their China businesses under rules that previously limited them to 49 percent ownership, had long sought the lifting of such limits on joint ventures.

Established in 2008 and headquartered in Beijing, CSFS provides capital markets services in the Chinese domestic market, including sponsoring and underwriting A-shares, foreign investment shares, and government and corporate bonds. It also provides financial advisory services, Credit Suisse said.

Since October 2016, the business has also operated a securities brokerage operation in Shenzhen Qianhai.

Credit Suisse has been present in China for more than 30 years. Its franchise includes equities, investment banking and capital markets, and private banking. It also has an asset management joint venture — ICBC Credit Suisse Asset Management Co Ltd — with total assets under management of nearly 1.3 trillion yuan ($193.78 billion) as of the end of 2018.

(Reuters) – Ailing British retailer Debenhams said two proposed company voluntary arrangements (CVA) could see all its stores remaining open during 2019, with 22 closures planned for next year, putting about 1,200 jobs at risk.

Debenhams’ lenders took control of the retailer earlier this month in a process designed to keep its shops open at the expense of shareholders.

BENGALURU (Reuters) – Chinese brands controlled a record 66 percent of Indian smartphone market in the first quarter, led by Xiaomi Corp, a report showed, with volumes rising 20 percent on the back of popularity for brands like Vivo, RealMe and Oppo.

Xiaomi’s India shipments fell by 2 percent over last year, but the Beijing-based company was still the biggest smartphone brand in the country, followed by Samsung Electronics Co Ltd, according to Hong-Kong based Counterpoint Research.

Shipment volumes for Vivo jumped 119 percent, while those of Oppo rose 28 percent.

“Vivo’s expanding portfolio in the mid-tier range ($100 to $180) drove its growth along with aggressive Indian Premier League cricket campaign,” Counterpoint analysts said.

India is the world’s fastest growing market for smartphones, where affordable pricing coupled with features like “selfie” cameras and big screens have popularized Chinese brands.

Video streaming services like Netflix Inc and Hotstar, as well as heavy usage of messaging apps like Facebook Inc’s WhatsApp have further spurred demand.

“Data consumption is on the rise and users are upgrading their phones faster as compared to other regions,” Counterpoint’s Tarun Pathak said.

“As a result of this, the premium specs are now diffusing faster into the mid-tier price brands. We estimate this trend to continue leading to a competitive mid-tier segment in coming quarters.”

Fox News has learned the texts, initially released in 2018 by a Senate committee, are under renewed scrutiny, with GOP Sen. Chuck Grassley and Homeland Security Committee chair Ron Johnson sending a letter Thursday night to Attorney General Bill Barr pushing for more information on the matter. President Trump, speaking on Fox News’ “Hannity” Thursday night, responded to this report by accusing Strzok and Page of an attempted “coup.” “They were trying to infiltrate the administration,” he said.

Kim accuses US of acting in ‘bad faith’
North Korean leader Kim Jong Un, fresh off his summit with  Russian President Vladimir Putin, said the U.S. has been acting in “bad faith” since his Hanoi meeting with President Trump over the stalemated issue of North Korean denuclearization. The North Korean leader told the Korean Central News Agency that, “the situation on the Korean Peninsula and the region is now at a standstill and has reached a critical point,” the Straits Times of Singapore reported. Kim warned that the situation “may return to its original state as the U.S. took a unilateral attitude in bad faith at the recent second DPRK-US summit talks,” the Korean Central News Agency added.

NFL Draft 2019: It’s all about defense
The first round of the 2019 NFL Draft saw a run on defensive players, with eight of the top 12 picks in Nashville coming from that side of the ball. After Oklahoma quarterback Kyler Murray was taken first overall by the Arizona Cardinals, the San Francisco 49ers started a run of four straight front-seven players by taking Ohio State defensive end Nick Bosa with the second overall pick — the highest draft slot for any Buckeye since left tackle Orlando Pace went No. 1 overall to the St. Louis Rams in 1997.

Joe Biden’s brain surgeon said his former patient is “totally in the clear” as speculation over the candidate’s health — with Biden possibly becoming the oldest president in U.S. history — is likely to become a campaign issue.

The former vice president, who had been perceived by many as the strongest potential contender for the Democratic Party’s 2020 presidential nomination, formally announced his candidacy Thursday.

But Biden’s age – 76 – is expected to become a source of attacks from a younger generation of Democrats not because of obvious generational differences, but possibly for actual health concerns if Biden gets into office.

WHY THE MEDIA ARE CONVINCED JOE BIDEN WILL IMPLODE

Biden himself agreed last year that “it’s totally legitimate” for people to ask questions about his health if he decides to run for president, given his medical history — which has included brain surgery in 1988.

“I think they’re gonna judge me on my vitality,” Biden told “CBS This Morning.” “Can I still run up the steps of Air Force Two? Am I still in good shape? Am I – do I have all my faculties? Am I energetic? I think it’s totally legitimate people ask those questions.”

But Dr. Neal Kassell, the neurosurgeon who operated on Biden for an aneurysm three decades ago, told the Washington Examiner that Biden appears to be “totally in the clear” — and even joked that the operation made Biden “better than how he was.”

“Joe Biden of all of the politicians in Washington is the only one that I’m certain has a brain, because I have seen it,” Kassell said. “That’s more than I can say about all the other candidates or the incumbents.”

BIDEN’S CLAIM HE DIDN’T WANT OBAMA TO ENDORSE TRIGGERS MOCKERY

At the same time, however, Biden hasn’t been forthcoming about his health at least since 2008 when he released his medical records as a vice presidential candidate. The disclosure that time revealed some fairly minor issues such as an irregular heartbeat in addition to detailing previous operations, including removing a benign polyp during a colonoscopy in 1996, the outlet reported.

It remains unclear if Biden had more aneurysms. Some medical experts say that people who have had an aneurysm can have another one.

An aneurysm, or a weakening of an artery wall, can lead to a rupture and internal bleeding, potentially placing a patient’s life in jeopardy.

Biden won’t be the only Democrat grappling with old age. Sen. Bernie Sanders, another 2020 frontrunner, is currently 77 years old and agreed with Biden last year that their ages will be an issue in the race.

“It’s part of a discussion, but it has to be part of an overall view of what somebody is and what somebody has accomplished,” Sanders told Politico.

“Look, you’ve got people who are 50 years of age who are not well, right? You’ve got people who are 90 years of age who are going to work every day, doing excellent work. And obviously, age is a factor. But it depends on the overall health and wellbeing of the individual.”

Sanders released his medical records in 2016, with a Senate physician saying in a letter that the senator was “in overall very good health.”

German carmaker Daimler endured a weak start to the year, echoing troubles at other major manufacturers, as sales in the big Chinese market stuttered.

The company said Friday that its net income fell to 2.1 billion euros ($2.3 billion) in the first quarter from 2.3 billion euros during the same period a year earlier, while revenue dipped to 39.7 billion euros from 39.8 billion euros.

Vehicle sales fell 4% to 773,800 units, with a double-digit percentage drop in China offsetting gains in other markets like the U.S. and Europe.

The company said there were also problems with high inventories and bottlenecks in the supply chain.

Chairman Dieter Zetsche said that “we cannot and will not be satisfied with this — as expected — moderate start to the year.”
