Trump fails to end ‘Apprentice’ contestant’s defamation lawsuit

NEW YORK (Reuters) – A New York state appeals court rejected U.S. President Donald Trump’s effort to dismiss a defamation lawsuit by Summer Zervos, a former contestant on his television show “The Apprentice,” or delay it until after he leaves the White House.

In a 3-2 decision on Thursday, the Appellate Division in Manhattan said the U.S. Constitution did not strip state courts of power to decide cases arising under state constitutions, even if they involved sitting presidents.

Despite suggesting he embodies the executive branch and has significant responsibilities, “the President is still a person, and he is not above the law,” Justice Dianne Renwick wrote.

The dissenting judges said the lawsuit would interfere with Trump’s job as president, and should wait until he left office.

Trump’s lawyer Marc Kasowitz said Trump will appeal to the state’s highest court, the Court of Appeals, “which we expect will agree with the dissent.”

The decision affirmed a lower court ruling from last March.

Zervos’ lawyers are hoping to question Trump under oath about whether he defamed her by calling her a liar after she accused him of sexual misconduct.

“We look forward to proving to a jury that Ms. Zervos told the truth about defendant’s unwanted sexual groping and holding him accountable for his malicious lies,” Zervos’ lawyer Mariann Wang said.

Trump has denied Zervos’ claims and called her case politically motivated. Several other women have also accused Trump of improper sexual conduct.

Zervos, an “Apprentice” contestant in 2005, accused Trump of kissing her against her will at a 2007 meeting in New York, and later groping her at a Beverly Hills hotel.

She came forward in October 2016, the month before Trump was elected, after an “Access Hollywood” recording showed Trump speaking in vulgar terms about women. Trump also republished on Twitter a post calling Zervos’ accusations a “hoax.”

The appeals court called Zervos’ case “materially indistinguishable” from former Arkansas state employee Paula Jones’s lawsuit accusing then-President Bill Clinton of sexual harassment.

In 1997, the U.S. Supreme Court let Jones’ case go forward. That paved the way for Clinton’s impeachment the following year.

Justice Angela Mazzarelli, one of Thursday’s dissenters, said the “all-consuming nature of the Presidency creates a constitutional barrier” against Zervos’ lawsuit.

All five justices found Zervos’ defamation claim legally sufficient, without ruling on its merits.

Trump also faced a defamation claim by adult film actress Stormy Daniels in her lawsuit over a hush money agreement. That lawsuit was dismissed on March 7.

The case is Zervos v Trump, New York State Supreme Court, Appellate Division, First Department, No. 7610.

Botswana unveils country’s largest blue diamond find

A big blue diamond weighing more than 20 carats has been unveiled in Botswana, where the gem was discovered.

The government-owned Okavango Diamond Company on Wednesday called it the largest blue diamond ever discovered in the southern African nation.

A company statement says it is "in the very top bracket of all-time historical blue diamond finds." The bright blue color is attributed to the mineral boron, which was present in the rocks of oceans when the diamond was formed some 1 to 3 billion years ago.

Company managing director Marcus ter Haar says just a few such blue stones have come to market in the last decade.

The company says the diamond is expected to be sold near the end of the year.

Dozens of Nicaraguans arrested in anti-government march: opposition

MANAGUA (Reuters) – Hundreds of Nicaraguans opposed to President Daniel Ortega took to the streets of the capital Managua on Wednesday in protests deemed illegal by the government and several dozen were arrested, according to an opposition group.

Video showed that police in riot gear at the site of the main protest attempted to impede some 200 marchers as peaceful, flag-waving Nicaraguans shouted pro-democracy slogans. One journalist was also briefly arrested.

Anti-government protests began a year ago this week, evolving into a broader resistance movement and the sharpest test of Ortega’s grip on power since he took office for a second time in 2007. A Cold War adversary of the United States, the 73-year-old Ortega served a single term as president in the 1980s.

A total of 67 protesters were detained by police during the day, according to the opposition Blue and White National Unity movement, which organized the protests in defiance of a ban issued a day earlier by the government.

Police and government officials did not respond to requests for comment.

The government on Tuesday said it had released more than 600 prisoners, but denied that any had been held for political reasons.

Journalist Abixael Mogollon with Nicaraguan digital outlet Aritculo 66 was covering the protests on Wednesday and was among those detained although he was later released.

“I was in the midst of a live broadcast and (the police) ordered me to stop and then they took me into a vehicle and began hitting my chest and legs,” Mogollon told Reuters.

He added that four women who had been arrested were also released but not before he witnessed them also being struck, threatened and their possessions taken from them.

The protests first erupted last April when Ortega, a former Marxist guerrilla, tried to cut welfare benefits.

