Congressional Republicans rattled by Trump's pivot to ObamaCare fight after Mueller summary

GOP lawmakers fear that President Trump has trampled all over what may have been the best week of his presidency by backing the complete overturn of ObamaCare.

On Monday, the Justice Department asked the U.S. Court of Appeals for the Fifth Circuit in New Orleans to affirm last year's ruling by a Texas federal judge stating that the Affordable Care Act was no longer constitutional because the 2017 tax reform legislation eliminated the health care law’s penalty for not having health insurance.

Multiple congressional Republicans tell Fox News they are bothered by the timing of the Trump administration's intervention in the matter, which comes on the heels of a favorable outcome in the investigation by Special Counsel Robert Mueller, the House sustaining the president's veto of a bill to halt the national emergency for the border wall and a Senate vote that shined a spotlight on problems with the Green New Deal, championed by Rep. Alexandria Ocasio-Cortez, D-N.Y.

"He didn't have to do it now," said House Republican Conference Chair Liz Cheney, R-Wyo., the third-ranking Republican in that chamber.

"We felt vindicated," added one senior House Republican about the end of the Mueller investigation. "We could have ridden this for a few weeks."

"In the South, they put it another way," one senior Democratic lawmaker told Fox News, adding that the president "stepped on his own appendage."

“I’m not going to say the president made a mistake because he said all along he was going to repeal ObamaCare,” said Rep. Bill Johnson, R-Ohio, who represents a sprawling, rural district beset with staggering health care issues and opioid abuse. However, Johnson noted that a bid to repeal and replace ObamaCare failed in 2017, with Republicans in control of both houses of Congress and the White House after years of promising to undo the Affordable Care Act.

“There is merit in the thinking that we missed a golden opportunity,” he said.

Fox News has confirmed that House Minority Leader Kevin McCarthy, R-Calif., spoke to Trump on the phone Wednesday, though McCarthy's office would not characterize the contents of the call. Axios reported earlier Wednesday that McCarthy told the president that the attempt to get the ACA overturned "made no sense."

“ObamaCare is a failure,” McCarthy told Fox News. "The real fear I have is the Democrats’ plan of Medicare for All."

Sources tell Fox News that Republicans are worried they would be blamed if the law is ruled unconstitutional, a decision that would create an immediate vacuum in the American health care system and toss millions of people off health care plans because of pre-existing conditions.

"It will destroy the infrastructure of health care in this country,” said Rep. Donna Shalala, D-Fla., who served for eight years as President Clinton’s Health and Human Services Secretary. "It would be a disaster for 100,000 people in my district."

"Congress isn't going to let 40 million people go without health care," vowed Rep. Mike Johnson, R-La., the chair of the Republican Study Committee, which is trying to prep legislation that would fill the void in the event the law is overturned.

Cheney described a possible end of ObamaCare as “a situation of desperation on behalf of the Democrats.”

“ObamaCare is unconstitutional,” she said. “We are seeing Democrats push this lie that Republicans don’t want to cover people with pre-existing conditions.”

Man accused of tossing boy from Mall of America balcony faces judge

The Minnesota man accused of throwing a 5-year-old boy off a third-floor balcony at the Mall of America was ordered held on $2 million bail following an initial court appearance Tuesday.

Emmanuel Aranda, 24, said little during the hearing in a courtroom at the Hennepin County jail. He gave his name and address when prompted by Judge Jeannice Reding and answered "not at all" when the judge asked if he had any questions.

The Minneapolis Star-Tribune reported that the address given to the judge by Aranda matched the site of a Minneapolis shelter.

Aranda is charged with first-degree attempted premeditated murder in the incident, which took place on Friday morning. The boy, identified only as Landen, remains in critical condition at a local hospital. A GoFundMe to help cover the family's medical costs had raised more than $700,000 as of Tuesday afternoon.

"The family appreciates the outpouring of support from across the country, reassuring them of the overall goodness of humanity and of God’s will," attorney Stephen Tillitt told reporters in a prepared statement outside the jail.

Prosecutors say Aranda told police officers that he had gone to the mall the prior day "looking for someone to kill," but it did not "work out." Court documents claim Aranda said he originally planned to kill an adult before choosing the child instead.

