Afghan Supreme Court allows Ghani term to cover delay to election

KABUL (Reuters) – Afghanistan’s Supreme Court has ruled that President Ashraf Ghani can stay in office until a much-delayed presidential election, which is due to be held after his mandate expires next month, officials said.

The election, originally scheduled for April this year, has been postponed twice to allow more time to organize the poll, first to July and then to Sept. 28, well after the official end of Ghani’s five-year term on May 22.

Amid growing division in Kabul, opposition politicians demanded he step down as soon as his mandate ends and give way to an interim government to oversee peace talks with the Taliban. Ghani, seeking a second term, has ruled that out.

Government officials, speaking on condition of anonymity, confirmed the court decision, but the way the news was announced underscores the confusion in Afghan politics as Ghani’s term nears its end.

Television station Ariana TV first carried the news on Sunday, citing a court document ruling that the constitution allowed the president to remain in office until the election.

However, with political rivals attacking the move and accusing the government of imposing the ruling, the court refused to confirm the decision, saying it was for the government to announce.

The presidential palace press office said only the court could announce its own decision.

In a short video statement it said that the government remaining in office for another six months was in line with what happened before elections in 2009 and 2014.

Atta Mohammad Noor, leader of the Jamiat-e Islami party and a former provincial governor who remains one of the most powerful figures in Afghan politics, said the decision was “unlawful” and undermined the authority of the Supreme Court.

“(Ghani’s) tenure ends in May and that’s it,” a message on Atta Noor’s Twitter account said. He called on presidential candidates, lawyers and legislators to “elaborate on this” but did not say whether he would mount a legal challenge.

The confusion came just days after a planned meeting between Taliban representatives and a 250-strong group of Afghan officials and civil society figures was canceled amid recriminations over the size and status of the delegation.

Ghani took office in 2014 at the head of a unity government including his rival, Abdullah Abdullah, after a bitterly disputed election that was tainted by significant voter fraud and which left no clear winner.

Graham calls McCabe comments 'beyond stunning' as he threatens to subpoena former FBI chief

Sen. Lindsey Graham, R-S.C., vowed Sunday to investigate alleged discussions at the Department of Justice about invoking the 25th Amendment as a way to oust President Trump from office and threatened to subpoena former FBI Deputy Director Andrew McCabe if he refused to testify on the matter before the Senate.

"We're going to find out what happened here and the only way I know to find out is to call the people in under oath and find out, through questioning, who's telling the truth because the underlying accusation is beyond stunning," Graham, the chairman of the Senate Judiciary Committee, said on CBS’ "Face the Nation."

Graham added that he also plans to subpoena both McCabe and Deputy Attorney General Rod Rosenstein if they won’t voluntarily agree to testify before the committee.

"There is no organization beyond scrutiny," Graham said. "There is no organization that can't withstand scrutiny. And the FBI will come out stronger."

He said: "But we've got to get to the bottom of it. What are people to think after they watch "60 Minutes" when they hear this accusation by the acting deputy — acting FBI director that the deputy attorney general encouraged him to try to find ways to count votes to replace the president? That can't go unaddressed."

Graham’s comments come on the heels of a Fox News story that reported that former FBI lawyer James Baker, in closed-door testimony to Congress, detailed alleged discussions among senior officials at the Justice Department about invoking the 25th Amendment.

The testimony was delivered last fall to the House Oversight and Judiciary Committees. Fox News has confirmed portions of the transcript. It provides additional insight into discussions that have returned to the spotlight in Washington as fired FBI Deputy Director Andrew McCabe revisits the matter during interviews promoting his forthcoming book.

Baker did not identify the two Cabinet officials. But in his testimony, the lawyer said McCabe and FBI lawyer Lisa Page came to him to relay their conversations with Rosenstein, including discussions of the 25th Amendment.

“I was being told by some combination of Andy McCabe and Lisa Page, that, in a conversation with the deputy attorney general, he had stated that he -- this was what was related to me -- that he had at least two members of the president’s Cabinet who were ready to support, I guess you would call it, an action under the 25th Amendment,” Baker told the committees.

