Adobe, Microsoft to take on Salesforce’s marketing software, with LinkedIn as a weapon

SAN FRANCISCO (Reuters) – Adobe Inc and Microsoft Corp are partnering to bolster each other’s sales and marketing software capabilities, taking aim at common rival Salesforce.com Inc, they said on Tuesday.

Adobe and Microsoft hope to make it easier for users of Adobe’s marketing software to find and target teams of potential customers for business goods on LinkedIn, the social network owned by Microsoft, they said at a conference in Las Vegas.

If an Adobe customer is selling medical equipment to a hospital, for example, the new partnership would make it easier to target tailored LinkedIn ads to all of the people involved in the purchasing decision, such as doctors, technicians and finance managers. If the marketing campaign works, sales people could then use Microsoft’s sales software to help close the deal.

“The LinkedIn network is one of those clear holy grails” for business marketers, Steve Lucas, chief executive officer of Marketo, a business-to-business marketing software firm that Adobe acquired last year for $4.75 billion, told Reuters. “It has just become such a huge lever for B-to-B marketers that it would be impossible for us to ignore it.”

Long known as the maker of content creation tools such as Photoshop, Adobe has in recent years turned to making the software used for marketing campaigns, which rely heavily on the content created with its software.

Most of Adobe’s tools were for marketers trying to reach consumers, but the Marketo acquisition last year bolstered its software for business marketers.

While Microsoft is best known for its Window operating system and Office program, it is also working to grow a business called Dynamics 365, software used by sales people to track deals. Its $26 billion acquisition in 2016 of LinkedIn, perhaps the most common tool used by sales people trying to drum up business, was a key piece of the effort https://www.reuters.com/article/us-microsoft-linkedin-idUSKBN17Q1FW.

In doing so, both are taking on Salesforce, the cloud software company that offers sales and marketing software, where Adobe and Microsoft lack one or the other.

But by integrating their systems, Adobe and Microsoft can offer something arguably “a lot broader” because Adobe software is how most marketing content gets made, said Melissa Webster, program vice president for content and digital media technologies at research firm IDC.

“There’s no question that Microsoft and Adobe both have a lot to gain from teaming up against Salesforce,” Webster said.

Salesforce could not be reached immediately for comment.

Michael Avenatti hit with 36-count federal indictment that could put him behind bars for 335 years

Michael Avenatti, the former Stormy Daniels attorney and once-rumored 2020 presidential candidate, is now facing up to 335 years in prison after being slapped with three dozen new federal charges alleging he stole millions of dollars from his clients, failed to pay taxes and lied in bankruptcy cases, amongst other accusations.

The 48-year-old was indicted late Wednesday by a Southern California grand jury following his arrest last month in New York for allegedly trying to shake down Nike for up to $25 million.

“I intend to fully fight all charges and plead NOT GUILTY,” Avenatti posted on Twitter Thursday after being freed on a $300,000 bond. “I look forward to the entire truth being known as opposed to a one-sided version meant to sideline me.”

If convicted on all of the new charges, Avenatti would face 335 years in prison, federal investigators say. He is scheduled to be arraigned on April 29 in United States District Court in Santa Ana. The Los Angeles Times says Avenatti already faces up to 47 more years if convicted in the Nike case.

"These four areas of criminal conduct alleged in the indictment are all linked to one another because money generated from one set of crimes appears in other sets – typically in the form of payments to lull victims and to prevent Mr. Avenatti’s financial house of cards from collapsing,” United States Attorney Nick Hanna said Thursday.

The 61-page indictment alleges Avenatti embezzled from a paraplegic man and four other clients and deceived them by shuffling money between accounts to pay off small portions of what they were due to lull them into thinking they were getting paid.

Avenatti is also charged with not paying personal income taxes, not paying taxes for his various businesses, including two law firms, and pocketing payroll taxes from the Tully's Coffee chain that he owned, the indictment said.

Between September 2015 and January 2018, Global Baristas US, the company that operated Tully's, failed to pay the Internal Revenue Service $3.2 million in payroll taxes, including nearly $2.4 million withheld from employees, the indictment said.

When the IRS put tax levies on coffee company bank accounts to collect more than $5 million, Avenatti had Tully's employees deposit cash receipts in a little-known account, the indictment said.