Aranda has two past convictions for assaults at the mall, both in 2015, including one in which he threw a glass of water and glass of tea at a woman who refused to buy him something. Aranda at one point was banned from the mall.

Court records show that Aranda had been ordered to undergo psychological evaluation or treatment after the earlier mall assaults. The Star-Tribune reported that Aranda was previously convicted of first-degree property damage and was also arrested on charges of assault and theft in Illinois.

The paper also reported that Aranda told police that he "has some anger issues" after he was arrested for allegedly smashing computers at a Minneapolis public library.

Immigration operation at Texas tech firm brings almost 300 worker arrests

Immigration officials on Wednesday arrested some 280 employees of a North Texas tech company suspected of knowingly hiring illegal immigrants, the largest such single-company sweep in 11 years.

More than 200 law enforcement personnel took part in the operation at CVE Technology Group in Allen, north of Dallas. Officials said the company refurbishes and repairs telecommunications equipment, including cellphones.

"The numbers of the administrative arrests we made today hint at the significant scope of this criminal investigation," Homeland Security Investigations (HSI) Special Agent in Charge Katrina Berger said at a news conference. Berger said investigators had worked on the case for "at least a year" after receiving "many tips that they [CVE] were hiring illegal aliens who were using fraudulent documents."

HSI began auditing the company's I-9 forms in January -- the forms confirm the eligibility of prospective employees to hold jobs in the U.S. -- and confirmed "numerous hiring irregularities," according to a statement from Immigration and Customs Enforcement (ICE).

A breakdown of the nationalities, ages and possible criminal backgrounds of those arrested was not immediately available. CVE's other locations in Plano, Texas, and Riverdale, N.J., were not affected by the operation.

Berger said HSI would interview the arrested employees before determining if they should remain in custody or be released for humanitarian reasons.

"Businesses that knowingly hire illegal aliens create an unfair advantage over their competing businesses," Berger said. "In addition, they take jobs away from U.S. citizens and legal residents, and they create an atmosphere poised for exploiting an illegal workforce."

Wednesday's operation was the largest at a single location since May 12, 2008, when 389 employees of the Agriprocessors slaughterhouse and meatpacking plant in Postville, Iowa, were taken into custody. The raid led to the arrest and conviction of executive Sholom Rubashkin for money laundering. Rubashkin was sentenced to 27 years in prison, but his sentence was commuted to time served by President Trump in December 2017.

Oakland Athletics first baseman Matt Olson underwent surgery on his right hand Friday and is expected to be placed on the injured list. How long he will be out of the lineup has not been announced.

The team announced that the surgery was performed by Dr. Steven Shin at the Kerlan-Jobe Clinic in Los Angeles, and involved a hamate excision to Olson’s right hand.

The injury occurred Thursday in the second game of a season-opening series against the Seattle Mariners in Tokyo on a foul tip during Olson’s final at-bat. He started each of Oakland’s first two games at first base and went 1-for-5.

The 25-year-old Gold Glove winner, who is beginning his fourth season with the A’s, played in all 162 games last year, batting .247 with 29 home runs and 84 RBIs in his first full season in the majors. He has career totals of 53 home runs and 129 RBIs in 232 games.

–The Boston Red Sox and ace left-hander Chris Sale have agreed to a long-term contract extension, according to multiple reports.

The five-year deal is worth $145 million, league sources told ESPN’s Jeff Passan. It adds to Sale’s current contract (one year remaining) and will go through the 2024 season.

Sale, who turns 30 on March 30, is scheduled to make $15 million in 2019, completing a team-friendly five-year, $32.5 million extension he signed with the White Sox in 2013 that included two club options.

–Cincinnati Reds second baseman Scooter Gennett was helped off the field during the spring training game against the Milwaukee Brewers in Phoenix, Ariz., with an apparent right leg or groin injury.

Gennett walked gingerly as he was helped off the field, and he was later taken from the dugout on a golf cart. The team said he will have an MRI, with an update to be announced later.

Gennett was hurt while fielding a routine grounder on the outfield grass after he aligned deep as part of a shift. He moved to his left and went down on his right knee, but he fielded the ball awkwardly and was in apparent pain as he threw to first base for the out. He remained in a kneeling position before getting assistance.

