United Methodist Church on edge of breakup over LGBT stand

The United Methodist Church is teetering on the brink of breakup after more than half the delegates at a national conference voted to maintain bans on same-sex weddings and ordination of gay clergy.

The preliminary vote was held Monday. If the plan is formally approved on Tuesday, it could drive supporters of LGBT inclusion to leave America's second-largest Protestant denomination.

The United Methodist Church has 12.6 million members worldwide, including nearly 7 million in the U.S.

Father, daughter fined for stealing $12.5M lotto ticket: report

A Canadian father and daughter were each fined more than $2 million last week for their role in a lottery scam.

Jun-Chul Chung, 68, a convenience store worker in Burlington, Ontario, was convicted of stealing a Super 7 ticket, worth $12.5 million from a customer in 2003, according to reports. His daughter, Kathleen Chung, 36, who reportedly cashed the ticket for her father, was convicted of possessing stolen property and defrauding the Ontario Lottery and Gaming Corporation.

Justice Douglas Gray, who handed the Chungs their fines of $2.3 million each said last week: “I see no reason why they should not be equally responsible for the outstanding amount.”

Jun-Chul Chung was sentenced to seven years in prison last September while Kathleen Chung was sentenced to a four-year jail term. If they do not pay their fines, they’ll spend another six years in prison, Gray said.

The Chungs are out on bail, pending their appeal, the report said. They will have a seven-year period, beginning when they are paroled, to pay back the fine, according to the report.

SAN FRANCISCO (Reuters) – A trial in which a California man alleged his use of Bayer AG’s glyphosate-based Roundup weed killer caused his cancer went to a federal U.S. jury after lawyers for both sides delivered their closing arguments on Tuesday.

The closely-watched case brought by plaintiff Edward Hardeman is only the second of some 11,200 Roundup lawsuits to go to trial in the United States. Another California man was awarded $289 million in August after a state court jury in August found Roundup caused his cancer, sending Bayer shares plunging.

Hardeman’s case has proceeded differently from the earlier trial, with an initial phase exclusively focused on scientific facts while omitting evidence of alleged corporate misconduct by company representatives.

Following the first phase, the six jurors in San Francisco federal court were asked by U.S. District Court Judge Vince Chhabria to decide whether Roundup was a “substantial factor” in causing Hardeman’s cancer.

If the jury finds Roundup to have caused Hardeman’s cancer, the trial will proceed into a second stage, where his lawyers can present evidence allegedly showing the company’s efforts to influence scientists, regulators and the public about the safety of its products.

Hardeman’s lawyer, Aimee Wagstaff, during her closing arguments on Tuesday said Hardeman had “extreme” exposure to Roundup, spraying the chemical more than 300 times over 26 years.

“The dose makes the poison. The more you use, the higher the risk,” Wagstaff said. She urged jurors to consider all studies, including of rodents and cells, which she said showed an elevated cancer risk.

Bayer, which acquired Monsanto for $63 billion, denies allegations that Roundup, or glyphosate, cause cancer. It says decades of studies and regulatory evaluations, primarily of real-world human exposure data, have shown the weed killer to be safe for human use regardless of exposure levels.

Wagstaff criticized the epidemiological studies as flawed.

Brian Stekloff, a lawyer for Bayer, in his closing statement said the cause of Hardeman’s cancer, and non-Hodgkin’s lymphoma generally, was not known.

“No one can tell you the cause,” Stekloff said, adding that Hardeman had some risk factors, such as old age and a history of hepatitis.

Chhabria decided in January to split Hardeman’s case into two phases. He called evidence of alleged corporate misconduct “a distraction” from the scientific question of whether glyphosate causes cancer.

Hardeman’s trial is a test case for some 760 cases nationwide consolidated before Chhabria in federal court.

Evidence of corporate misconduct was seen as playing a key role in the earlier state court case. The verdict in that case was later reduced to $78 million and is on appeal.

Plaintiff lawyers called Chhabria’s decision to exclude similar evidence from the first phase of Hardeman’s case “unfair,” saying their scientific evidence was inextricably linked to Monsanto’s alleged attempts to manipulate, misrepresent and intimidate scientists.