Avenatti was also charged with submitting fraudulent tax returns to get more than $4 million in loans from The Peoples Bank in Biloxi, Mississippi, in 2014. The tax returns he presented to the bank were never filed to the IRS, prosecutors have said.

“For 20 years, I have represented Davids vs. Goliaths and relied on due process and our system of justice,” Avenatti tweeted Thursday. “Along the way, I have made many powerful enemies. I am entitled to a FULL presumption of innocence and am confident that justice will be done once ALL of the facts are known.”

The charges are the latest major blow to a career that took off last year when Avenatti represented Daniels in her lawsuit to break a confidentiality agreement with Trump to stay quiet about an affair they allegedly had.

Avenatti became one of Trump's leading adversaries, attacking him on cable news programs and Twitter. At one point, Avenatti even considered challenging Trump for the White House in 2020.

But back home, his business practices had come under scrutiny from the IRS and a former law partner who was owed $14 million by Avenatti and the Eagan Avenatti firm, which filed for bankruptcy.

And now the tables have turned in part on Twitter, with Avenatti getting ripped by the same figures he has gone after, like Donald Trump Jr.

“Good news for my friend @MichaelAvenatti, if you plead fast enough, you might just get to share a cell with Michael Cohen!” the president’s son quipped in late March following the emergence of the Avenatti-Nike allegations.

The new indictment also says Avenatti made false statements in bankruptcy proceedings by submitting forms under penalty of perjury that under reported income his firm received.

The most glaring example of deception and fraud was described in the indictment as scheming Avenatti allegedly did to deprive clients of money they were due from legal settlements or sales of stock and the actions he took to cover his tracks.

In a case involving one client, Avenatti allegedly funneled a $2.75 million settlement into his bank accounts and spent $2.5 million on a private airplane, the indictment said.

Although Avenatti was due a portion of settlement funds for his work, the charges said he paid only a fraction of the money clients were due in some cases and strung them along while they waited to be paid.

Avenatti allegedly drained a $4 million settlement he negotiated in 2015 on behalf of Geoffrey Johnson, who was paralyzed after trying to kill himself in the Los Angeles County jail, the indictment said. Johnson was referred to as "Client 1" in the indictment, but was named at a recent court hearing involving the money Avenatti was ordered to pay his former partner.

Until last month, Avenatti had only provided $124,000 over 69 payments to Johnson, the indictment said.

Two years after the settlement was reached, Avenatti allegedly helped Johnson find a real estate agent to buy a house. But when Johnson was in escrow to purchase the property, Avenatti falsely said he had not received the settlement funds, the indictment said.

In November, when the U.S. Social Security Administration requested information to determine if Johnson should continue to receive disability benefits, Avenatti said he would respond, but didn't because he knew it could lead to the discovery of his embezzlement, the indictment said. The failure to respond led to Johnson's disability benefits being cut off in February.

SAN SALVADOR (Reuters) – China on Thursday rejected comments by Salvadoran President-elect Nayib Bukele, who accused the Asian power of not playing by the rules and intervening in other nations’ affairs.

Bukele, a political outsider who was elected in February as the Central American nation’s next president, has questioned whether El Salvador should maintain diplomatic relations with China.

In August, El Salvador broke ties with Taiwan to establish relations with China, following the Dominican Republic and Panama. China later offered El Salvador about $150 million for social projects and 3,000 tons of rice to feed thousands of Salvadorans struck by a drought.

“China does not play by the rules; they do not respect the rules,” Bukele said on Wednesday at the Washington-based Heritage Foundation. “They develop projects that are not feasible, leaving countries with huge debt that cannot be paid back and use that as financial leverage.”

“They are not a democracy, but they intervene in your democracy,” Bukele added.

The Chinese embassy in El Salvador issued a statement on Thursday responding to Bukele’s comments, saying cooperation between China and El Salvador would not be a “debt trap but instead a sweet deal for both nations.”

“China never looks to intervene in the internal affairs of other nations, but always opens and develops diplomatic relations with all countries, just as is the case with El Salvador,” the statement said.

Bukele has been critical of the benefits that El Salvador received after establishing diplomatic relations with China.

U.S. National Security adviser John Bolton tweeted that he and Bukele reaffirmed strong friendship between their countries on Thursday. “We are eager to identify new opportunities for foreign investment, improve security, counter Chinese predatory practices, & increase support for Interim Venezuelan President Guaido,” Bolton said.