CBS News reported on McCabe’s comments after he told “60 Minutes” that Justice Department officials discussed the possibility of removing Trump via the 25th Amendment and that Deputy Attorney General Rosenstein had offered to wear a wire around the president.

The 25th Amendment provides a mechanism for removing a sitting president from office. One way that could happen is if a majority of the president’s Cabinet says the president is incapable of discharging his duties.

Since giving the interview to “60 Minutes,” McCabe has since made an about-face, with a spokesperson for the former FBI chief releasing a statement that says McCabe did not "participate in any extended discussions about the use of the 25th Amendment, nor is he aware of any such discussions."

The Justice Department issued a statement calling McCabe’s comments “inaccurate and factually incorrect."

Reports of the discussions of invoking the 25th Amendment and of Rosenstein wearing a wire were reported in The New York Times.

House votes to condemn Trump's transgender military ban

The House delivered a rebuke to President Donald Trump on Thursday by voting to condemn his administration's move to restrict transgender men and women from military service.

A non-binding resolution opposing Trump's transgender ban passed 238-185. Every Democrat supported the resolution, while nearly every Republican voted against it. Five Republicans broke ranks and voted in favor: Brian Fitzpatrick of Pennsylvania, Trey Hollingsworth of Indiana, Will Hurd of Texas, John Katko of New York and Tom Reed of New York.

The Trump administration's policy bars people who have undergone gender transition from enlisting. It also requires military personnel to serve as their biological gender unless they began a gender transition under less restrictive Obama administration rules. The policy is being challenged in court.

Rep. Joe Kennedy, D-Mass., the resolution's sponsor, said Trump's policy amounts to "targeted discrimination." He said the House was voting to tell transgender people "that they cannot be banned from military service because of who they are."

The top Republican on the House Armed Services Committee, Rep. Mac Thornberry of Texas, opposed the resolution and said the vote attempted to politicize U.S. service members. Thornberry said because the resolution does not change law or policy it was a "messaging bill" that detracted from "serious issues that need to be discussed."

Ahead of the vote many Democratic lawmakers placed transgender pride flags outside their offices on Capitol Hill, including House Speaker Nancy Pelosi, who spoke from the floor in support of the resolution.

"There is no moral justification for this ban which violates every value of our American democracy," Pelosi said Thursday.

Under the Obama administration, the Pentagon announced that transgender people already serving in the military would be allowed to serve openly. Trump reversed that policy beginning in 2017 with a tweet that the government would not allow "Transgender individuals to serve in any capacity in the U.S. Military."

The Pentagon has said that over 900 men and women have been diagnosed with "gender dysphoria," a discomfort with their birth gender. A 2016 survey estimated that about 1 percent of active duty service members, around 9,000 men and women, identify as transgender.

Speaking from the House floor ahead of the vote, Armed Services Chair Adam Smith, D-Wash., said the Trump administration policy is "primarily based on ignorance and bias against the transgender community."

"We have the best military in the world," Smith said. "We need highly qualified people to serve and to single out a particular group — to discriminate against them and to say they cannot serve — is bad for national security."

WASHINGTON (Reuters) – U.S. President Donald Trump said on Tuesday that NATO members’ cost-sharing burden was much improved, but he would like to see other countries spend more on defense.

At a White House meeting with NATO Secretary-General Jens Stoltenberg, Trump also said he would like to see members of the North Atlantic Treaty Organization pay more than 2 percent of gross domestic product for defense. The U.S. president told NATO leaders last year to increase defense spending to 4 percent of GDP.

Boeing to mandate safety alert in 737 MAX software upgrade: sources

WASHINGTON (Reuters) – Boeing Co will mandate a previously optional cockpit warning light as part of a forthcoming software update to the 737 MAX fleet that was grounded in the wake of two fatal crashes, two officials briefed on the matter said Thursday.

Boeing previously offered the AOA DISAGREE alert, which warns pilots when the “angle of attack” (AOA) readings do not match, but it was not required by regulators. Boeing will now retrofit older planes with the light that did not initially receive it, the officials said. Boeing did not immediately comment Thursday.