LONDON (Reuters) – British Prime Minister Theresa May will request a short delay to Brexit in a letter to the European Union on Wednesday, Sky cited an unidentified senior government source as saying.

The delay, nearly three years since the United Kingdom voted to leave the European Union, leaves the Brexit divorce uncertain with options including leaving with May’s deal, a longer delay, a disruptive exit, or even another referendum.

Just 9 days before the March 29 exit date that May set two years ago by serving the formal Article 50 divorce papers, May is due to write to European Council President Donald Tusk to ask for a delay.

But the ultimate length of the delay was unclear amid the political chaos in London. May had warned that if parliament did not ratify her deal, she would ask to delay beyond June 30, a step that Brexit’s advocates fear would endanger the entire divorce.

Why Pelosi is dissing impeachment despite her party's anti-Trump fervor

Nancy Pelosi is trying to shut down any talk of impeachment.

And since she happens to be speaker of the House, that means it won't happen for the foreseeable future, if ever.

There’s a reason that President Trump's only nickname for Pelosi is "Nancy." She's a shrewd politician, and she understands that an incendiary and ill-fated impeachment drive would mainly hurt the Democrats.

For the Dems to go down the impeachment road would utterly energize the Trump base and allow the president to accuse his partisan opponents of trying to overturn the election of 2016.

Impeachment proceedings would utterly dominate the next year, essentially wiping out the Democrats' attempt to define an agenda or to actually pass legislation that would help the country. They would be defined as the anti-Trump party, given power in the House only to launch a crusade against the incumbent.

In the end, it would be virtually impossible for the Republican-controlled Senate to reach the two-thirds vote needed to evict Trump from the White House. And that denouement would come just as the primaries were getting under way, giving Pelosi's party a chance to beat Trump through the usual electoral process.

The California congresswoman's words, in a Washington Post Magazine interview, immediately changed the nature of the debate:

"I'm not for impeachment," she said. "This is news. I'm going to give you some news right now because I haven't said this to any press person before. But since you asked, and I've been thinking about this: Impeachment is so divisive to the country that unless there's something so compelling and overwhelming and bipartisan, I don't think we should go down that path, because it divides the country. And he's just not worth it."

Pelosi is obviously right that impeachment is incredibly divisive. And she may be recalling that the Democrats picked up five seats after House Republicans impeached Bill Clinton in 1998 on a party-line vote. The only other modern impeachment effort — which drove Richard Nixon from office in 1974 — succeeded because several Republicans joined the Democrats when the Judiciary Committee voted on the Watergate-related articles. (Both efforts came during their second terms, when there was no other way to remove them.)

Pelosi's dilemma is that some of her own caucus, especially the younger liberal members, as well as left-wing pundits are hot to trot on impeachment. Many Democratic voters also strongly favor the move. Even before Bob Mueller delivers his findings, she's trying to find a way to defuse the movement without alienating a significant chunk of the party.

So she subtly disses the president — "he's just not worth it" — while dismissing impeachment.

At another point in the Post Magazine interview, Pelosi calls Trump "ethically unfit. Intellectually unfit. Curiosity-wise unfit. No, I don't think he's fit to be president of the United States. And that’s up to us to make the contrast to show that this president — while he may be appealing to you on your insecurity and therefore your xenophobia, whether it's globalization or immigrants — is fighting clean air for your children to breathe, clean water for them to drink, food safety, every good thing that we should be doing that people can't do for themselves."

A nod to one side, a nod to the other side. He's unfit for office, but impeachment isn't worth it. He's bad on immigration and the environment, but we have to make that case outside of the Constitution's last-resort remedy.

The question for Trump's critics, who despise his policies, his persona and his associates, some of whom have been convicted, the question remains: What exactly has Trump done that would qualify as high crimes and misdemeanors?

Adam Schiff, the House Intel chairman and cable-TV fixture, told reporters that Pelosi is "absolutely right." But House Budget Chairman John Yarmuth told CNN, "To me it's not a question of 'whether,' it's a question of 'when,' and probably right now is not the right time, but I think at some point it's going to be inevitable."