The White House warned in August that China was luring countries with incentives that “facilitate economic dependence and domination, not partnership.”

El Salvador’s relations with Washington suffered under the outgoing government of the left-wing Faribundi Marti National Liberation front (FMLN), the party of the country’s former guerrilla movement.

The current Salvadoran government of Salvador Sanchez Ceren has defended its decision to open relations with China and accuses Bukele of receiving orders from the United States to cut ties with the country.

Bukele will take office in June. “We are convinced that President-elect Nayib Bukele, with the wisdom and courage of a great young leader, will make the right decision,” said China’s embassy.

Planned Parenthood President Says Being Called ‘Trump’s Nightmare’ Is A ‘Badge Of Honor’

Following her appearance on Comedy Central with Trevor Noah, Planned Parenthood president Dr. Leana Wen tweeted Friday that she will wear as a “badge of honor” the label of “Trump’s nightmare,” which Noah bestowed on her during the show.

Wen tweeted, “Last night, I was on @TheDailyShow to talk about Planned Parenthood’s incredible life-saving work. @Trevornoah called me @realDonaldTrump’s “nightmare” — a badge of honor I proudly wear as we fight for our patients, our rights & our future!”

During Noah’s show Thursday evening, Wen advocated for universal healthcare, claiming that sickness originates from “systemic issues.”

“In working in the ER, I saw that what’s making people sick isn’t just the illness that they have, its also systemic issues. And that’s why I truly believe that healthcare has to be a human right that’s guaranteed to all and not just a privilege available to some,” she said.

Wen also went on to claim that the healthcare services provided by Planned Parenthood should not be considered political in nature.

When Noah directly addressed to topic of abortion in the interview, Wen characterized the procedure as “standard” and just normal “healthcare.”

“Abortion is a standard medical procedure, that one fourth of women will have in their lifetime. It’s part of the full spectrum of reproductive healthcare, which is healthcare, and its important for us to speak about abortion in that context,” she explained. (RELATED: Gov. At one point in the interview, Wen accused Trump of lying about late-term abortion practices and post-birth abortion claims:

We have to call out President Trump for what he is doing, which is lying. What he is saying has no basis in medicine or reality. And here are the facts: about 99% of abortions occur before 21 weeks; those that occur later in pregnancy are because something in the pregnancy has gone very wrong … these are extremely difficult, hugely personal and challenging circumstances that women and families find themselves in and they deserve our compassion, and President Trump is exploiting their pain for political gain and I say to him, “Shame on you, President Trump.”

Noah concluded the interview by telling Wen,  “I’ll tell you this much, you are a doctor who is a woman, who is running Planned Parenthood, who finished college and is an immigrant. You are literally Trump’s nightmare.”

The Latest: Tornado confirmed in Alabama

The Latest on severe weather in the Southeast (all times local):

12:55 p.m.

The National Weather Service says a small tornado is responsible for destroying farm buildings and causing other damage in northeast Alabama.

The weather service says a team found damage from an EF-1 tornado with winds estimated at 90 mph (145 kph) after storms moved through Blount County early Monday.

A barn and other rural buildings were damaged or destroyed, and one person was reported hurt.

The weather service team is checking other damage that occurred elsewhere, and storms are still moving across the region.

A strong storm moving across northeast Alabama knocked down power lines and caused scattered damage in a retail district and forecasters said more bad weather was on the way.

Photos shared on social media showed plants and other items thrown around the parking lot of a Walmart store in Guntersville, Alabama, during Monday's storm. Nearby stores had to close because of power outages.

High winds left trees tilted sideways and utility lines drooped toward the ground. Farm buildings were damaged in rural Blount County, Alabama, where one person was reported injured.

The National Weather Service issued tornado warnings after radar indicated a possible twister. The weather service office in Huntsville said it was sending a team to determine whether a tornado caused damage.

The Storm Prediction Center says 26 million people were at a slight risk of severe storms in Mississippi, Alabama, Georgia and the Carolinas.

Nadler: Executive Privilege Can't Be Asserted to Cover 'Wrong Doing'

Executive privilege cannot be used to hide wrongdoing and any attempt by the White House and President Donald Trump to block parts of special counsel Robert Mueller's report from Congress or the public would not be "right" nor "successful," according to House Judiciary Committee Chairman Jerrold Nadler, D-N.Y.