–The Chicago White Sox officially announced they have agreed to terms on a six-year, $43 million contract with outfielder Eloy Jimenez, plus two club options that could extend the deal through the 2026 season.

The White Sox said Jimenez will receive a $5 million bonus in addition to $1 million in 2019, $1.5 million in 2020, $3.5 million in 2021, $6.5 million in 2022, $9.5 million in 2023 and $13 million in 2024. The team holds options for $16.5 million in 2025 and $18.5 million in 2026, with $3 million buyouts for either season.

The White Sox’s top prospect and No. 3 overall in baseball, the 22-year-old had already been assigned to Triple-A Charlotte to start the upcoming season, but the deal means that he could be in the team’s Opening Day lineup on March 28 at Kansas City.

Dolphin strandings increase along Southern California coast

Experts are concerned about an increase in dolphin strandings along the Southern California coast.

The Pacific Marine Mammal Center said it has responded to six beached dolphins this month and received reports of two others.

Necropsies have been performed on all the dolphins to try to determine the cause of the strandings.

The strandings began with three common dolphins beaching themselves on Feb. 4. One washed up dead at Huntington Beach and two more were rescued alive at Laguna Beach but had to be euthanized after examination.

A dead bottlenose dolphin washed ashore at Corona del Mar on Feb. 10, followed five days later by a common dolphin. Both were pregnant.

The most recent stranding was a common dolphin at Corona del Mar on Feb. 18.

Israel, Palestinian militants trade fire as 'truce' appears to unravel

The Israeli army on Tuesday bombed several targets in the Gaza Strip as Palestinian militants responded with a new barrage of late-night rocket fire, demonstrating that a truce with Hamas rulers showed signs of unraveling.

Tuesday night’s airstrikes came in response to a lone rocket attack. The military said it hit a Hamas military compound and a weapons manufacturing warehouse in southern Gaza. Militants responded by firing another rocket. Israel said both projectiles landed harmlessly in open areas.

The violence, less than two weeks before Israel holds national elections, is likely to become a major theme in the final stretch of a tight reelection campaign for Prime Minister Benjamin Netanyahu, who indicated the election would not deter him from acting.

Netanyahu cut short a visit to the U.S. and rushed back to Israel on Tuesday to deal with the crisis. After meeting with Netanyahu, Israel’s military chief, Lt. Gen. Aviv Kohavi, ordered an additional troop buildup along the border.

Netanyahu had been scheduled to give a speech in Washington to the AIPAC pro-Israel lobbying group. Instead, he addressed the group by satellite, telling them that over the past 24 hours Israel had pounded militant sites in Gaza on a scale not seen since a 2014 war with Hamas.

“I can tell you, we are prepared to do a lot more,” he said. “We will do what is necessary to defend our people and to defend our state.”

Israeli forces continued to strike targets Tuesday in the Gaza Strip after a rocket attack from the Palestinian territory. The Israeli army said at least 30 rockets were fired into Israel, and that it retaliated with at least 15 airstrikes.

Israel and Hamas are bitter enemies that have fought three wars and dozens of skirmishes since the Islamic militant group seized control of Gaza in 2007.

The latest round of violence was triggered by a rocket fired early Monday from Gaza that slammed into a house in central Israel and wounded seven people.

Uber unveils new safety measures after college student’s murder: NBC News

(Reuters) – Ride-hailing company Uber Technologies Inc is rolling out new features for the safety of its riders, NBC News reported on Thursday.

In an interview with NBC News, Tony West, Uber’s chief legal and security officer said the company’s app will push out an alert for riders to check the license plate, make and model of the vehicle as well as the name and picture of the driver to confirm the correct person is picking them up.

BERLIN (Reuters) – Wulf Matthias will not stand for a second term as Wirecard’s chairman in 2020, German daily Handelsblatt said on Friday, citing sources in the financial industry.

For age reasons alone this would not be an option for Matthias, aged 75, Handelsblatt added.

Matthias will keep his mandate until it ends in 2020, the paper quoted a company spokeswoman as saying.

Wirecard was not immediately available for comment when contacted by Reuters.