The calculation could change once Mueller delivers his findings. But without evidence of Russian collusion that still hasn't emerged, Pelosi knows that her party's best bet for defeating Trump is in November of 2020.

Boeing 737 MAX software fix: easy to upload, harder to approve

SEATTLE/WASHINGTON/MONTREAL (Reuters) – Boeing engineers armed with laptops and thumb drives will be able to upload a crucial software fix for the 737 MAX anti-stall system in about an hour. That’s the easy part.

Before Boeing’s workhorse of the future can resume flying, the upgrade must first be approved by the U.S. Federal Aviation Administration (FAA) and then by wary regulators around the globe who have grounded it in the wake of two deadly crashes.

Regulators in China, Europe and Canada have signaled they will not rubber stamp an FAA decision to allow the planes back into the air but conduct their own reviews.

With the FAA under pressure for its role in certifying the newest 737, and other regulators challenging its leadership of the airline safety system, Boeing’s money-spinning jet could remain parked for months.

“We are guessing this thing’s not going to be put to bed until the July or August time frame,” said Charlie Smith, chief investment officer at Fort Smith Capital Group, which holds shares in Boeing.

The world’s largest planemaker has been working on the upgrade for its MCAS stall-prevention system since October’s Lion Air crash, when pilots are believed to have lost a tug of war with software that repeatedly pushed the nose down.

Acting FAA Administrator Dan Elwell told the U.S. Senate Tuesday in written testimony that the agency will agree to allow the 737 MAX to return to service “only when the FAA’s analysis of the facts and technical data indicate that it is appropriate.”

Boeing formally submitted a proposed MCAS software enhancement to the FAA for certification on Jan. 21, Elwell’s testimony said.

Prior to certification, the FAA was “directly involved” in the review of the MCAS system but “time yields more data to be applied for continued analysis and improvement.”

Boeing’s flagship new single-aisle jet was grounded globally after a second crash in Ethiopia this month prompted concerns over possible similarities.

As a first step toward resuming flights and unfreezing deliveries, Boeing plans to provide more than 200 airlines and regulators with details on software and training on Wednesday.

Once the new software is approved, adding it will only take an hour per plane, according to an FAA official. But the overall task could stretch on far longer.

The FAA and Boeing will have to redo some analyses – including a formal functional hazard assessment – because they are making changes to a system that was already certified.

After the installation, there will be ground testing and flight tests, though how long these take could vary widely.

“Clearly there is pressure to get the airplanes ungrounded but there is tremendous pressure to make sure it was done right,” the FAA official said.

“The last thing in the world you want is to have the thing hurried and then find problems with it.”

Boeing and the FAA declined to comment.

FAA CHALLENGED

For decades, nations large and small followed the FAA’s lead, but this month many ignored its initial declaration after the second crash that there was “no basis to order grounding the aircraft.”

The agency stood alone among top regulators. First China, then Singapore, Britain and Canada banned flights, before U.S. President Donald Trump announced the MAX would be grounded.

Now, the FAA and Boeing must run the gauntlet of increased overseas scrutiny as they try to unground the jet – with China once again in a position to undo the regulatory pecking order.

Toughening its public stance, China said on Tuesday it had stopped accepting applications to certify individual MAX jets.

Canada, Europe and Turkey have all suggested they will take whatever time is needed to check the software even after the FAA approves it – a move that would normally set a global lead.

The shift in regulatory power poses a challenge to Boeing’s efforts to quickly resolve the crisis, experts said.

Increased precautions by global regulators could also have a broad impact on an aviation system that relies on “reciprocity” between the United States, Canada and Europe in recognizing each other’s expertise in certifying a plane.

Having a regulator such as the FAA do the heavy lifting to certify a plane reduces costs and time, since agencies abroad can validate the results and not have to duplicate them.

That global system of trust, which helps limit costs and keep flying safe, could be at risk from any perception that the United States failed to act, said Teal Group analyst Richard Aboulafia.