At least 324 people have been killed in the civil unrest since then, according to the Inter-American Commission on Human Rights, an autonomous arm of the Organization of American States.

Ortega has called the protests an illegal plot by his adversaries to oust him, while critics have accused him of employing authoritarian tactics and seeking to entrench a family dynasty in the Central American nation.

The government had prohibited the opposition march on the grounds that those behind it were involved in “grave disturbances to public order” in past protests.

SEE IT: Water from rooftop pool falls 600 feet down Manila penthouse during Philippines earthquake

Water from a rooftop pool was seen cascading 600 feet down a Manila skyscraper on Monday as a powerful earthquake ripped through the northern Philippines, damaging multiple buildings and causing at least 11 deaths.

The dramatic footage captured the moment when water from an 82-foot-long lap pool and a children’s pool poured down the side of the Anchor Skysuites as the building swayed in the 6.1 earthquake. The video was shared online by The Manila Bulletin and credited to Michael Rivo.

Monday’s earthquake collapsed a supermarket and damaged other buildings and an airport in the country’s north. Rescuers worked overnight to recover bodies from the rubble. The death toll is now at 11 and at least 24 remain missing.

Ben Carson explains benefits of investing in ‘Opportunity Zones’ for areas facing economic challenges

Housing and Urban Development Secretary Ben Carson spoke on “The Next Revolution with Steve Hilton” in an interview that aired Sunday about proposed new regulations aimed at making it easier for investors to take advantage of tax breaks for investing in “Opportunity Zones” in low-income areas.

“Policies have been pretty much aimed at putting people into programs,” Carson said, and now the Trump administration is trying to get poor Americans “out of the programs and self-sufficient.”

President Trump said last week that 8,700 neighborhoods across all 50 states and U.S. territories have received the Opportunity Zone designation and would be eligible for the federal tax incentives he's proposed.

“The entire island of Puerto Rico is an opportunity zone,” Carson said.

“We are very concerned about the rural areas, too,” he added.

Trump’s proposed regulations were issued by the Treasury Department. They sought to clear up questions that were keeping some investors from using the incentives.

The program was included in the $1.5 trillion tax cut legislation that Trump pushed through Congress in 2017.

The new Opportunity Zones were set up to enable private investors to re-invest profits into designated areas.

“They are going to invest that money somewhere,” Carson said.

He noted private investors would do what they do because they “want to be successful.”

As White House officials have explained, investors in Opportunity Zones could get tax benefits by deferring their capital gains taxes invested in the zones until 2026. They also could receive discounts of up to 15 percent on capital-gains profits invested in the zones and would pay no capital-gains taxes on investments in the zones held for at least 10 years.

Family now charged in death of Georgia boy buried in yard

Five relatives charged in the death of a Georgia girl now faces charges in the death of her brother as well.

The Savannah Morning News reports their father, 50-year-old Elwyn Crocker Sr., their stepmother and three others are each indicted on two charges of felony murder, child cruelty and concealing a death.

Effingham County sheriff's investigators say a tip led authorities in December to the bodies of 14-year-olds Mary Crocker and Elwyn Crocker Jr, which were buried in their father's yard. Both had been homeschooled and never reported missing.

The indictment issued last week alleges that like his sister, Elwyn had been beaten, starved and kept in a dog crate.

The defendants are set to be arraigned next month.

KIEV (Reuters) – Comic actor Volodymyr Zelenskiy is the frontrunner in Ukraine’s presidential election, according to the latest opinion poll published on Wednesday.

A survey, conducted by the Kiev-based Razumkov Center, showed the 41-year-old Zelenskiy, a political novice, was ahead of current President Petro Poroshenko and opposition leader Yulia Tymoshenko.

The center said it had interviewed 2016 voters in all regions, except in annexed Crimea, from Feb. 7 to Feb 14.

The election takes place on March 31, where 44 candidates are set to compete.

NEW YORK (Reuters) – The Federal Reserve may lower the interest it pays on excess reserves banks leave with it by 5 basis points at its April 30-May 1 policy meeting in a bid to prevent the federal funds rate from drifting higher, Morgan Stanley analysts said on Friday.

This would mark the third such “technical” adjustment on the interest on excess reserves (IOER) following cuts last June and December.

In response to the news that the U.S. economy rose 3.2 percent in the first quarter of 2019, White House National Economic Council Director Larry Kudlow said that this “prosperity cycle” will continue if President Trump‘s policies stay in place.

Calling the advance in gross domestic product a “blow-out number,” Kudlow told “America’s Newsroom” Friday that it serves as concrete proof Trump’s measures to grow the economy have been successful.

“I’ll just say, Trump’s policies to rebuild the economy, lower taxes, regulations, opening energy, trade reform. Look, this stuff is working,” he said.