"The president must personally assert executive privilege, and I do not believe it exists here at all because, as we learned from the [former President Richard] Nixon tapes case, executive privilege cannot be used to hide wrongdoing," Nadler told NBC's "Meet the Press."

". . . The president may try to assert it, may try to hide things behind it, but I don't think that's right or [would] be successful."

Rep. Nadler referred to the unanimous 1974 Supreme Court ruling on the Nixon tapes that rejected executive privilege overriding the judicial process.

President Trump has reportedly weighed using executive privilege to review classified material not related to any indictment legal proceeding, merely the public release of potentially politicized material that is not used in review criminality.

"Congress must get all the information and the evidence that the Department of Justice may have in order to exercise our function of being able to hold the president accountable," Nadler told host Chuck Todd. "If we don't do that, if we can't do that the president is effectively above the law."

BEIJING (Reuters) – British finance minister Philip Hammond said on Friday that he had a “very constructive meeting” with his counterpart in the opposition Labour Party before leaving for Beijing and that he was optimistic about finding common ground.

Hammond, speaking on the sidelines of a summit on China’s Belt and Road initiative in Beijing, said talks with Labour aimed at finding a way forward on Brexit had not stalled.

“I’m optimistic that we will find common ground,” he said. “Both sides have got clear positions and both sides will have to compromise in order to reach an agreement.”

Hammond added that he absolutely did not favor a no deal exit from the European Union.

NICOSIA (Reuters) – Cypriot police searched on Friday for more victims of a suspected serial killer, in a case which has shocked the Mediterranean island and exposed the authorities to charges of “criminal indifference” because the dead women were foreigners.

The main opposition party, the left-wing AKEL, called for the resignation of Cyprus’s justice minister and police chief.

Police were combing three different locations west of the capital Nicosia for victims of the suspected killer, a 35-year-old army officer who has been in detention for a week.

The bodies of three women, including two thought to be from the Philippines, have been recovered. Police sources said the suspect had indicated the location of the third body, found on Thursday, and had said the person was “either Indian or Nepali”.

Police said they were searching for a further four people, including two children, based on the suspect’s testimony.

“These women came here to earn a living, to help their families. They lived away from their families. And the earth swallowed them, nobody was interested,” AKEL lawmaker Irene Charalambides told Reuters.

“This killer will be judged by the court but the other big question is the criminal indifference shown by the others when the reports first surfaced. I believe, as does my party, that the justice minister and the police chief should resign. They are irrevocably exposed.”

Police have said they will investigate any perceived shortcomings in their handling of the case.

One person who did attempt to alert the authorities over the disappearances, a 70-year-old Cypriot citizen, said his motives were questioned by police.

The bodies of the two Filipino women reported missing in May and August 2018 were found in an abandoned mine shaft this month. Police discovered the body of the third woman at an army firing range about 14 km (9 miles) from the mine shaft.

Police are now searching for the six-year-old daughter of the first victim found, a Romanian mother who disappeared with her eight-year-old child in 2016, and a woman from the Phillipines who vanished in Dec. 2017.

The suspect has not been publicly named, in line with Cypriot legal practice.

A public vigil for the missing was planned later on Friday.

LONDON, April 26 – British factories stockpiled raw materials and goods ahead of Brexit at the fastest pace since records began in the 1950s, and they were increasingly downbeat about their prospects, a survey showed on Friday.

The Confederation of British Industry’s (CBI) quarterly survey of the manufacturing industry showed expectations for export orders in the next three months fell to their lowest level since mid-2009, when Britain was reeling from the global financial crisis.

The record pace of stockpiling recorded by the CBI was mirrored by the closely-watched IHS Markit/CIPS purchasing managers’ index published earlier this month.

KUALA LUMPUR (Reuters) – Fewer than half of Malaysians approve of Prime Minister Mahathir Mohamad, an opinion poll showed on Friday, as concerns over rising costs and racial matters plague his administration nearly a year after taking office.

The survey, conducted in March by independent pollster Merdeka Center, showed that only 46 percent of voters surveyed were satisfied with Mahathir, a sharp drop from the 71 percent approval rating he received in August 2018.

Mahathir’s Pakatan Harapan coalition won a stunning election victory in May 2018, ending the previous government’s more than 60-year rule.