“It just makes the system, innovation and the development of new products all the more expensive.”

Mike Daniel, a former FAA accident investigator, said the crash revealed weaknesses in Boeing’s relations with regulators and airlines abroad.

777X CERTIFICATION CONCERN

The FAA’s acting head will tell a Senate panel on Wednesday the agency’s oversight approach must “evolve” too.

But in Canada, Transport Minister Marc Garneau told Reuters Ottawa had already gone further than the FAA following the first crash in October and was ready to move the bar higher again.

“So we don’t always do things exactly the same. It has to pass the sort of safety threshold from our point of view.  And there’s nothing wrong with that,” he said.

Meanwhile, the fallout may spread beyond the 737 family.

Certification could be delayed for the larger Boeing 777X, for which Lufthansa is a launch customer, as European regulators give it more a stringent review, the German airline’s CEO said.

“Overall, foreign authorities will be more thorough in accepting American certifications. I think that for me is one of the outputs of these terrible events in Indonesia and Ethiopia already,” Chief Executive Carsten Spohr told reporters.

Massachusetts judge accused of helping illegal immigrant evade ICE pleads not guilty

The Massachusetts judge accused of helping an illegal immigrant evade an Immigration and Customs Enforcement officer has pleaded not guilty to all counts.

Newton District Court Judge Shelley M. Richmond Joseph, 51, appeared in U.S. District Court in Boston on Thursday, where she was arraigned on obstruction of justice stemming from an incident that allegedly took place on April 2, 2018.

Prosecutors claimed in court documents earlier Thursday that Joseph, along with 56-year-old court officer Wesley MacGregor, helped Jose Medina-Perez, a twice-deported illegal immigrant with a fugitive warrant for drunk driving in Pennsylvania, sneak out a back door after he appeared in court to be arraigned on drug charges, according to MassLive.com.

Authorities alleged that Joseph asked an immigration agent who was in the courtroom to leave, and said Medina-Perez would be released into the courthouse lobby. But after the hearing, MacGregor led him downstairs to the lockup and out a back door, U.S. Attorney for the District of Massachusetts Andrew Lelling said.

Medina-Perez, who had been barred from entering the U.S. until 2027, was caught by immigration officials about a month after the hearing, Lelling said, and is now in immigration proceedings.

Both Joseph and MacGregor were charged with obstruction of justice, aiding and abetting; obstruction of a federal proceeding, aiding and abetting and conspiracy to obstruct justice. MacGregor was also charged with perjury before a federal grand jury.

MacGregor also pleaded not guilty to all counts in court on Thursday.

Massachusetts Attorney General Maura Healey said in a statement that the indictment "is a radical and politically-motivated attack on our state and the independence of our courts."

"It is a bedrock principle of our constitutional system that federal prosecutors should not recklessly interfere with the operation of state courts and their administration of justice," she continued. "This matter could have been appropriately handled by the Commission on Judicial Conduct and the Trial Court. I am deeply disappointed by U.S. Attorney Andrew Lelling’s misuse of prosecutorial resources and the chilling effect his actions will have.”

Lelling said the charges were not meant to send a message about immigration policy. He said he's "heard the occasional gasp of dismay or outrage at the notion of holding a judge accountable for violating federal law ... but if the law is not applied equally it cannot credibly be applied to anyone."

Both Joseph, who has been suspended without pay, and MacGregor were released after the hearing on Thursday. No date has been set for their next court appearance.

BERLIN (Reuters) – Wulf Matthias will not stand for a second term as Wirecard’s chairman in 2020, German daily Handelsblatt said on Friday, citing sources in the financial industry.

For age reasons alone this would not be an option for Matthias, aged 75, Handelsblatt added.

Matthias will keep his mandate until it ends in 2020, the paper quoted a company spokeswoman as saying.

Wirecard was not immediately available for comment when contacted by Reuters.

ZURICH (Reuters) – Shareholders approved Credit Suisse’s 2018 compensation report with an 82 percent majority on Friday, overriding frustrations expressed at its annual general meeting over jumps in executive pay during a year its share price plummeted.