“It tells me, among other things, that the prosperity cycle we have entered into is continuing, it is strong. It has legs and momentum and frankly it is going to go on for quite some time,” he continued. “This is the new Trump economy. Some people don’t like that or they don’t agree with that. I respect the differences but I’ll tell you it’s working.”

Kudlow said the Trump administration is also working with House Speaker Nancy Pelosi and other Democratic leaders to implement bipartisan deals to ensure the continuation of the GDP’s success.

“If the policies and the principles remain in place — and I believe they will — then I believe this new prosperity expansion cycle is going to go on for a whole bunch of more years,” he said.

(Reuters) – World number one Naomi Osaka came from behind in the final set to beat Croatian Donna Vekic 6-3 4-6 7-6(4) on Friday and move into the Porsche Tennis Grand Prix semi-finals.

Osaka comfortably won the opening set but was tested by the Croatian, who pushed her to the limit in the second and third. The Japanese made 45 unforced errors as she struggles to get to grips with swapping hard courts for clay.

Osaka was visibly frustrated and trailed 5-1 in the final set but she refused to give up and found her rhythm to break Vekic twice and prevent her from serving for the match.

In the tiebreaker, a confident Osaka upped her baseline game and had two early mini breaks before wrapping up the match in two hours and 18 minutes. An infuriated Vekic even smashed her racket after losing the match.

“I told myself I didn’t want to have any regrets here,” Osaka said. “I was stressed out when I went down 1-5… but this (comeback) was pretty good because I don’t play really well on clay.”

Earlier, world number three Petra Kvitova came back from a set down to beat Anastasija Sevastova 2-6 6-2 6-3 and move into the tournament’s semi-finals for the third time in her career.

Sevastova had a dream start, breaking Kvitova twice to take a 3-0 lead as the Czech struggled with her first serve. Kvitova also made a slew of unforced errors, with many of her returns going long.

Sevastova used the full width of the court to get the better of Kvitova, who played on the back foot for much of the first set as the Latvian gave her little time to catch her breath.

However, Kvitova recovered in the second set and she broke Sevastova’s serve when she was 3-2 up, winning 10 straight points to take a 5-2 lead. Sevastova looked shaken and was broken again to give Kvitova the second set.

Kvitova took command in the final set and broke a visibly upset Sevastova to take a 3-1 lead before easing into the semis.

“In the first set I missed almost everything. I was pretty slow and she just couldn’t miss,” Kvitova said. “In the second set it was very important for me to stay on my serve and the chance to break her came.”

Kiki Bertens plays Angelique Kerber later on Friday and Victoria Azarenka faces Anett Kontaveit in the last quarter-final.

President Donald Trump says he feels “young” and “vibrant” at age 72 and thinks he can beat 76-year-old Joe Biden “easily.”

A reporter asked Trump at the White House on Friday how old is too old to be president of the United States.

Trump said: “I just feel like a young man. I’m so young. I can’t believe it. … I’m a young vibrant man.”

Then he smiled and said he’s not sure about Democratic presidential contender Biden, the second-oldest contender in the race behind Bernie Sanders.

Trump said: “I look at Joe. I don’t know about him.”

Biden, in an interview on ABC’s “The View,” joked in response that if Trump “looks young and vibrant compared to me, I should probably go home.”

The Latest on fatal pileup on Interstate 70 near Denver (all times local):

10:10 a.m.

Colorado officials say four people have died after a semi-truck hauling lumber plowed into vehicles on Interstate 70, causing a fire so intense that it melted the roadway and metal off of cars.

Authorities had to wait until daylight Friday to confirm the death toll from Thursday’s 28-vehicle pileup because of the devastation caused by the fire.

Six people were taken to hospitals with injuries. Their conditions are unclear.

Lakewood police spokesman Ty Countryman says the driver of the truck who caused the crash sustained minor injuries. He has been arrested on suspicion of vehicular homicide.

Officials say the driver was headed down a hill when he slammed into slower traffic. Countryman says there is no indication the crash was intentional.

A truck driver blamed for causing a deadly pileup involving over two dozen vehicles near Denver has been arrested on vehicular homicide charges.

Lakewood police spokesman Ty Countryman said Friday that there’s no indication that drugs or alcohol played a role in Thursday’s crash.

The unidentified driver was headed down a hill on Interstate 70 when he slammed into slower traffic and sparked a massive fire. Countryman said police are looking at whether his brakes were working properly.

He said 28 vehicles were involved, up from the initial 15 vehicles police reported after further sorting through the burned wreckage.

Police still say there were multiple fatalities but are still working to provide an exact number.

The highway is expected to remain closed until Saturday.