There has been a long-running industry debate about how much information should be displayed in the cockpit, notably about the angle at which the wing is slicing through the air.

Federal prosecutors, the Transportation Department’s inspector general and U.S. lawmakers are investigating the Federal Aviation Administration’s certification of the 737 MAX.

The FAA declined to comment on the software upgrade Thursday but said last week it planned to mandate “design changes” coming from Boeing in its software upgrade by April for the 737 MAX.

Indonesia’s Lion Air did not install the warning light. Lion Air Fight 610 crashed in October minutes after takeoff, killing all 189 onboard. The company told Reuters in November it did not install it because it was not required.

The angle is a key flight parameter that must remain narrow enough to preserve lift and avoid an aerodynamic stall. A faulty AOA reading led the doomed Lion Air jet’s computer to believe it was stalled, prompting the plane’s anti-stall system, called the Maneuvering Characteristics Augmentation System (MCAS), to repeatedly push down the plane’s nose.

The planemaker has come under fire in the wake of the Lion Air crash for not outlining the automated system, MCAS, in the flight manual for the 737 MAX.

Senior White House adviser Jared Kushner said Tuesday that a detailed plan for a merit-based immigration system will be presented to President Trump, giving priority to skilled immigrants rather than those with family ties to the U.S.

“I do believe that the president’s position on immigration has been maybe defined by his opponents by what he’s against as opposed to what he’s for,” Kushner said at the Time 100 Summit in New York City. “What I’ve done is I’ve tried to put together a very detailed proposal for him.”

Kushner denied in the same talk that he has clashed with White House staffer Stephen Miller, who’s seen as tougher on immigration than others, adding that the plan was concocted with the help of Miller and Kevin Hassett, chairman of the Council of Economic Advisers.

Brazilian President Jair Bolsonaro on Thursday said his government must make men aware of the dangers of poor hygiene after expressing dismay over the 1,000 penis amputations that apparently occur in his country each year.

“In Brazil, we have 1,000 penis amputations a year due to a lack of water and soap,” he said while speaking to reporters in Brasilia after visiting the Education Ministry. “We have to find a way to get out of the bottom of this hole.”

The far-right leader called the figure “ridiculous and sad,” Reuters reported. A spokeswoman for the Brazilian urology society told the news agency the number is based on its official data for penis amputations.

The amputations were conducted out of necessity over untreated infections, along with complications from HIV and various cancers, she said.

A top Russian diplomat says Russia is willing to negotiate a new nuclear weapons treaty with the United States and China.

Deputy Foreign Minister Sergei Ryabkov told reporters on Friday Moscow is closely following reports in the United States that the U.S. would like to reach a nuclear weapons deal with both Russia and China, and is “willing” to negotiate. The story was reported by CNN earlier Friday.

Ryabkov also said that Russia “would like to convince” the U.S. to adopt a joint statement that would condemn any use of nuclear weapons.

Ryabkov’s comments come just months after the U.S. withdrew from the Intermediate-Range Nuclear Forces Treaty, a cornerstone of the post-Cold War security, and Russia followed suit. Each claims breaches by the other.

Government dysfunction and an intelligence failure that preceded the Easter Sunday bombings in Sri Lanka are traced to simmering divisions between the president and prime minister after a weekslong political crisis that crippled the country last year.

The government has admitted to a “lapse of intelligence” after officials failed to act upon near-specific information received from foreign agencies. Suicide bombers exploded themselves last Sunday in three churches and three luxury hotels, killing 253 people and wounding 400 more. Authorities said eight Muslim militants blew themselves up at their targets while the wife of one of the attackers blasted herself on being rounded up by police.

The carnage has brought forth arguments that worshippers and holidaymakers fell victim to the rivalry and a lack of communication between the country’s two leaders — President Maithripala Sirisena and Prime Minister Ranil Wickremesinghe.