Three shareholder advisers had recommended investors vote against Switzerland’s second-biggest bank’s remuneration report, while a fourth backed the report but expressed reservations about whether management pay matched performance.

The approval marked a slight increase over the 80.8 percent support garnered for the bank’s 2017 compensation report.

LONDON (Reuters) – Activist investor Edward Bramson is likely to fail in his attempt to get a board seat at Barclays’ annual meeting next week, even though shareholders are dissatisfied with performance of the group’s investment bank.

New York-based Bramson’s Sherborne Investors and the board of the British bank have been sparring for months over Barclays’ strategy.

Bramson wants to scale back Barclays’ investment bank to reduce risk and boost shareholder returns. Barclays Chief Executive Jes Staley remains staunchly committed to growing the business out of trouble.

After failing to persuade Staley to change course since he began building a 5.5 percent stake in the bank in March last year, Bramson hopes a board seat will rachet up the pressure.

Both sides have written to shareholders pitching their case and Bramson has courted investors in one-on-one meetings, although none have publicly backed him yet.

Interviews by Reuters with five institutional investors in Barclays suggest Bramson has failed to persuade them.

Sherborne declined to comment.

Mirza Baig, head of investment stewardship at top-40 shareholder Aviva Investors, said Bramson was welcome on the bank’s register but the boardroom was a step too far.

“He has created a lot of value at other businesses, but, generally, when he has come in as executive chair and taken full control. This would be a different case where he would just be one lone voice on the board,” he said.

A second Barclays shareholder said he backed Bramson’s goal of improving returns but via an “evolutionary” approach.

“If you look at banks that have tried to restructure their operations in investment banking – you look at Natwest Markets, Deutsche Bank – I struggle to think of an example where a roughshod restructuring has been accretive to shareholder value.”

A third, top-30 investor said he had been impressed by incoming Chairman Nigel Higgins’ grasp of the challenge in hand, and felt investors would give him time.

“Management know they have to execute and deliver improved returns… [Higgins] will continue to re-shape the board but obviously he didn’t feel that having someone with a diametrically opposed view on it would be helpful.”

A fourth, top-30 investor agreed: “We voted for the chairman to come in and it would be crazy to allow an activist to join the board (at this time).”

Jupiter Fund Management, the 24th largest investor, said it also planned to vote against Bramson.

Barclays has nearly 500 institutional shareholders, Refinitiv data showed.

Since Staley joined Barclays in 2015, the investment bank returns relative to capital invested have increased but are still underperforming the overall business.

Barclays’ first-quarter figures showed the investment bank posted a 6 percent drop in income from its markets business and a 17 percent fall in banking advisory fees.

Returns in the investment bank fell to 9.5 percent from 13.2 percent a year ago.

Famed for successful campaigns against smaller British companies in sectors from chemicals to advertising, Bramson’s board seat pitch has been rebuffed by shareholder advisory firms.

Institutional Shareholder Services, the world’s biggest, said Bramson’s proposal “falls short of what can reasonably be expected from a shareholder trying to address issues at a 28 billion pounds, systemically important bank”.

Glass Lewis also flagged concern about Bramson’s lack of banking experience and “questionable” shareholding structure, referring to Sherborne’s use of derivative contracts to hedge losses should its strategy fail.

Critics said the arrangement meant his interests are not truly aligned with those of other long-term shareholders.

British advisory firm Pirc, however, said it recommended that investors abstain in the vote on Bramson’s proposal as a challenge to the board to do better in the year ahead – or face a similar contest in 2020.

(Reuters) – U.S. oil and natural gas producer Chevron Corp reported a 27 percent fall in quarterly earnings on Friday, hit by lower crude prices and weaker margins in its refining and chemicals businesses.

Net income attributable to the company fell to $2.65 billion, or $1.39 per share, for the first quarter ended March 31, from $3.64 billion, or $1.90 per share, a year earlier.

Earlier in the day, larger rival Exxon Mobil Corp reported earnings well below analysts’ estimates, as margins in its refining business were hurt by higher Canadian prices and heavy scheduled maintenance.