ZURICH (Reuters) – Shareholders approved Credit Suisse’s 2018 compensation report with an 82 percent majority on Friday, overriding frustrations expressed at its annual general meeting over jumps in executive pay during a year its share price plummeted.

Three shareholder advisers had recommended investors vote against Switzerland’s second-biggest bank’s remuneration report, while a fourth backed the report but expressed reservations about whether management pay matched performance.

The approval marked a slight increase over the 80.8 percent support garnered for the bank’s 2017 compensation report.

LONDON (Reuters) – Activist investor Edward Bramson is likely to fail in his attempt to get a board seat at Barclays’ annual meeting next week, even though shareholders are dissatisfied with performance of the group’s investment bank.

New York-based Bramson’s Sherborne Investors and the board of the British bank have been sparring for months over Barclays’ strategy.

Bramson wants to scale back Barclays’ investment bank to reduce risk and boost shareholder returns. Barclays Chief Executive Jes Staley remains staunchly committed to growing the business out of trouble.

After failing to persuade Staley to change course since he began building a 5.5 percent stake in the bank in March last year, Bramson hopes a board seat will rachet up the pressure.

Both sides have written to shareholders pitching their case and Bramson has courted investors in one-on-one meetings, although none have publicly backed him yet.

Interviews by Reuters with five institutional investors in Barclays suggest Bramson has failed to persuade them.

Sherborne declined to comment.

Mirza Baig, head of investment stewardship at top-40 shareholder Aviva Investors, said Bramson was welcome on the bank’s register but the boardroom was a step too far.

“He has created a lot of value at other businesses, but, generally, when he has come in as executive chair and taken full control. This would be a different case where he would just be one lone voice on the board,” he said.

A second Barclays shareholder said he backed Bramson’s goal of improving returns but via an “evolutionary” approach.

“If you look at banks that have tried to restructure their operations in investment banking – you look at Natwest Markets, Deutsche Bank – I struggle to think of an example where a roughshod restructuring has been accretive to shareholder value.”

A third, top-30 investor said he had been impressed by incoming Chairman Nigel Higgins’ grasp of the challenge in hand, and felt investors would give him time.

“Management know they have to execute and deliver improved returns… [Higgins] will continue to re-shape the board but obviously he didn’t feel that having someone with a diametrically opposed view on it would be helpful.”

A fourth, top-30 investor agreed: “We voted for the chairman to come in and it would be crazy to allow an activist to join the board (at this time).”

Jupiter Fund Management, the 24th largest investor, said it also planned to vote against Bramson.

Barclays has nearly 500 institutional shareholders, Refinitiv data showed.

Since Staley joined Barclays in 2015, the investment bank returns relative to capital invested have increased but are still underperforming the overall business.

Barclays’ first-quarter figures showed the investment bank posted a 6 percent drop in income from its markets business and a 17 percent fall in banking advisory fees.

Returns in the investment bank fell to 9.5 percent from 13.2 percent a year ago.

Famed for successful campaigns against smaller British companies in sectors from chemicals to advertising, Bramson’s board seat pitch has been rebuffed by shareholder advisory firms.

Institutional Shareholder Services, the world’s biggest, said Bramson’s proposal “falls short of what can reasonably be expected from a shareholder trying to address issues at a 28 billion pounds, systemically important bank”.

Glass Lewis also flagged concern about Bramson’s lack of banking experience and “questionable” shareholding structure, referring to Sherborne’s use of derivative contracts to hedge losses should its strategy fail.

Critics said the arrangement meant his interests are not truly aligned with those of other long-term shareholders.

British advisory firm Pirc, however, said it recommended that investors abstain in the vote on Bramson’s proposal as a challenge to the board to do better in the year ahead – or face a similar contest in 2020.

(Reuters) – U.S. oil and natural gas producer Chevron Corp reported a 27 percent fall in quarterly earnings on Friday, hit by lower crude prices and weaker margins in its refining and chemicals businesses.

Net income attributable to the company fell to $2.65 billion, or $1.39 per share, for the first quarter ended March 31, from $3.64 billion, or $1.90 per share, a year earlier.

Earlier in the day, larger rival Exxon Mobil Corp reported earnings well below analysts’ estimates, as margins in its refining business were hurt by higher Canadian prices and heavy scheduled maintenance.