But his administration has since been criticized for failing to deliver on promised reforms and protecting the rights of majority ethnic Malay Muslims.

Of 1,204 survey respondents, 46 percent felt that the “country was headed in the wrong direction”, up from 24 percent in August 2018, the Merdeka Center said in a statement. Just 39 percent said they approved of the ruling government.

High living costs remained the top most concern among Malaysians, with just 40 percent satisfied with the government’s management of the economy, the survey showed.

It also showed mixed responses to Pakatan Harapan’s proposed reforms.

Some 69 percent opposed plans to abolish the death penalty, while respondents were sharply divided over proposals to lower the minimum voting age to 18, or to implement a sugar tax.

“In our opinion, the results appear to indicate a public that favors the status quo, and thus requires a robust and coordinated advocacy efforts in order to garner their acceptance of new measures,” Merdeka Center said.

The survey also found 23 percent of Malaysians were concerned over ethnic and religious matters.

Some groups representing Malays have expressed fear that affirmative-action policies favoring them in business, education and housing could be taken away and criticized the appointments of non-Muslims to key government posts.

Last November, the government reversed its pledge to ratify a UN convention against racial discrimination, after a backlash from Malay groups.

Earlier this month, Pakatan Harapan suffered its third successive loss in local elections since taking power, which has been seen as a further sign of waning public support.

Despite the decline, most Malaysians – 67 percent – agreed that Mahathir’s government should be given more time to fulfill its election promises, Merdeka Center said.

This included a majority of Malay voters who were largely more critical of the new administration, it added.

(Reuters) – European shares slipped on Friday after losses in heavyweight banks and Glencore outweighed gains in healthcare and auto stocks, while investors remained on the sidelines ahead of U.S. economic data for the first quarter.

The pan-European STOXX 600 index was down 0.1 percent by 0935 GMT, eyeing a modest loss at the end of a holiday-shortened week. Banks-heavy Italian and Spanish indices were laggards.

The banking index fell for a fourth day, at the end of a heavy earnings week for lenders.

Britain’s Royal Bank of Scotland tumbled after posting lower first quarter profit, hurt by intensifying competition and Brexit uncertainty, while its investment bank also registered poor returns.

Weakness in investment banking also dented Deutsche Bank’s quarterly trading revenue and sent its shares lower a day after the German bank abandoned merger talks with smaller rival Commerzbank.

“The current interest rate environment makes it challenging for banks to make proper earnings because of their intermediary function,” said Teeuwe Mevissen, senior market economist eurozone, at Rabobank.

Since the start of April, all country indexes were on pace to rise between 1.8 percent and 3.4 percent, their fourth month of gains, while Germany was strongly outperforming with 6 percent growth.

“For now the current sentiment is very cautious as markets wait for the first estimates of the U.S. GDP growth which could see a surprise,” Mevissen said.

U.S. economic data for the first-quarter is due at 1230 GMT. Growth worries outside the United States resurfaced this week after South Korea’s economy unexpectedly contracted at the start of the year and weak German business sentiment data for April also disappointed.

Among the biggest drags on the benchmark index in Europe were the basic resources sector and the oil and gas sector, weighed down by Britain’s Glencore and France’s Total, respectively.

Glencore dropped after reports that U.S authorities were investigating whether the company and its subsidiaries violated certain provisions of the commodity exchange act.

Energy major Total said its net profit for the first three months of the year fell compared with a year ago due to volatile oil prices and debt costs.

Chip stocks in the region including Siltronic, Ams and STMicroelectronics lost more than 1 percent after Intel Corp reduced its full-year revenue forecast, adding to concerns that an industry-wide slowdown could persist until the end of 2019.

Meanwhile, healthcare, which is also seen as a defensive sector, was a bright spot. It was helped by French drugmaker Sanofi after it returned to growth with higher profits and revenues for the first-quarter.

Luxembourg-based satellite operator SES led media stocks higher after it maintained its full-year outlook on the back of the company’s Networks division.

Automakers in the region rose 0.4 percent, led by Valeo’s 6 percent jump as the French parts maker said its performance would improve in the second half of the year.

Continental AG advanced after it backed its outlook for the year despite reporting a fall in first-quarter earnings.

Renault rose more than 3 percent as it clung to full-year targets and pursues merger talks with its Japanese partner Nissan.