The Cabinet led by Wickremesinghe says neither he nor his ministers were informed of the intelligence received by the defense authorities. Sirisena is the head of state, defense minister, minister in charge of the police and head of the armed forces. He also chairs the National Security Council, which includes the heads of security agencies and departments. Traditionally the prime minister also plays an important role on the council.

According to Health Minister Rajitha Senaratne, Sirisena has not included Wickremesinghe in national security affairs since a dispute between them came into the open in October last year. This is an unusual departure from the protocol, he said.

Senaratne said that Sirisena was overseas when the attacks took place and even after that, the National Security Council refused to meet with Wickremesinghe as he tried to give them instructions.

Sirisena has also said that he was not informed of the intelligence received and vowed to overhaul the leadership of the defense forces.

The top bureaucrat at the Defense Ministry, Hemasiri Fernando, has resigned at Sirisena’s insistence.

“It is a major factor,” said Jehan Perera, the head of local activist group National Peace Council, referring to the alleged lack of coordination between the leaders contributing to the failure to prevent the attacks.

“The primary responsibility has to be taken by the president, he did not give the information and he did not act,” Perera said. “He had the Ministry of Defense, took the police from the prime minister, chaired the National Security Council meetings and did nothing,” Perera said.

Kusal Perera, a journalist and political commentator, says security and intelligence officials should have acted on the information whether or not they received orders from politicians.

“If they (Wickremesinghe and his party) were not invited to the National Security Council, why did not they say in Parliament that they were not responsible for the security of the country any longer,” said Perera, who is not related to Jehan Perera.

“Saying that now is taking political advantage, not taking responsibility,” he said.

Sirisena and Wickremesinghe belong to different political parties but came together for Sirisena’s presidential campaign in 2015. Their relationships broke down and their differences exploded last year when Sirisena suddenly sacked Wickremesinghe as prime minister and appointed in his place former strongman Mahinda Rajapaksa, whom he defeated in the presidential election. The crisis crippled the country for more than seven weeks to the point of not being able to pass this year’s national budget on time.

A court decision compelled Sirisena to reappoint Wickremesinghe, but the two leaders have been rivals within the same government.

Rajapaksa, who is the minority leader in Parliament, blames the government for weakening intelligence and dropping its guard, which he had maintained to defeat the separatist Tamil Tiger rebels 10 years ago to end the 26-year-old civil war. He also criticized the government for the detention of intelligence officers accused of extrajudicial killings and abductions during the closing days of the war, which he said crippled the security apparatus before the bombings. According to conservative U.N estimates, some 100,000 people were killed in Sri Lanka’s conflict.

Sirisena summoned an all-party conference Thursday to which Wickremesinghe was also invited. At the conference, Sirisena stressed “setting aside all the political beliefs and difference (so that) everybody should collectively commit towards building a peaceful environment within the country,” a statement from his office said.

“It is not a secret that the disagreements between me and the government aggravated over the past two years,” Sirisena told the country’s media executives Friday. “One of the reasons for that is weakening of military intelligence and arresting military officials unnecessarily and my speaking up against it within and outside the government.”

Jehan Perera said that the security threat could prove politically advantageous to Rajapaksa and his family, with a presidential election scheduled at the end of this year. Gotabhaya Rajapaksa, a younger brother of Mahinda, was the powerful defense secretary during his brother’s reign and has expressed his interest to join the contest.

“People are saying we want a stronger leader and they are talking about Gotabhaya. It (the blasts) has worked to their benefit,” Perera said.

Cyprus police are intensifying a search for the remains of more victims at locations where an army officer, who authorities say admitted to killing five women and two girls, allegedly had dumped their bodies.

Police said Friday’s search will concentrate on a military firing range, a reservoir and a man-made lake near an abandoned mine approximately 32 kilometers (20 miles) west of the capital Nicosia.

On Thursday, the 35-year-old suspect told investigators that he had killed four more people than he had previously admitted to. All the suspect’s alleged victims are foreign nationals.

Police have already found the bodies of a 38-year-old Filipino woman and two as yet unidentified women.

Search crews are now looking for the daughter of the 38-year-old, a Romanian mother and daughter and another Filipino woman.
